The transportation departments of provinces and autonomous regions are responsible for guiding the operation and management of urban rail transit within their respective administrative areas.
The competent department of urban transportation where urban rail transit is located or the competent department of urban rail transit operation designated by the urban people's government (hereinafter referred to as the competent department of urban rail transit operation) shall, under the leadership of the people's government at the corresponding level, be responsible for organizing and implementing the supervision and management of urban rail transit operation within their respective administrative areas. Chapter II Basic Requirements for Operation Article 5 At the stage of soliciting opinions on the planning and construction of urban rail transit network, the competent department of urban rail transit operation shall comprehensively consider the factors such as the connection with urban planning, passenger flow demand of urban rail transit, and operational safety guarantee. And put forward opinions on network layout and scale, transfer hub planning, construction sequence, resource sharing, network integrated emergency command system construction, line function positioning, line system format, system scale and traffic connection.
The competent department of urban rail transit operation shall put forward opinions on passenger flow forecast, system design transportation capacity, traffic organization, operation management, operation service and operation safety at the stage of soliciting opinions on the feasibility study report and preliminary design document preparation of urban rail transit project. Article 6 The feasibility study report and preliminary design documents of urban rail transit projects shall set up a special chapter on operation services, which shall at least include the following contents:
(a) the number of entrances and exits, platform area, channel width, transfer conditions, station hall capacity and other station facilities, equipment capacity and service requirements, safety requirements;
(two) the choice of vehicles, communications, signals, power supply, automatic fare collection and other facilities and equipment and the compatibility of other line facilities and equipment in the network;
(three) the planning layout and scale of safety emergency facilities and the adaptability of operational safety, and the planning and design are synchronized with the main project;
(4) Connection with the capacity of urban rail transit network;
(five) supporting the connection of other modes of transportation;
(6) Construction of barrier-free environment. Article 7 Urban rail transit vehicles, communication, signal, power supply, electromechanical, automatic fare collection, platform doors and other facilities and integrated monitoring systems shall meet the technical conditions for operation access stipulated by the state, realize system interconnection and compatibility, and meet the needs of network operation. Article 8 Urban rail transit projects shall, in principle, select and determine operating units in accordance with relevant regulations before the feasibility study report is compiled. An operating unit shall meet the following conditions:
(1) It has the qualification of an enterprise legal person, and its business scope includes the operation and management of urban rail transit;
(2) Having a sound safety production management system and service quality assurance system such as traffic management, passenger transport management, facilities and equipment management and personnel management;
(3) Having professional managers in vehicle, communication, signal, power supply, electromechanical, track, civil engineering structure, operation management, and professional technicians suitable for operational safety. Article 9 Operating units shall participate in the passenger-free trial operation of urban rail transit projects in accordance with regulations, be familiar with the engineering equipment and standards, observe the safety and reliability of system operation, and urge the urban rail transit construction unit (hereinafter referred to as the construction unit) to deal with it in time when quality problems and potential safety hazards are found.
The operating unit shall specify the warranty scope, warranty period and warranty responsibility of relevant civil engineering, facilities, equipment and system integration in the operation takeover agreement, and urge the construction unit to include the above contents into the warranty scope of construction project quality. Article 10 After the acceptance of urban rail transit projects, the competent department of urban rail transit operation shall organize a preliminary pre-operation safety assessment. After passing the safety assessment before the initial operation, the initial operation procedures can be handled according to law.
During the initial operation, the operating unit shall monitor the operation status and quality of civil engineering, facilities and equipment and system integration in accordance with the design standards and technical specifications. When problems or potential safety hazards are found, relevant responsible units shall be required to deal with them in time according to relevant regulations or contract stipulations. Eleventh urban rail transit line initial operation expires one year, the operating unit shall submit the initial operation report to the competent department of urban rail transit operation, and the competent department of urban rail transit operation shall organize a formal safety assessment before operation. Only those who have passed the safety assessment can go through the formal operation procedures according to law. For the problems found in the safety assessment, the competent department of urban rail transit operation shall report to the city people's government and notify the relevant responsible units to request rectification within a time limit.
The abandoned urban rail transit lines in initial operation shall pass the safety assessment organized by the competent department of urban rail transit operation before they can be put into use. If it is difficult to complete due to objective conditions, the operating unit shall urge the construction unit and the design unit to perform the design change procedures. After all abandoned projects are put into use or design change procedures are fulfilled, urban rail transit projects can go through formal operation procedures according to law.
