Health administrative licensing procedures for health-related products
Article 3 Domestic health-related products shall directly apply to the Ministry of Health for health administrative license after production capacity audit and product inspection. After the imported health-related products pass the inspection, they shall directly declare the health administrative license to the Ministry of Health. When necessary, the Ministry of Health will organize on-site audit and sampling re-inspection according to specific conditions.
Where imported health-related products are transferred to China for production, processing or sub-packaging, they shall re-apply for health administrative license as domestic products.
The provincial health supervision department is responsible for the production capacity audit of domestic health-related products. Health-related product inspection institutions recognized by the Ministry of Health or the provincial health administrative departments (hereinafter referred to as inspection institutions) shall undertake the inspection of health-related products in accordance with relevant regulations.
The health-related product evaluation institution established by the Ministry of Health (hereinafter referred to as the evaluation institution of the Ministry of Health) undertakes the work of declaration and acceptance, organization evaluation, product approval, feedback of approval conclusions and file management of health-related products assigned by the Ministry of Health.
The Ministry of Health shall set up a health-related product review committee (hereinafter referred to as the review committee) to undertake the corresponding technical review of health-related products. Article 7 The evaluation institution of the Ministry of Health shall announce to the public the acceptance time, declaration requirements, declaration procedures, working hours and charging standards, and provide advisory services for declaration work. Article 8 The hygiene administrative license for health-related products shall be implemented in strict accordance with the provisions of relevant national laws, regulations, rules, norms and standards and the principle of risk assessment.
