Neighborhood (village) committees or owners' committees may formulate neighborhood (village) conventions and supervise their implementation in accordance with the law on matters related to dog management in this residential area.
Social groups and organizations such as dog industry associations, pet associations and animal protection organizations should educate their members to abide by dog-raising laws and regulations, popularize dog-raising knowledge, and assist relevant government departments to carry out publicity and education activities on dog-raising in accordance with the law.
Article 6 The areas within ring highway of this Municipality are key dog management areas (hereinafter referred to as key management areas), and the areas outside ring highway are general dog management areas (hereinafter referred to as general management areas).
By the decision of the county (city, district) people's government, the urbanization management area in the general management area can be managed according to the key management area.
Article 7 A dog immunization system shall be implemented in key management areas and general management areas, and a dog registration system shall be implemented in key management areas.
No unit or individual may raise dogs without immunization registration in key management areas, or raise dogs without immunization registration in general management areas.
Article 8 Individuals with legal identity certificates and full capacity for civil conduct may raise dogs.
Cultural relics protection units, dangerous goods storage units, important storage units, animal performance units and military, public security, scientific research, medical and health units can raise dogs because of special needs.
Individuals and units can only raise dogs in their own houses or areas, but they are not allowed to raise dogs in the office and production service areas of organs, enterprises and institutions, hospitals, kindergartens, school teaching areas and student dormitory areas (hereinafter referred to as the no-raising areas).
Ninth key management areas prohibit individuals from raising large dogs and strong dogs, except for the blind and the disabled with severe physical disabilities.
It is forbidden for individuals to raise large dogs and strong dogs. The standards for height and length shall be determined by the municipal public security department in conjunction with the animal husbandry and veterinary department, and announced after being approved by the Municipal People's Government.
Article 10 In key management areas, public security and animal husbandry and veterinary departments shall set up joint offices in all districts, and implement joint offices to facilitate dog owners to handle dog immunization and registration procedures. Joint office space shall be announced to the public.
Eleventh dogs in key management areas shall go through the initial registration and immunization procedures within fifteen days from the date of obtaining dogs; From the second year onwards, the annual registration and immunization procedures will be handled every year.
Twelfth key management areas, individuals for the initial registration of dogs, immunization procedures, should bring dogs and truthfully submit the following materials:
(a) proof of the source of the dog;
(two) household registration book, temporary residence permit or ID card and other legal identification;
(3) The house ownership certificate, house lease contract or other legal residence certificate of the kennel.
Feeding guide dogs and disabled dogs shall also submit the "People's Republic of China (PRC) Disabled Persons' Card".
Thirteenth key management areas and units shall truthfully submit the following materials when handling the initial registration and immunization procedures for dogs:
(a) proof of the source of the dog;
(two) the unit code certificate or business license;
(3) written proof of the management facilities such as kennel, kennel and kennel, and the use, type and quantity of dogs;
(four) the corresponding safety management system and the list of full-time domesticated personnel.
If you keep police dogs, you should also submit written instructions and a map of the warning area.
Fourteenth public security and animal husbandry and veterinary departments shall handle the initial registration and immunization procedures in accordance with the following procedures:
(a) the public security department to review the materials submitted by dog owners and dogs;
(two) after passing the examination, the animal husbandry and veterinary department shall carry out health examination on the dogs, inject rabies vaccine and implant electronic tags;
(3) The public security department shall register the dog owners and their dogs, and issue the dog registration certificate, number plate and dog manual to the dog owners.
The electronic tag shall contain information such as the name of the dog owner, the location of the dog, the number of dogs, and the time of rabies vaccine injection.
Fifteenth dog owners shall submit the dog registration certificate and number plate when handling the annual registration and immunization procedures. Public security and animal husbandry and veterinary departments shall register and immunize healthy dogs.
Sixteenth public security departments should establish dog management files, animal husbandry and veterinary, urban management administrative law enforcement (comprehensive law enforcement), industry and commerce, health and other departments can consult.
Seventeenth registered dogs transfer, gift, loss, death or move out of key management areas, the original dog owners shall go through the formalities for cancellation of registration; In the key management area to change the location of the dog, the dog owner shall go through the registration formalities for change; If the dog registration certificate and number plate are damaged or lost, the dog owner shall reissue them.
If a dog dies, it shall be handed over to the animal husbandry and veterinary department for harmless treatment. The harmless treatment field is set up by the animal husbandry and veterinary department.
Article 18 Foreigners who bring dogs to stay in this city must hold the animal quarantine and immunization certificate signed by the animal husbandry and veterinary department at or above the county level where the dogs were originally located, and stay in key management areas for more than three months, and go through the registration formalities in accordance with these Provisions.
Nineteenth dogs in key management areas shall pay management service fees. Small ornamental dogs, management service fee for each dog in 400 yuan in the first year, and 200 yuan every year thereafter; For other dogs, the management service fee is 800 yuan for each dog in the first year and 400 yuan every year thereafter.
Feeding blind guide dogs and disabled auxiliary dogs with severe physical disabilities is free of management service fees.
Twentieth dog management service fees charged by the competent department of dog. The dog management service fees collected shall be turned over to the municipal finance, incorporated into the financial budget management, and used for the management service fees such as dog immunization and dog registration, and subject to the supervision and inspection of relevant departments.
Article 21 Any unit or individual shall abide by social ethics when raising dogs, and shall not interfere with or infringe upon public interests and the legitimate rights and interests of others, interfere with the normal life of neighbors and others, or abandon dogs.
Dogs in key management areas must also comply with the following provisions:
(a) can only be raised within the scope of its registration.
(two) large dogs and strong dogs should be kept in captivity or tied up, and shall not leave the breeding place unless it is necessary for work.
(three) when the dog barking affects others' rest, effective measures should be taken to stop it in time.
(4) Dogs should carry the dog registration certificate when they go out. Dogs should be registered, and people with full capacity for civil conduct should use leashes (ropes) for traction, and take the initiative to avoid others and vehicles. The longest towing rope (rope) shall not exceed1.5m..
(5) If you take the elevator with your dog, you should avoid the rush hour when taking the elevator, and put a muzzle on the dog or put the dog in a dog cage or dog bag.
(six) dogs are not allowed to take public transport other than passenger taxis. When taking a taxi, you must obtain the driver's consent and put the dog into a dog cage and a dog bag.
(7) Dogs are not allowed to enter government agencies, schools, kindergartens, hospitals (excluding pet hospitals), parks, scenic spots, martyrs' cemeteries, squares, exhibition halls, museums, libraries, science and technology museums, theaters, sports venues, community gymnasiums, waiting rooms, playgrounds, markets, shops, hotels, restaurants, food stalls and other places.
(eight) dogs are not allowed to bathe or swim in public waters such as springs and canals.
(nine) when the dog goes out, the dog owner shall promptly remove the feces excreted by the dog.
Article 22 The public security department shall set up a dog reception center, which is responsible for receiving and handling abandoned dogs, ownerless dogs, injured dogs and confiscated (temporarily detained) dogs. The public security department can announce the adoption of healthy dogs without owners to the public.
Article 23 Where a dog is raised in the general management area, the dog owner shall inject rabies vaccine for the dog within 15 days from the date of obtaining the dog, receive the dog immunization certificate issued by the animal husbandry and veterinary department, and immunize the dog every year.
Twenty-fourth dog farms, dog trading markets and dog service institutions shall abide by the relevant provisions of animal epidemic prevention, and go through the registration formalities in the industrial and commercial registration according to law.
No unit or individual may set up dog farms in key management areas, spring water supply areas and drinking water source protection areas, set up large dogs and strong dogs trading markets in key management areas, or engage in dog trading outside dog farms and dog trading markets.
Dogs sold must have animal quarantine certificates and canine immunization certificates issued by animal husbandry and veterinary departments.
Twenty-fifth dog owners find or suspect that their dogs only have rabies symptoms, and shall promptly send them to the animal husbandry and veterinary department for inspection.
Animal husbandry and veterinary departments have the right to detain and quarantine dogs suspected of having infectious diseases during quarantine or inspection; Dogs found to be suffering from rabies shall be killed and killed according to law, and the dead bodies of dogs shall be treated harmlessly.
When rabies epidemic occurs, it shall be disposed of according to law.
Twenty-sixth in violation of the provisions of the act, any unit or individual has the right to criticize and discourage, and have the right to report to the relevant departments. The department that accepts the report shall keep the informant confidential.
Public security, animal husbandry and veterinary medicine, urban management administrative law enforcement (comprehensive law enforcement), industry and commerce departments should establish a reward system for reporting, announce the telephone number of reporting, and accept reports from key management areas 24 hours a day; Matters that do not fall within the scope of their duties shall be promptly transferred to the relevant departments for handling.
Article 27 If a dog raised by a dog owner hurts others, the dog owner shall immediately send the injured person to a medical and health institution for diagnosis and treatment and advance medical expenses, and immediately send the injured dog to a dog reception center for quarantine by the animal husbandry and veterinary department. The responsible person shall bear civil liabilities such as medical expenses and quarantine fees according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.
Twenty-eighth in violation of the provisions of these measures, one of the following acts shall be punished by the public security department:
(a) in violation of the provisions of the third paragraph of Article 8 or in violation of the provisions of Article 9 in the no-feeding area, the dogs shall be confiscated, and a fine of 500 yuan shall be imposed on individuals and a fine of 2,000 yuan shall be imposed on units according to each dog.
(II) in violation of the provisions of the second paragraph of Article 7, if the initial registration and annual registration of dogs are not handled in key management areas, a fine of 500 yuan shall be imposed on individuals according to each dog, and a fine of 2,000 yuan shall be imposed on the unit, and the dogs shall be temporarily detained, and the registration formalities shall be ordered to be completed within a time limit; Dogs will be confiscated if they fail to go through the registration formalities within the time limit.
(three) in violation of the relevant provisions of the seventeenth did not go through the formalities of change and cancellation of registration, each dog fined two hundred yuan.
(4) Failing to keep a dog in the registration place in violation of the provisions of Item (1) of Paragraph 2 of Article 21, failing to keep a large dog or a strong dog in captivity in violation of the provisions of Item (3), or leaving the breeding place for non-work reasons, failing to take effective measures to stop it in time because of barking, violating the provisions of Item (4), failing to bring a dog registration certificate or leaving a registration card for the dog when taking the dog out of the house. Violation of Item (5), failure to take the dog in the elevator according to the specified time and other requirements, violation of Item (7), allowing the dog to enter the forbidden place, violation of Item (8), allowing the dog to bathe and swim in springs, canals and other public waters, which interferes with the normal life of others, shall be given a warning; If the warning is not corrected, or the dog is allowed to intimidate others, it shall be fined from 200 yuan to 500 yuan; Anyone who drives a dog to harm others shall be detained for more than five days and less than ten days, and shall be fined more than 200 yuan and less than 500 yuan; If the circumstances are minor, they shall be detained for not more than five days or fined not more than five hundred yuan.
(five) in violation of the provisions of Article 24 in key management areas, spring recharge areas and drinking water source protection areas to open a dog farm, dogs and illegal income shall be confiscated, and a fine of not less than 5,000 yuan but not more than 20,000 yuan shall be imposed.
Twenty-ninth in violation of the provisions of these measures, one of the following acts shall be punished by the animal husbandry and veterinary department:
(a) in violation of the provisions of the second paragraph of Article 7 of these Provisions, dogs are not immunized in key management areas, dogs are temporarily detained, and a fine is imposed on 500 yuan, and dogs are ordered to be immunized within a time limit. Fails to immunize, dogs confiscated; If the dogs are not immunized in the general management area, the dogs will be temporarily detained, and a fine of 100 yuan will be imposed, and the dogs will be ordered to be immunized within a time limit. If the dogs are not immunized within the time limit, the dogs shall be confiscated.
(two) in violation of the provisions of the second paragraph of article seventeenth, the dead dog is not sent to the animal husbandry and veterinary department for treatment, and shall be ordered to make corrections within a time limit. If it fails to make corrections within the time limit, it shall be fined in 200 yuan.
The animal husbandry and veterinary department shall, within ten days from the date of making the decision on administrative punishment, send a copy of the punishment result to the public security department at the same level.
Thirtieth in violation of the provisions of these measures, one of the following acts shall be punished by the urban management administrative law enforcement (comprehensive law enforcement) department:
(a) in violation of the provisions of Article 21, paragraph 2 (9), if the dog is not cleaned up in time, it shall be ordered to clean up, and the dog owner shall be fined in 500 yuan;
(two) in violation of the provisions of article twenty-fourth in the city roads and squares engaged in dog trading, dogs and illegal income confiscated, and impose a fine of 2000 yuan from 500 yuan.
Urban management administrative law enforcement (comprehensive law enforcement) department shall, within ten days from the date of making the decision on administrative punishment, send a copy of the punishment result to the public security department at the same level.
Article 31 If an individual who raises a dog in a key management area is subject to administrative punishment for more than three times in violation of these regulations within two years, his dog shall be confiscated by the public security department and he shall not raise a dog for five years.
Article 32 If a party refuses to accept a specific administrative act related to dog management made by the public security department or other administrative departments, it may apply for administrative reconsideration or bring a lawsuit according to law.
Article 33 Where the relevant departments of dog management and their staff abuse their powers, neglect their duties or engage in malpractices for selfish ends, they shall be given administrative sanctions by their units or the competent department at a higher level; If a crime is constituted, criminal responsibility shall be investigated according to law.
Thirty-fourth these Provisions shall come into force as of May 6, 2007. 1995 1 February 1 day The Measures for the Administration of Dog Breeding in Jinan promulgated and implemented by the Standing Committee of Jinan Municipal People's Congress shall be abolished at the same time.
