Responsibility basis of disputes over body rights, health rights and life rights

If the actor commits an illegal act and infringes on the right to life, health or body of others, the actor shall bear corresponding civil liability.

Body right disputes refer to disputes caused by infringement of citizens' physical integrity, including infringement of formal integrity and infringement of substantive integrity.

Disputes over the right to health refer to disputes caused by the destruction of citizens' physical functions and the infringement of their functions.

Disputes over the right to life refer to disputes caused by the destruction of citizens' physical functions and the infringement of their functions.

Therefore, protecting the right to life and health is the common task of many legal departments such as criminal law, civil law and administrative law. Illegal violation of citizens' right to life and health should bear corresponding civil and criminal responsibilities. In order to protect their lives and health, citizens can exercise their right to self-defense and claim compensation.

Legal basis: Civil Code of People's Republic of China (PRC).

Article 3 The personal rights, property rights and other lawful rights and interests of civil subjects are protected by law, and no organization or individual may infringe upon them.

Article 110 A natural person enjoys the right to life, body, health, name, portrait, reputation, honor, privacy and marital autonomy.

Legal persons and unincorporated organizations enjoy the right of name, reputation and honor.

Article 102 Natural persons have the right to life. The life safety and dignity of natural persons are protected by law. No organization or individual may infringe upon the right to life of others.

Article 105 When a natural person's right to life, body and health is infringed upon or is in other dangerous situations, an organization or individual with legal obligation to provide assistance shall provide timely assistance.

Tort Liability Law of People's Republic of China (PRC)

Articles 7 and 8 provide that:

If the animals raised cause damage to others, the animal breeder or manager shall bear the tort liability, but if he can prove that the damage was caused by the intentional or gross negligence of the infringed, he may not bear or reduce the liability.
