Chapter I General Provisions
Article 1 In order to standardize the management of special funds, safeguard the legitimate rights and interests of donors and recipients, ensure the use and efficient operation of special funds, and give full play to their due social benefits, these Articles of Association are formulated in accordance with the Law of People's Republic of China (PRC) on Donation to Public Welfare, the Regulations on the Administration of Foundations and the Measures for the Administration of Special Funds of Provincial (City, Autonomous Region) Charity Federation.
Article 2 This fund was initiated by others and named as a county (city, district) rural clean public welfare fund. The purpose of this fund is to raise public welfare funds to improve the environmental sanitation of a county (city, district) and rivers. Approved by the county (city, district) charity association, this fund belongs to the special fund established by the county (city, district) charity association, and is subject to the supervision, guidance and guidance of the county (city, district) charity association.
Article 3 Special funds shall be protected by law and used exclusively for public welfare projects as stipulated in the Articles of Association. No unit or individual may privately divide, occupy or misappropriate special funds.
Article 4 The principle of fund operation: villagers donate money and residents purify themselves; Government support, civil action; Counties (cities, districts) are integrated, unified and divided; Standardized and transparent, continuous operation.
Article 5 Use of the Fund: Purify and beautify the rural areas of a county (city, district) through the rural cleaning project, enhance the public, health, environmental awareness and local cultural awareness of rural residents, and realize "clean village appearance and civilized rural customs".
Chapter II Sources of Funds
Article 6 The funds of this special fund refer to the legal donations made by a county (city, district) clean rural public welfare fund in accordance with the law and put into public welfare projects according to the wishes of the donors.
Donors can use all or part of the donated funds for designated purposes, such as purchasing cleaning facilities (trash cans, garbage trucks, etc.). ) in his own village (administrative village) or town (township, street) and pay the wages of garbage disposal workers.
Seventh sources of funds for this special fund:
(1) Special donations from sponsors.
(two) donations from people or organizations from all walks of life, including corporate donations, personal donations and funds obtained by the foundation through charitable activities.
(3) government funding.
(4) Other lawful income.
Article 8 The raising of this special fund shall be made public in a special account, and the name of the account shall be: a county (city, district) rural clean public welfare fund; Account number:, bank:.
Chapter III Fund Council and Standing Council
Ninth county (city, district) clean rural public welfare fund council is the decision-making body of fund management and use, but its authority and responsibility are borne by the Standing Council.
Members of the board of directors and their selection methods:
(1) Honorary Chairman
So-and-so county and other well-known public welfare towns have served.
(2) Chairman of the Board of Directors
Elected by the standing Council from among the standing directors.
(3) Vice Chairman
The chairman is nominated by the executive director and decided by the executive committee. There are two vice-chairmen, one is a local resident and the other is a foreign resident.
(4) Executive Director
1, elected executive director: the five directors with the largest cumulative donations in each town (township), and choose one of them as the executive director;
2. Ex officio executive directors: legal representative, secretary-general, director of housing and urban-rural construction, director of education, director of health, director of water affairs, etc. A county (city, district) charity association.
The total number of executive directors is odd.
(5) Directors
If the accumulated donation reaches a certain amount, such as 20,000 yuan, you can become a director, and the number of directors is not limited.
(6) Secretariat staff: Secretary-General, accountant and cashier.
1. secretary-general: nominated by the chairman, elected by the standing Council from among the managing directors. Generally, the Secretary-General of a charity in a county (city, district) serves as the Secretary-General.
2. Accountant and cashier: nominated by the Secretary-General and approved by the chairman. In principle, the accountant and cashier of the finance department of a county (city, district) charity will serve concurrently.
Article 10 The term of office of the Standing Council and the Standing Directors is five years, and they may be re-elected. The term of office of honorary chairman and directors is indefinite.
Half a year before the establishment of the fund, the promoters and others set up a temporary standing Council as the authority of the standing Council. After the establishment of the standing Council, the temporary Council was automatically dissolved.
Article 11 The executive director of the Fund has the right to participate in and supervise the work of the Fund and participate in various activities of the Fund; Have the obligation to abide by the articles of association of the Foundation, implement the resolutions of the Standing Committee, and actively complete the tasks assigned by the Standing Committee.
Article 12 The duties of the Standing Council of the Foundation are as follows:
(1) To formulate and revise the articles of association of the fund.
(2) to elect and recall the chairman, vice-chairman and secretary-general.
(3) Examining and approving the annual work plan, budget and final accounts of the Fund.
(four) to decide the funded projects and purposes, and to check the implementation of the work plan.
(5) Deciding on other important matters of the Fund.
Article 13 The operation of special funds shall be decided by the Standing Committee of the Fund and supervised and managed by the county (city, district) charity associations.
Chapter IV Utilization of Funds
Article 14 This special fund is a special donation, so-and-so county (city, district) charity will set up a special account management, and issue a special receipt for donation, and donors will enjoy preferential tax policies for public welfare donations.
Fifteenth the expenditure of this special fund must be approved by the Standing Council of the fund and stamped with the official seal. The scope of use of the fund shall be within the scope stipulated in the articles of association and shall not be used for expenditures beyond the scope of the articles of association.
Directional donation funds shall be used in strict accordance with the purpose and scope specified by the donor.
Non-directional donation funds shall be used by the Standing Council within the scope of public welfare purposes of the fund, and shall be used as planned with the approval of the chairman and the Secretary-General.
Only when the funds donated to a village or town (township) reach the goal of purchasing all sanitation facilities and pay a certain proportion, such as half of the cleaning staff's salary, can they apply to the fund secretariat for funding and pay the rest of the cleaning staff's salary. After the application is passed and the follow-up capital expenditure procedures are completed, the funded funds will be distributed to the village Committee and forwarded to the cleaning staff on a quarterly basis, or directly to the personal bank account of the cleaning staff.
The procedure of capital expenditure is: application entrusted by the Standing Committee of the Fund (signed by the chairman or vice-chairman and the Secretary-General) → approval of a county (city, district) charity association → handling expenditure procedures.
Sixteenth the use of this special fund shall comply with the relevant financial system, auditing system and social supervision system of the county (city, district) charity. Every time you use donations, you have to go through procedures such as application, verification, distribution, announcement and return visit.
Article 17 In order to encourage the enthusiasm of donors, the Fund does not accrue management fees according to the amount of donations, and all donations are used for public welfare purposes specified by the Fund. The management fee for maintaining the operation of the foundation shall be paid by the county (city, district) charity in the name of government purchasing social services.
Chapter V Fund Supervision and Management
Eighteenth special funds by the county (city, district) charity in accordance with the national unified accounting system to set up and accounting, and supervision and management of its accounts. The financial department of a county (city, district) charity is responsible for financial work to ensure the safety and standardization of special funds.
Article 19 The financial management of funds shall follow the principles of openness, fairness and transparency. The board of directors of the fund and the donors shall give timely and true answers to the inquiries about the income and expenditure of the fund.
Twentieth the financial department of a county (city, district) charity will submit a summary of the annual financial revenue and expenditure of the fund to the Standing Committee of the Fund every year. The special fund is subject to the supervision of the Standing Council of the Fund and all sectors of society.
Twenty-first establish a special website, build a working platform, publish accounts regularly, and accept public supervision.
Twenty-second special fund members and members of the Standing Council shall not have any behavior that damages the reputation of county (city, district) charities. In case of violation, a county (city, district) charity has the right to terminate the operation of the special fund until the establishment of the special fund is cancelled.
Twenty-third when the amount of the special fund account is less than 50,000 yuan and the duration exceeds 1 year, a county (city, district) charity has the right to clean it up. After that, the remaining assets are used for charitable projects stipulated in the articles of association, and the special fund is dissolved by itself.
Chapter VI Supplementary Provisions
Article 24 The right to interpret and amend the Articles of Association belongs to the Fund Council.
Article 25 The Articles of Association shall come into effect after being approved by the county (city, district) charity association.
