Article 1 These Measures are formulated for the purpose of establishing a reporting system for environmental pollution and damage accidents, keeping abreast of accidents and strengthening environmental supervision and management. Article 2 Environmental protection departments at all levels shall, according to their functions and powers, be responsible for timely and accurately reporting environmental pollution and damage accidents within their respective jurisdictions to the people's governments at the same level and the environmental protection departments at higher levels.

Environmental protection departments at all levels should organize relevant departments and units to do a good job in reporting environmental pollution and damage accidents. Article 3 The term "environmental pollution and destruction accident" as mentioned in these Measures refers to the unexpected events that cause environmental pollution, damage to wildlife and nature reserves protected by the state, harm to human health, loss of social economy and people's property and bad social impact due to economic and social activities and behaviors that violate environmental protection laws and regulations, and the impact of unexpected factors or irresistible natural disasters. Article 4 Environmental pollution and damage accidents are divided into water pollution accidents, air pollution accidents, noise and vibration hazards accidents, solid waste pollution accidents, pesticide and toxic chemicals pollution accidents, radioactive pollution accidents and damage accidents of national key protected wild animals and nature reserves. Article 5 According to the degree, environmental pollution and damage accidents can be divided into:

(1) General environmental pollution and destruction accidents. Direct economic loss caused by pollution or damage 1000 yuan or more 10000 yuan or less (excluding 10000 yuan).

(2) A major environmental pollution and destruction accident is a major environmental pollution and destruction accident if it meets one of the following circumstances: 1. The direct economic loss caused by pollution and destruction is between 1 10,000 yuan and 50,000 yuan (excluding 50,000 yuan); 2. People have symptoms of poisoning; 3. Conflicts between factories and groups caused by environmental pollution; 4. Harm to the environment.

(three) major environmental pollution and destruction accidents. Under any of the following circumstances, it is a major environmental pollution and destruction accident: 1. The direct economic loss caused by pollution or destruction is more than 50,000 yuan and less than 654.38+10,000 yuan (excluding 654.38+10,000 yuan); 2. Personnel have obvious poisoning symptoms, radiation damage or possible disability consequences; 3. People have symptoms of poisoning; 4. Environmental pollution affects social stability; 5. Great harm to the environment; 6. Killing and cutting down wild animals and plants protected by the State at the second and third levels.

(4) Extraordinary environmental pollution and destruction accidents. Anyone who meets one of the following circumstances is a major environmental pollution and destruction accident; 1. The direct economic loss caused by pollution or destruction is more than 654.38+10,000 yuan; 2. People have obvious poisoning symptoms or radiation damage; 3. People died of poisoning; 4. Environmental pollution seriously affects the normal activities of local economy and society; 5. Causing serious harm to the environment; 6. Killing and cutting down wild animals and plants protected at the national level. Article 6 After an accident of environmental pollution and destruction occurs, the local environmental protection department shall immediately rush to the scene to investigate and make an appropriate determination of the nature and harm of the accident.

All general or large environmental pollution and damage accidents are confirmed by the environmental protection department at or above the county level; All major or particularly major environmental pollution and destruction accidents must be confirmed by the environmental protection department at or above the prefecture level. For environmental pollution and damage accidents other than those specified in Article 5 of these Measures, the environmental protection departments at or above the prefecture level may confirm them as major or extraordinarily serious accidents according to the actual situation. Seventh where the occurrence of major environmental pollution and damage accidents, the municipal environmental protection department shall promptly report to the people's government at the same level, and report to the provincial environmental protection department; In case of major environmental pollution and damage accidents, the local and municipal environmental protection departments shall promptly report to the people's governments at the same level and the provincial environmental protection departments, and report to the State Environmental Protection Bureau. Article 8 Reports of major and extraordinarily serious environmental pollution and destruction accidents are divided into three categories: quick report, accurate report and report of treatment results. Report the accident quickly within 48 hours after it is discovered; Report immediately after finding out the basic situation; After the accident is handled, the handling result report shall be reported immediately. The quick report can be made by telephone or telegram, and if necessary, someone should be sent to report directly. Confirmation can be made by telephone or written report. A report on the treatment result shall be written. The report should adopt an appropriate way to avoid affecting the local people. Article 9 The contents of quick report mainly include: the types, time, place, pollution sources, main pollutants, economic losses, victims, names and quantities of wildlife under special state protection, and the affected area and degree of nature reserves. On the basis of quick report, report the exact data, cause, process and emergency measures of the accident.

On the basis of accurate report, report the measures, process and results of handling the accident, the potential or indirect harm and social impact of the accident, the remaining problems after handling, the relevant departments and work contents involved in handling the work, and issue documents on the details of harm and loss. Tenth reporting units shall ensure the accuracy and reliability of the report. When it is found that the contents of the report are different from the actual situation, the reporting unit shall immediately report the correction truthfully. Eleventh general and large environmental pollution and destruction accidents into the environmental statistics of environmental protection departments at all levels; Major and extraordinarily serious environmental pollution accidents are not only included in the environmental statistics of environmental protection departments at all levels, but also summarized once every six months by provincial environmental protection departments, and reported to the State Environmental Protection Bureau before July 20th and June 20th, 65438+1October 20th (the summary report is attached).
