Chapter I General Provisions

Article 1 In order to further guarantee the basic livelihood and promote social equity, these Measures are formulated in accordance with the Interim Measures for Social Assistance and the Regulations of Guangdong Province on Social Assistance, combined with the actual situation in our province.

Article 2 * * * Families whose per capita income, property and living conditions meet the requirements of marginal families with local minimum living guarantee and families with difficult expenses can be identified as marginal families with minimum living guarantee and families with difficult expenses respectively after application and verification.

Article 3 The civil affairs departments of the people's governments at or above the county level shall co-ordinate the identification of marginal minimum living guarantee families and families with financial difficulties within their respective administrative areas. Education, justice, finance, human resources and social security, housing and urban construction, agriculture and rural areas, health, emergency management, medical insurance, government service data management, taxation, trade unions, disabled persons' federations and other units at or above the county level shall, according to their respective functions and duties, do a good job in related work.

Article 4 The civil affairs department of the people's government at the county level shall be responsible for the examination and confirmation of marginal families with minimum living guarantee and families with difficult expenses.

Township people's governments and sub-district offices are responsible for the application, acceptance, investigation and preliminary examination of marginal families with minimum living security and families with financial difficulties.

Villagers' committees and residents' committees assist in policy propaganda, active discovery, household survey, democratic appraisal and data collection, and help families with difficulties in applying to submit their applications.

Where conditions permit, the power of examination and confirmation can be delegated to township people's governments and sub-district offices according to procedures, and the civil affairs departments of county-level people's governments will strengthen supervision and guidance.

Article 5 The civil affairs department of the people's government at the provincial level shall establish a bottom-line information management system for people's livelihood, and provide information check and inquiry for the confirmed objects.

Education, household registration management, taxation, social insurance, real estate registration, commercial registration, housing provident fund management, vehicle and vessel management, supervision of prisoners and other banks, insurance, securities and other financial institutions shall provide relevant data verification services for the civil affairs departments to check the applicant's family population, income and property status.

Civil affairs departments shall, according to the requirements of government information, share the information of marginal families with minimum living security and families with difficulties in spending with relevant units.

Article 6 All localities shall provide corresponding social assistance to marginal families with minimum living security and families with financial difficulties, or provide other necessary assistance measures.

Chapter II Identification Conditions

Seventh marginal families with minimum living security and families with financial difficulties shall be determined by the applicant's declaration, information inquiry, verification of family economic situation and comprehensive evaluation of family living conditions.

Article 8 The term "family" as mentioned in these Measures consists of family members who live together, including:

(1) spouse;

(2) Parents and minor children;

(3) children who have grown up but cannot live independently, including adult children who have received undergraduate education or below;

(4) Other persons who have the legal obligation to support, support and support and live together for a long time, including adult unmarried children who have not set up separate households.

The following persons are not included in the family members living with * * * *:

(a) living independently from the family for more than 3 years (including 3 years);

(2) Persons who have served their sentences in prison and are forced to be isolated for drug rehabilitation;

(3) A person declared missing by the court;

(four) family members registered in the same household registration, but living together with * * * *, have no obligation to support, support and support.

Ninth marginal families enjoying the minimum living guarantee shall meet the following conditions:

(a) the applicant or a family member living with * * * has a local household registration;

(2) Before the date of application, the per capita monthly income of the family is less than 1.5 times of the local urban minimum living standard, and shall not exceed the local monthly minimum wage standard.

Tenth families with financial difficulties shall meet the following conditions at the same time:

(a) the applicant or a family member living with * * * has a local household registration;

(two) the per capita annual income of the family is lower than the per capita disposable income of the residents in the county (city, district) where the household registration is located in the previous year;

(3) * * * The rigid expenditure of medical treatment, education, disability rehabilitation or disasters and accidents of family members living together reaches or exceeds 60% of their annual family income.

Article 11 Family income refers to all cash and in-kind income of family members living together within the prescribed time limit.

Urban and rural residents' basic old-age insurance, basic pension, social assistance funds and materials, scholarships, living allowance for disabled people with difficulties, nursing allowance for severely disabled people, basic living allowance for orphans, basic living allowance for children without actual dependents, old age allowance, elderly people with financial difficulties, disability and other subsidies, preferential payments for conscripts, pensions and preferential treatment for entitled groups, family planning incentives and support, and courageous incentives are not included in family income.

The necessary employment costs and rigid expenditures of family members living together can be appropriately deducted according to regulations when calculating family income.

Twelfth family property refers to all movable property (including bank deposits, securities, funds, commercial insurance, creditor's rights, internet financial assets and carriers, etc.). Real estate (including houses, trees and other fixtures) owned by family members living together (including accepting inheritance and gifts), and other items that should be included in family property. After the family property status is determined, the property necessary to maintain family production and life can be exempted.

Article 13 The rigid expenditure of families with expenditure difficulties shall be calculated according to the total expenditure of 12 months before the applicant applies, mainly including:

(1) medical expenses. Refers to the medical expenses actually paid by individuals in medical institutions after deducting basic medical insurance, serious illness insurance, other supplementary medical insurance, commercial health insurance, medical assistance and charitable assistance, which are determined on the basis of bills in principle;

(2) Education expenditure. Refers to the personal burden of family members attending kindergarten and full-time academic education in China, such as teaching fees, tuition fees, accommodation fees, etc., which are determined in principle according to the benchmark quota provided by the school education department. Private schools (kindergartens), with reference to the local similar public schools (kindergartens) fee standards identified;

(3) Disability rehabilitation and other expenses. Refers to the expenses actually paid by individuals, such as basic rehabilitation training, nursing and assistive devices adaptation, which are determined on the basis of bills in principle after deducting government subsidies, charitable assistance and commercial insurance compensation;

(four) the household rigid expenditure determined by the relevant departments at or above the county level can be identified as rigid expenditure due to disasters and accidents.

Article 14 The property under the names of marginal families with minimum living security and family members with financial difficulties shall meet the following conditions at the same time:

(1) Upon verification, the per capita amount (market value) of financial assets under the names of family members does not exceed the 24-month minimum living standard of local towns;

(2) The total number of residential real estate (including houses and apartments) under its name does not exceed 1 set (building), and there is no residential real estate (including shops, garages and office buildings) under its name;

(3) There are no motor vehicles under its name (except disabled scooters, fuel motorcycles and battery cars);

(4) There is no commercial registration information in its name.

The family already owns 1 residential property, and also owns mud brick houses or ancestral houses left by parents and above, but the family members who apply for non-residential houses are not considered as exceeding the housing standards.

If it is found that the industrial and commercial registration information is in the name of a family member and belongs to a couple's small workshop or canteen without employees (except for high-end tobacco, alcohol and luxury goods), you can apply for review. After investigation and verification by the staff, it is deemed that there is no industrial and commercial registration.

Fifteenth any of the following circumstances, shall not be identified as the minimum living security marginal families and families with financial difficulties:

(a) refusing to cooperate with the relevant departments to investigate the economic situation of the applicant family and its related personnel, which makes it impossible to verify its economic situation;

(two) families who refuse to provide a power of attorney for economic inquiry and verification or provide a false and incomplete power of attorney for economic inquiry and verification, resulting in the inability to conduct a comprehensive information check on their economic situation according to law;

(three) families who study at their own expense in kindergartens, schools at all levels and off-campus training institutions, and families who study abroad at their own expense;

(four) the per capita income or property of the family exceeds the prescribed standard.

Chapter III Application for Examination and Confirmation

Article 16 Where an application is recognized as a marginal family with minimum living security or a family with difficult expenses, it shall be submitted by the applicant to the township people's government and sub-district office where any family member is registered; If it is difficult for family members to apply, they may entrust the villagers' committee or residents' committee where any family member's household registration is located to apply on their behalf; If it is difficult to apply to the township people's government or street office where the household registration is located, you can submit the application materials at the social assistance window of any township people's government or street office in this province.

The applicant shall provide all the original household registration books, identity cards and other documents of family members living together, and sign the power of attorney for checking the economic situation, and entrust the township people's government and sub-district offices that accept the application for checking.

Article 17 The Township People's Government and sub-district offices entrusted with inquiry and verification shall, within 2 working days from the date when the applicant signs the Power of Attorney for Inquiry and Verification of Economic Conditions, carry out inquiry and verification of family economic conditions information in accordance with the local minimum living guarantee marginal families and families with financial difficulties.

Eighteenth by the family economic information query and check, in line with the standards, the Township People's government, street offices shall accept, and issue a notice of acceptance within 2 working days; Do not meet the standards, will not be accepted, and within 2 working days to the applicant issued a notice of rejection and review report.

If the applicant has any objection to the verification report, the Township People's Government and the sub-district office shall review the applicant's family economic situation and issue a review report. For the same family, in principle, the review report will not be repeated within 30 days. Reports issued for the same family many times shall be subject to the results of the latest report.

Article 19 Township people's governments and neighborhood offices shall, with the assistance of villagers' committees and residents' committees, organize staff to conduct household investigation and verification within 10 working days from the date of issuing the acceptance notice, and complete a comprehensive assessment of the applicant's family life.

Household investigators should be no less than 2 people, and produce valid certificates during the investigation. After the investigation, evaluation materials shall be issued, which shall be signed, sealed or fingerprinted by the investigator and the respondent respectively.

Where the domicile of the applicant's family members is inconsistent with the place of residence, the township people's government and sub-district office accepting the application may entrust the township people's government and sub-district office where the applicant's family members live to conduct household investigation and verification. The entrusted township people's government and sub-district office shall complete the investigation and verification within 10 working days from the date of receiving the power of attorney, and deliver the evaluation materials to the township people's government and sub-district office that accept the application.

Article 20 Township People's governments and sub-district offices shall put forward preliminary opinions within 5 working days from the date of issuing or receiving evaluation materials, and publicize the results in village affairs public columns, community public columns and public service halls of township people's governments and sub-district offices set up by villagers' committees and residents' committees. Conditional should also be publicized through the network platform for 7 days.

If there is no objection at the expiration of the publicity period, the Township People's Government and the sub-district office shall submit relevant materials to the civil affairs department of the people's government at the county level within 3 working days from the date of the expiration of the publicity period; During the publicity period, if there are objections and valid certification materials can be provided, the Township People's Government and sub-district offices shall reorganize the investigation, carry out democratic appraisal, re-submit preliminary examination opinions, and submit the results of democratic appraisal and related materials to the civil affairs department of the people's government at the county level.

Democratic assessors are composed of township people's governments, street office staff, members of village and community party organizations, members of villagers' committees and residents' committees, and representatives of villagers and residents.

Article 21 The civil affairs department of the people's government at the county level shall, within 10 working days from the date of receiving the relevant materials and democratic appraisal results submitted by the township people's government and sub-district offices, make a decision on examination and confirmation. To meet the application conditions, the issuance of the "minimum living security marginal family card" or "family card with difficulties in spending"; Not to confirm the unqualified application, and inform the applicant in writing and explain the reasons within 3 working days.

The civil affairs department of the people's government at the county level shall conduct a comprehensive review of the application materials, evaluation materials and preliminary examination opinions submitted by the township people's government and sub-district offices, and then make a decision on examination and confirmation.

Article 22 The civil affairs department of the people's government at the county level shall publish the information of marginal families with minimum living security and families with financial difficulties through the public affairs column, village affairs column, community public column, township people's government, subdistrict office, public service hall and online platform. The contents to be announced include the name of the applicant, the number of family members, and the way of assistance. , but shall not disclose information unrelated to assistance.

If there is any objection after the announcement, the civil affairs department of the people's government at the county level shall organize the investigation and verification within 10 working days from the date of receiving the objection, and publish the investigation results.

Twenty-third minimum living security marginal families, families with financial difficulties and other family economic conditions have changed significantly, it should be reported to the Township People's government and street offices in a timely manner. Meet the minimum living guarantee, poor people support and other social assistance conditions, the Township People's government, neighborhood offices shall, according to the family income and property status, timely assist in applying for relevant social assistance; Those who no longer meet the conditions for the identification of marginal families with minimum living security and families with financial difficulties will be disqualified according to procedures.

Article 24 If, after examination, the object applying for or withdrawing from the minimum living guarantee and supporting the destitute persons exceeds the minimum living guarantee or the conditions for identifying destitute persons and meets the conditions for identifying marginal families with minimum living guarantee or families with difficult expenses, the Township People's Government and sub-district offices can directly transfer to the procedures for identifying marginal families with minimum living guarantee or families with difficult expenses according to their application materials and investigation and verification, and the relevant application materials will not be submitted repeatedly, thus simplifying the workflow.

Chapter IV Relief Measures

Twenty-fifth patients with serious illness in marginal families with minimum living security (locally stipulated patients with serious illness), first-and second-class disabled persons, third-and fourth-class mentally disabled persons and intellectually disabled persons are separately included in the minimum living security scope.

The minimum living guarantee for the disabled in marginal families enjoys the living allowance for the disabled with difficulties.

(3) High school education funds. For family members attending high school education (including secondary vocational education), state grants and tuition subsidies are given;

(4) Higher education funds. For family members studying in ordinary colleges and universities (including higher vocational colleges and junior colleges), state grants are given, and educational aid such as state student loans, work-study programs and school grants are provided;

(five) to provide home school education, distance education or other appropriate educational services for disabled children who cannot receive compulsory education. Strengthen the responsibility of joint prevention and control of compulsory education, and ensure that children with severe disabilities and multiple disabilities with learning conditions receive compulsory education on an equal footing.

Twenty-eighth families with housing difficulties, such as marginal families with minimum living security and families with financial difficulties, can enjoy housing assistance after being confirmed by the housing security application review procedure:

(a) for urban housing assistance objects, priority should be given to the allocation of public rental housing or urban housing security family rental subsidies, in which the allocation of public rental housing can be given appropriate rent concessions according to the actual situation;

The people's governments at or above the county level shall take targeted measures to ensure that at least 1 person of marginal families with minimum living security and families with difficult expenses are employed.

Thirtieth minimum living security marginal families and families with financial difficulties in the elderly aged 60 and above enjoy the following pension services:

(1) Services provided by home and community service centers, day care centers, canteens for the elderly and other service organizations organized or entrusted by the government;

(2) Elderly people aged 60 and above from marginal families with minimum living security can apply for pension service subsidies and give priority to public pension institutions.

Thirty-first provide free legal services for marginal families with minimum living guarantee and family members with financial difficulties who meet the conditions of legal aid.

Chapter V Supervision and Administration

Thirty-fourth civil affairs departments of people's governments at or above the county level and township people's governments and sub-district offices shall set up report boxes or telephone numbers to accept supervision by the masses and society.

The civil affairs department of the people's government at the county level shall conduct spot checks at home according to a certain proportion and make a review decision.
