After the verdict was pronounced in the first instance, the Changchun Municipal Health and Wellness Committee refused to accept it and appealed to the Changchun Railway Transport Intermediate Court.

Family members said they were allergic to cephalosporin and were still taking medicine.

Recalling that on the day of going to the hospital, my daughter had some difficulty walking with leg pain, so she pushed her to a wheelchair to see a doctor and hung up the name of Zhao, a rheumatologist. Liu Lili was diagnosed with polymyositis and dermatomyositis this time. The doctor thinks that the disease has recurred and suggests hospitalization.

Previous medical records suggest a history of cephalosporin allergy.

On August 3, 2020, Liu Lili's condition deteriorated and he had difficulty breathing. Because their daughter was successfully cured in a hospital in Beijing, they decided to transfer to Beijing for treatment. On the same day, Liu Lili was transferred by an ambulance provided by the First Hospital of Jida University.

That day, Liu Lili looked very miserable. At 1 1: 20 that night, Liu Lili's heart rate dropped, and the medical staff on board pressed Liu Lili's chest for cardiopulmonary resuscitation. After the death of her daughter, the crew on board said that she could not issue a death certificate for Liu Lili; At the same time, he collected 3000 yuan from his family and brought Liu Lili back to Changchun. On the morning of August 6th, the ambulance returned to Changchun, and the family transferred Liu Lili to Fan Jiatun funeral home.

The family found the doctor on board, and the First Hospital of Jida University failed to issue a death certificate. Finally, Zhang Fengqin went to the local community to explain the situation, and the community health service center issued a death certificate. According to the medical certificate of residents' death, Liu Lili died in the First Hospital of Jida University 120 ambulance on the way out of Beijing.

Is it an ambulance or a car?

Zhang Fengqin believes that there is not enough medical equipment on the ambulance, and getting off the expressway twice delayed the treatment time. In addition, Zhang Fengqin asked why the ambulance in the First Hospital of Jida University (the third-class hospital in Jilin Province) was licensed by Liaoning Province. Afterwards, she learned that the ambulance her daughter took actually belonged to Jilin Renkang First Aid Station Co., Ltd.

Renkang Company involved in the case stated in the explanation of the patient transport incident in Liu Lili that it was established on May 19 and 20 15, 2009, and was legally registered and allowed to operate the transport qualification, mainly providing transport services for discharged patients, excluding emergency medical treatment. It is a cooperative relationship with the First Hospital of Jida University, so the words "First Aid Center of the First Hospital of Jida University" are used. The company's transfer vehicles are equipped with standardized on-board medical equipment and medical instruments, and the on-board medical staff have qualification certificates, and they monitor patients during the transfer process according to the requirements of their families, but there is no first-aid measures.

Zhang Fengqin said that after the family members agreed to be transferred to another hospital, several people who claimed to be ambulance workers from Jida Hospital came to the ward and advised the family members to take an ambulance from the hospital. Because the car was written as an ambulance in the First Hospital of Jida University, she always thought it was a hospital ambulance.

Zhang Fengqin, who had doubts, learned from Changchun 120 Emergency Center that the emergency center did not have this car. So in March of 20021year, she complained to the Chaoyang District Health Bureau of Changchun City.

According to an administrative license and administrative penalty announcement issued by Chaoyang District Health and Health Bureau of Changchun City, on September 26th, 2002 1, the bureau made a penalty decision, claiming that Renkang Company practiced without obtaining the Medical Institution Practice License, and confiscated its illegal income of 3 1 000 yuan, and imposed a fine of1,300 yuan.

Therefore, Zhang Fengqin complained to the Changchun Municipal Health and Wellness Committee about the First Hospital of Jida University.

Subsequently, Mr. and Mrs. Zhang Fengqin filed an administrative lawsuit, demanding that the Changchun Municipal Health and Health Commission revoke the reply and make a specific administrative act again. Changchun Railway Transport Court accepted and filed the case on July 7, 2022.

According to the judgment of the first instance, the Changchun Municipal Health and Health Commission argued that the reply given by the bureau was clear in facts, conclusive in evidence, correct in application basis, legal in procedure and appropriate in content. As a third person, the First Hospital of Jida University indicated that there was no violation of laws and regulations, and requested the court to reject Zhang Fengqin's application.

On August 1 this year, the Changchun Railway Transport Court ruled in the first instance that the reply given by the Changchun Municipal Health and Wellness Committee was unclear, and decided to revoke the reply given by the Changchun Municipal Health and Wellness Committee on the contents of the complaint and report, requiring a new reply within 30 days from the date of the effective judgment.

After the verdict was pronounced in the first instance, the Changchun Municipal Health and Wellness Commission refused to accept the verdict and appealed to the Changchun Railway Transport Intermediate Court.
