Provisions on Quality and Safety Management of Aquaculture

Chapter I General Provisions Article 1 These Provisions are formulated in accordance with the Fisheries Law of People's Republic of China (PRC) and other laws and administrative regulations in order to improve the quality and safety of aquaculture products, protect the fishery ecological environment and promote the healthy development of aquaculture. Article 2 Units and individuals engaged in aquaculture in People's Republic of China (PRC) shall abide by these Provisions. Article 3 The Ministry of Agriculture is in charge of the management of aquaculture quality and safety throughout the country.

The fishery administrative departments of the local people's governments at or above the county level shall be in charge of the quality and safety management of aquaculture within their respective administrative areas. Article 4 The State encourages aquaculture units and individuals to develop healthy aquaculture and reduce the occurrence of aquaculture diseases. Control aquatic drugs to ensure the quality and safety of aquaculture products; Promote ecological agriculture and protect the agricultural environment.

The state encourages breeding units and individuals to apply for pollution-free agricultural products certification in accordance with relevant regulations. Chapter II Aquaculture Water Article 5 Aquaculture water shall meet the standards of the Ministry of Agriculture, such as the water quality of pollution-free food in mariculture (NY5052-200 1) or pollution-free food in freshwater culture (NY505 1-200 1), and it is forbidden to use water sources that do not meet the standards of aquaculture water quality. Sixth aquaculture units and individuals should regularly monitor the quality of aquaculture.

When the aquaculture water source is polluted, it should be stopped immediately; If it is really necessary to use it, it should be purified to meet the water quality standard of aquaculture.

When the water quality of aquaculture water does not meet the standards of aquaculture water quality, measures should be taken immediately to deal with it. If it still does not meet the requirements after treatment, it shall stop its aquaculture activities and report to the local fishery administrative department, and its aquaculture products shall be treated in accordance with Article 13 of these Provisions. Article 7 The water intake and drainage systems of farms and ponds shall be separated. The discharge of aquaculture wastewater shall meet the discharge standards prescribed by the state. Chapter III Aquaculture Production Article 8 The fishery administrative department of the local people's government at or above the county level shall reasonably determine the aquaculture waters and beaches according to the requirements of aquaculture planning, and at the same time, divide the aquaculture functional areas according to the environmental conditions of the waters and beaches, rationally arrange the layout of aquaculture production, and scientifically determine the scale and mode of aquaculture. Ninth units and individuals engaged in aquaculture using waters and beaches shall apply for aquaculture licenses in accordance with the relevant provisions and engage in aquaculture production in accordance with the approved area and scale. Article 10 Aquaculture production shall meet the operational requirements of the relevant national technical specifications for aquaculture. Aquaculture units and individuals shall be equipped with water treatment facilities and corresponding basic instruments and equipment such as water quality and aquatic biological detection that are suitable for aquaculture water bodies and production capacity.

The fry used in aquaculture shall meet the national or local quality standards. Eleventh aquaculture professional and technical personnel should be gradually in accordance with the relevant national employment requirements, through vocational skills training and obtain professional qualification certificates, before taking up their posts. Article 12 Breeding units and individuals shall fill in the breeding production records (see Annex 1 for the format), and record the breeding species, the source and growth of fry, the source and feeding of feed, and the changes of water quality. "Aquaculture Production Records" shall be kept for more than 2 years after all the aquatic products in this batch are sold. Thirteenth aquaculture products sold shall meet the relevant national or local standards. Products that do not meet the standards should be purified, and products that still do not meet the standards after purification are prohibited from being sold. Fourteenth aquaculture units selling autotrophic aquatic products shall be accompanied by a "product label" (see Annex 2 for the format), indicating the name, address, product type, specifications, date of leaving the pool, etc. Chapter IV Aquatic Feed and Drugs Article 15 The use of aquatic feed shall conform to the Regulations on the Administration of Feed and Feed Additives and the Safety Limit of Fishery Feed for Pollution-free Food (NY5072-2002) of the Ministry of Agriculture. Encourage the use of compound feed. It is restricted to directly feed chilled (frozen) bait to prevent residual bait from polluting water quality.

It is forbidden to use feed and feed additives without product quality standards, quality inspection certificates, production licenses and product approval numbers. It is forbidden to use spoiled and expired feed. Article 16 The use of aquatic drugs shall conform to the Regulations of the Ministry of Agriculture on the Administration of Veterinary Drugs and the Guidelines for the Use of Fishery Drugs for Pollution-free Food (NY507 1-2002). Aquaculture products using drugs shall not be used for human consumption during the withdrawal period.

It is forbidden to use fake and inferior veterinary drugs and drugs, other compounds and biological agents prohibited by the Ministry of Agriculture. Raw materials shall not be directly used for aquaculture. Seventeenth aquaculture units and individuals should be in accordance with the requirements of the instructions for the use of aquaculture drugs or under the guidance of aquatic disease prevention and control personnel, scientific drug use.

Aquatic disease prevention and control personnel shall, in accordance with the requirements of employment access, receive vocational skills training and obtain vocational qualification certificates before taking up their posts. Eighteenth aquaculture units and individuals shall fill in the "aquaculture drug records" (see Annex 3 for the format), and record the occurrence of diseases, main symptoms, drug name, time and dosage. "Aquaculture Drug Use Record" shall be kept for more than 2 years after all the aquatic products in this batch are sold. Nineteenth fishery administrative departments at all levels and technical popularization institutions shall strengthen the publicity, training and technical guidance on the safe use of aquaculture drugs. Article 20 The Ministry of Agriculture shall be responsible for formulating the national monitoring plan for drug residues in aquatic products and organizing its implementation.

The fishery administrative departments of the local people's governments at or above the county level shall be responsible for the monitoring of drug residues in aquatic products within their respective administrative areas.
