Measures for the administration of quarantine of entry-exit cruise ships

Chapter I General Provisions Article 1 In order to regulate the quarantine supervision of entry-exit cruise ships, prevent the spread of epidemic diseases and promote the development of cruise economy, according to the Frontier Health and Quarantine Law of People's Republic of China (PRC) and its implementing rules, the Animal and Plant Quarantine Law of People's Republic of China (PRC) and its implementing regulations, the Food Safety Law of People's Republic of China (PRC) and its implementing regulations, and the Infectious Disease Prevention and Control Law of People's Republic of China (PRC). Article 2 These Measures shall apply to the quarantine supervision and administration of foreign cruise ships entering and leaving the border ports of People's Republic of China (PRC), cruise ships of China nationality sailing on international routes and relevant business and service units. Article 3 The General Administration of Quality Supervision, Inspection and Quarantine (hereinafter referred to as AQSIQ) shall be responsible for the quarantine supervision of inbound and outbound cruise ships nationwide.

The entry-exit inspection and quarantine department established by the General Administration of Quality Supervision, Inspection and Quarantine (hereinafter referred to as the "inspection and quarantine department") is responsible for the quarantine supervision of entry-exit cruise ships at the ports under its jurisdiction. Chapter II Risk Management Article 4 The AQSIQ and the inspection and quarantine departments shall carry out risk management on inbound and outbound cruise ships. Article 5 The General Administration of Quality Supervision, Inspection and Quarantine (AQSIQ) shall, according to the sanitary conditions of cruise ships, the quarantine risk control ability of operators and their agents, credit rating, on-site supervision and other related factors, formulate the technical scheme of cruise ship quarantine risk assessment and determine the classification standard of cruise ship quarantine risk. Article 6 Cruise operators shall be responsible for establishing and operating the public health and safety system of cruise ships, including:

(a) food safety control plan;

(two) drinking water safety control plan;

(3) Water safety control plan for entertainment places;

(4) Medical vector biological monitoring plan;

(five) the health system of cruise public places;

(6) Waste management system;

(seven) gastrointestinal disease monitoring and control system;

(eight) working mechanism of public health emergencies. Article 7 Cruise operators shall be responsible for formulating IPM plans for cruise ships, implementing relevant monitoring, prevention and reporting, and controlling the spread of pests. Article 8 Cruise operators or their agents may, on a voluntary basis, apply to the inspection and quarantine department at the place where the home port is located for risk assessment, and the following materials shall be submitted when applying:

(1) An application for risk assessment of cruise quarantine;

(two) public health and safety system documents;

(3) Structural drawings and other relevant materials of the cruise ship ventilation system, domestic water supply system, drinking water purification system and sewage treatment system. Article 9 The AQSIQ shall be responsible for organizing the risk assessment of cruise ships, determining the quarantine risk level of cruise ships and announcing it to the public.

The inspection and quarantine department shall determine the cruise ship quarantine method, the content and frequency of health supervision according to the risk level, and implement dynamic classified management. Chapter III Entry Quarantine Article 10 The person in charge of a cruise ship or his agent shall report to the inspection and quarantine department at the port of entry 24 hours before the cruise ship enters the country or after leaving the last port, and submit the arrival plan, the health status of the personnel, the exemption certificate of ship health control measures and other materials.

If the contents of the declaration are changed, the person in charge of the cruise ship or his agent shall promptly correct it to the inspection and quarantine department. Article 11 Inbound cruise ships shall be subject to quarantine according to law.

The person in charge of the cruise ship or his agent shall apply to the inspection and quarantine department at the first port of entry for entry quarantine formalities, and shall not enter the country until it is approved by the inspection and quarantine department.

Cruise ships subject to entry quarantine shall not get on or off personnel or load or unload goods, luggage, postal parcels and other items without the permission of the inspection and quarantine department before the quarantine is completed. Article 12 Inbound cruise ships shall hang quarantine signals in accordance with regulations and wait for quarantine at designated places. The quarantine signal shall not be lifted before the inspection and quarantine department issues the entry quarantine certificate or notifies the quarantine completion.

When the inspection and quarantine personnel board the ship for quarantine, the person in charge of the cruise ship or his agent shall cooperate with the work. Article 13 The inspection and quarantine department shall determine the quarantine method according to the declaration information of inbound cruise ships and the risk level of cruise ship quarantine, and notify the person in charge of the cruise ship or his agent in time. The isolation method includes:

(1) Berthing quarantine;

(2) Quarantine on board;

(3) Anchorage quarantine;

(4) Telecommunications quarantine. Article 14 In any of the following circumstances, the inspection and quarantine institution may carry out on-board quarantine on inbound cruise ships:

(1) It is the first time to enter China, and it has stayed in the epidemic countries or regions listed in the announcement and early warning notice of AQSIQ within 4 weeks before entry;

(2) It happens for the first time, and the risk of public health system is unknown;

(3) In order to facilitate customs clearance, the inspection and quarantine department deems it necessary upon the application of the person in charge of the cruise ship or his agent.

The personnel involved in ship quarantine should be on-the-job personnel in cruise quarantine, with medical background or have received systematic training in ship health quarantine. Article 15 In any of the following circumstances, the inspection and quarantine institution shall carry out anchorage quarantine on inbound cruise ships:

(1) Coming from an epidemic area of quarantinable infectious diseases and reporting suspected cases of quarantinable infectious diseases on a cruise ship, it is necessary to conduct centralized and isolated observation on close contacts in accordance with regulations;

(2) There are clear requirements in the announcement and early warning notice of AQSIQ;

(3) The AQSIQ has assessed that the quarantine risk is relatively high;

(4) Failing to carry out on-board quarantine under the circumstances specified in Items (1) and (2) of Paragraph 1 of Article 14 of these Measures;

(5) The inspection and quarantine department deems it necessary upon the application of the person in charge of the cruise ship or its agent.
