Chapter 2? Monetary Compensation

Article 6? Residential housing expropriated people choose monetary compensation, within the consultation period to sign the expropriation compensation agreement, in principle, in accordance with the alteration (near) the average price of the lot of new general commercial housing given monetary compensation, and in accordance with the value of the expropriated housing compensation costs, and then given 10% of the self-settlement incentive fee.

Article 7? The monetary compensation fee for non-residential housing may be determined by negotiation with reference to the market price of similar real estate of the expropriated housing. If the requisitioned person has objections or fails to reach an agreement on compensation for the requisition, the real estate price appraisal agency shall determine the compensation value based on the market price of similar real estate. If the expropriated person signs the expropriation compensation agreement before the expiration of the negotiation period, an additional 10% self-settlement incentive fee will be paid in accordance with the monetary compensation amount of the expropriated house.

Article 8? Actively encourage the requisitioned person to choose the housing ticket settlement, the requisitioned person by himself to participate in the housing ticket settlement of real estate development enterprises to purchase commercial housing for housing requisition settlement. If the requisitioned person signs the expropriation compensation agreement within the negotiation period and purchases a residential house within the specified period from the date of receiving the housing ticket, the requisitioner will give an incentive in the form of a certain percentage of the purchase price of the house. Chapter 3? Property Rights Exchange

Article 9? If the expropriated person chooses the way of housing property right exchange, and if the expropriation compensation agreement is signed within the negotiation period, the property right exchange can be carried out in accordance with the following principles under the premise of effectively guaranteeing that the set area of the expropriated house will not be reduced:

(1) If the housing to be exchanged for property right exchange is a multi-storey one, the property right exchange will be carried out in accordance with the ratio of the floor area of the house being expropriated to that of the house being exchanged for property right exchange at the rate of 1:1.

(2) If the property right exchange housing is high-rise, the property right exchange will be carried out in the ratio of 1:1.2 according to the construction area of the expropriated housing and the construction area of the property right exchange housing.

The part of the building area of the property right exchange housing that is smaller than the building area of the compensable housing shall be compensated in monetary terms according to the average market price of ordinary commercial housing in the district where the property right exchange housing is located; the part of the building area of the property right exchange housing that is larger than the building area of the compensable housing shall be settled accordingly by the expropriated person at the time of the delivery of the property right exchange housing.

If the expropriated person objects or fails to reach an agreement on compensation for expropriation, the real estate price appraisal organization shall appraise and determine the value of the expropriated house and the property right exchange house according to the location of the expropriated house and the property right exchange house, the use, structure, age, floor, area, decoration and the right to use the land, etc., and the expropriated person shall settle the difference in the price of the property right exchange according to the facts.

Article 10? Chapter 5? Compensation for Decoration and Appurtenances

Article 19? Article 20? If the expropriated person signs the expropriation compensation agreement within the negotiation period, he may pay a lump sum compensation fee for the decoration of the expropriated house in accordance with the legal building area of the expropriated house at the rate of 400 yuan/square meter.

Article 21? Where there is a lessee of the expropriated house, the compensation fee for decoration shall be paid in accordance with the agreement of the lease contract; if there is no such agreement, it shall be negotiated between the lessor and the lessee within the prescribed period.

Chapter 6? Temporary Resettlement

Article 22? Residential housing levied on the person who chooses to exchange property rights, the property rights exchange of the house for a period of time, in accordance with the legal floor area of the house levied on the temporary resettlement fee at a rate of 15 yuan per square meter per month (if the month is less than 1,000 yuan, according to 1,000 yuan). The temporary resettlement fee shall be increased by another 300 yuan per person per month for those who have reached the age of 70 in the registered population of the permanent household registration of the expropriated person, or those whose breadwinner, dependant or supporter is physically handicapped and cannot take care of himself/herself.

If the owner of the expropriated residential house chooses monetary compensation or the resettlement house is a current house, a one-time temporary resettlement fee of 3 months shall be paid according to the above standard.

Chapter 7? Relocation Subsidies and Early Relocation Rewards

Article 23? The requisitioned houses shall be given relocation subsidies at the rate of 20 yuan/square meter in accordance with the legal floor area (if it is less than 1,000 yuan, it shall be given at the rate of 1,000 yuan); if the resettlement house is a period house, it shall be given twice according to the above standard.

Article 24? If the expropriated person has one of the following circumstances and signs the expropriation compensation agreement within the specified period and completes the relocation as promised, the expropriated person shall submit a written application and provide relevant supporting documents, and shall be granted a relocation subsidy of a maximum of not more than RMB 6,000 yuan separately after a public notice of three days without objection.
