Drugs as mentioned in these Regulations refer to opium, heroin, methamphetamine (ice), morphine, marijuana, cocaine and other narcotic drugs and psychotropic substances that can make people addicted as stipulated by the state.
Where laws and administrative regulations have already provided for drug administration, such provisions shall prevail. Article 3 Drug control is the common responsibility of the whole society. State organs, social organizations, enterprises and institutions, other organizations and citizens shall perform their duties or obligations in drug control according to law. Article 4 The anti-drug work adheres to the principle of giving priority to prevention, comprehensive management, prohibition of seeds, drugs, trafficking and smoking, and implements the working mechanism of unified leadership by the government, responsibility of departments and extensive participation of society. Article 5 The people's governments at or above the county level shall incorporate the drug control work into the national economic and social development plan, and the required funds shall be included in the fiscal budget at the corresponding level, which shall be used for special purposes and shall not be withheld or misappropriated.
The performance of drug control work is included in the construction of peace, rule of law, spiritual civilization and government performance evaluation. Article 6 The Narcotics Control Committee of the people's governments at or above the county level shall be responsible for organizing, coordinating and guiding the drug control work in their respective administrative areas, and perform the following duties:
(a) to formulate drug control work plans, plans and work measures;
(two) publicity of drug laws, regulations and rules, and inspection of the implementation;
(3) Establish and improve the drug situation monitoring and evaluation and drug situation notification mechanism, and regularly publish the drug situation and changes;
(4) urging the member units of the anti-drug committees at the same level and the anti-drug committees at lower levels to perform their duties and organize the assessment;
(five) coordinate and solve major problems in drug control work;
(six) to perform other duties entrusted by the superior anti-drug commission and the people's government at the same level.
The Anti-Narcotics Committee has an office, and it is clear that full-time staff will undertake the daily work of the Anti-Narcotics Committee. Article 7 Member units of the Narcotics Control Committee shall incorporate the drug control work into their overall work plans and annual plans, perform their duties in drug control work according to law, and regularly report the drug control work to the Narcotics Control Committee at the corresponding level.
The public security organs are responsible for drug investigation, investigation and dynamic control of drug addicts, management, supervision and inspection of the purchase, sale and transportation of precursor chemicals, publicity and education on the rule of law against drugs, management of compulsory isolation drug rehabilitation centers and drug rehabilitation places under their jurisdiction, and provision of guidance and support for community drug rehabilitation and community rehabilitation.
The judicial administrative department is responsible for the management of compulsory isolation drug rehabilitation centers and drug rehabilitation places under its jurisdiction, and provides guidance and support for community drug rehabilitation and community rehabilitation.
The administrative department of health is responsible for the supervision and management of drug rehabilitation medical institutions, guiding drug rehabilitation medical services, sending medical personnel to compulsory isolation drug rehabilitation places, and organizing the prevention and treatment of mental disorders caused by drug abuse.
Other member units of the Narcotics Control Committee shall carry out drug control work in accordance with their respective responsibilities. Article 8 Encourage and support social forces to participate extensively in anti-drug propaganda, scientific research, drug rehabilitation and social welfare services.
Encourage and support social organizations, enterprises, institutions and other organizations and individuals to donate to the drug control work, and give tax incentives according to law.
Encourage the transformation of scientific and technological achievements in drug control, develop and popularize advanced drug control technologies, equipment and drug rehabilitation methods, and encourage institutions of higher learning, scientific research units and colleges to carry out drug control scientific and technological research and personnel training. Article 9 Units and individuals are encouraged to report drug crimes.
People's governments at all levels and relevant departments shall establish a reward and confidentiality system to protect informants, and commend and reward those who report meritorious service and units and individuals who have made outstanding contributions in drug control work. Chapter II Publicity and Education Article 10 The people's governments at or above the county level shall establish and improve the anti-drug publicity and education system, combine anti-drug publicity and education with citizens' legal education, moral education and health education, establish anti-drug education bases or determine fixed anti-drug education places, provide anti-drug publicity and education services to the society free of charge, and improve citizens' ability to prevent drugs.
The Narcotics Control Committee and its member units shall, according to the actual situation, compile and produce anti-drug knowledge books, audio-visual products and Internet cultural products. And use all kinds of media to popularize the knowledge of drug harm and prevention to the whole society. Eleventh state organs, social organizations, enterprises, institutions and other organizations shall, in combination with their respective responsibilities, carry out anti-drug publicity and education for their own personnel. Twelfth education administrative departments and schools should incorporate anti-drug knowledge into education and teaching content, and carry out anti-drug publicity and education for students. Public security organs, judicial administrative departments and health administrative departments shall provide assistance. Thirteenth trade unions, the Communist Youth League and women's federations shall, according to the characteristics of their respective working objects, organize anti-drug publicity and education.
