Detailed Rules for the Implementation of the Interim Provisions on Occupational Safety and Health Supervision of Productive Construction Projects in Shaanxi Province
Article 1 In order to implement the policy of "safety first, prevention first", ensure that the construction projects in our province meet the requirements of occupational safety and health, and ensure the safety and health of workers in the production process, these measures are formulated according to the relevant documents of the Central Committee and the State Council, the Regulations on Labor Safety in Shaanxi Province and the Interim Provisions of the Ministry of Labor on Occupational Safety and Health Supervision of Productive Construction Projects, and combined with the actual situation of this province. Article 2 These Measures shall apply to all state-owned and collective enterprises (including enterprises affiliated to institutions) engaged in production activities at or above the county level in this province, as well as new construction, reconstruction, expansion, technological transformation and technology introduction projects of joint ventures, foreign-funded joint ventures and Chinese-foreign cooperative enterprises (hereinafter referred to as construction projects). Article 3 When preparing the project proposal, feasibility study report, preliminary design and completion acceptance, all construction projects must implement the corresponding labor protection laws, regulations, standards and regulations to ensure that the labor safety and health facilities in the project are designed, constructed and put into use at the same time as the main project, that is, "three simultaneities". Article 4 The project construction unit shall be responsible for the "three simultaneities" of project labor protection. When organizing the preparation of the plan task book or feasibility study report, special discussions should be held on the dangerous and harmful factors in the project, including the technical measures for labor protection and the required expenses, and responsible for the implementation of various labor protection facilities approved in the preliminary design, as well as the rectification of the remaining problems of labor protection facilities and the implementation of the required funds when the construction project is completed and accepted. Article 5 Where complete sets of technical equipment are imported from abroad, the corresponding safety and health facilities and technical equipment must be imported or made in China, and shall not be lowered at will. If domestic support is needed, it must be included in the plan together with the required expenses to ensure the safety and health effect. Article 6 When organizing the feasibility demonstration, preliminary design review and completion acceptance of engineering construction projects, the economic management departments at all levels and the competent departments of enterprises shall notify the labor department to participate, and be responsible for timely copying the annual plan of engineering construction projects of their own departments to the labor department at the same level. Seventh design units in the feasibility study of the project, should also demonstrate and evaluate the occupational safety and health of the project; When preparing preliminary design documents and construction drawing designs (including occupational safety and health articles with specific requirements), they must be prepared in accordance with occupational safety and health regulations and technical standards, and the possible occupational hazards in the production process, the measures taken and their expected effects must be explained in detail, and the occupational safety and health facilities of construction projects should be designed to protect good working conditions after the project is put into production. Article 8 The labor department shall implement hierarchical management for the "three simultaneities" of construction projects; The provincial labor department shall participate in the feasibility demonstration, design review and completion acceptance of the central competent department's construction projects in Shaanxi and provincial construction projects; Construction projects organized by prefectures, cities and counties should have labor departments at the same level to participate in feasibility demonstration, design review and completion acceptance; The feasibility demonstration, design review and completion acceptance of all projects must be attended by the labor department of the project location (prefecture, city and county) and the safety technology department (branch) of the competent department. Article 9 Fifteen days before the preliminary design review, the construction unit must submit the occupational safety and health evaluation report (see Article 10 for specific provisions), design documents (general situation of the project, special articles on occupational safety and health) and relevant drawings to the labor department at the same level for pre-examination. And fill in the "Preliminary Design Approval Form for Occupational Safety and Health of Construction Projects" (uniformly printed by the Provincial Labor Department) as required, and report it to the labor department at the same level for examination and approval after being examined and signed by the competent safety department. Article 10 Labor departments at all levels may decide whether it is necessary to make a safety and health evaluation report for a construction project according to its scale, severity and danger of dust and toxic hazards. The evaluation report shall be completed before the preliminary design by the design unit entrusted by the construction unit. The unit undertaking the evaluation shall scientifically analyze and accurately predict the dangerous and harmful factors after the project is put into production, make a correct conclusion on the technical feasibility of the preventive measures taken, and be responsible for the accuracy of the evaluation report. The evaluation unit shall be approved by the provincial labor department. Eleventh construction departments at all levels and banks in the "approval form" after the approval of the labor department, can handle the loan procedures. Twelfth major changes in the nature, scale, technology and equipment of a construction project, the construction unit shall re-declare in accordance with the original procedures. During the project construction, no unit or individual may arbitrarily change or reduce the occupational safety and health projects approved in the design documents. If it is really necessary to change, it is necessary to explain the reasons to the original labor department that participated in the design review, and provide relevant technical change plans, which can be implemented only after being approved by the labor department. Thirteenth construction units should strictly follow the requirements of engineering design and drawings, and be responsible for occupational safety and health facilities and engineering quality. Article 14 In the debugging stage of production equipment, the construction unit shall simultaneously debug and evaluate the occupational safety and health equipment and evaluate its effect. Occupational safety and health should be included in personnel training. Article 15 Construction units at all levels must write a special report on the operation of occupational safety and health equipment in trial production, the effects of measures, relevant test data, labor protection investment budget, existing problems and solutions 20 days before the completion and acceptance of the organization project, and submit it to the labor department at the same level for approval together with the Approval Form for Occupational Safety and Health Acceptance of Construction Projects (printed uniformly by the Provincial Labor Department) (the labor health supervision department conducts spot checks on some test data). It shall not be put into use without approval.
