Shenzhen Municipal Market Supervision Management Bureau
Shenzhen Municipal Market Supervision Bureau is an administrative organ approved by the Central Editorial Committee and Guangdong Provincial Party Committee and Government in August 2009.
After the institutional reform, Shenzhen Municipal Market Supervision Administration has become the second largest department in Shenzhen after the Public Security Bureau, and its supervision responsibilities cover the responsibilities of the original industrial and commercial administration, quality and technical supervision, intellectual property rights (trademarks, patents, copyrights), price, catering supervision (other areas belong to the functions of the Food and Drug Administration or the Health Bureau), and alcoholic products supervision.
Institutional function
(a) the implementation of national, provincial and municipal laws, regulations and policies on industrial and commercial administration, quality and technical supervision, intellectual property rights, food safety supervision and price supervision and inspection, drafting relevant local regulations, and organizing the implementation after approval.
(two) to formulate and implement the development plan to improve the overall quality level, standardization and measurement; Coordinate and guide the implementation of intellectual property strategy.
(three) according to the provisions of the organization and guidance to investigate and deal with violations of industrial and commercial administration, quality and technical supervision, intellectual property protection, food safety supervision, price supervision and inspection laws, regulations and rules.
(4) To be responsible for the registration, supervision and management of all kinds of enterprises, units and individuals engaged in business activities, resident representative offices of foreign (regional) enterprises and other market entities, and undertake the responsibility of investigating and banning unlicensed business activities according to law.
(five) to assume the responsibility of supervising the operation order of various markets according to law; Responsible for the supervision of market transactions (including virtual transactions such as online goods) and related service behaviors, and maintain the market operation order of fair competition; Responsible for organizing the construction of e-commerce credit system and supervision system; Supervise and manage brokers, brokerage institutions and brokerage activities according to law; Supervise and manage direct selling enterprises and direct selling personnel and their direct selling activities according to law, and take the lead in cracking down on pyramid selling violations; To undertake the duties of liquor market supervision; Responsible for the supervision and management of advertising activities.
(six) to undertake the responsibility of food safety supervision and management in food production, food circulation, catering, canteens and other consumption links; Responsible for handling food safety emergencies and investigating food safety cases according to regulations.
(seven) to undertake the responsibility of supervision and inspection of the prices of goods and services, administrative fees, and the price behavior of operators and intermediary organizations. Stop unfair price behavior, impose administrative penalties and administrative compulsory measures on illegal price and charge behaviors, and maintain the price order of fair competition.
(eight) the implementation of quality revitalization plan, management and guidance of quality and technical supervision of scientific and technological work; Organize and promote the implementation of the quality supervision system for major engineering equipment; Supervise and manage the quality system and product quality certification.
(nine) to undertake the responsibility of product and commodity quality supervision; Manage compulsory inspection, risk monitoring, supervision and spot check of product and commodity quality and safety; Supervise and manage product quality inspection and testing institutions according to law; Organize and implement the management system of industrial product production license; Supervision and management of product quality and safety arbitration inspection and appraisal.
(ten) according to the provisions of the consumer rights protection responsibility; Establish a consumer rights protection system; Organize and guide consumer rights protection work and mediate consumer disputes.
(eleven) to undertake the responsibility of contract administrative supervision and management, and investigate and deal with contract violations; Handle the registration of enterprise chattel mortgage according to law and supervise the auction according to law.
(twelve) responsible for the management of measurement work; Carry out legal measurement units and implement the national measurement system; Manage measuring instruments according to law, organize the transmission and comparison of values, standardize and supervise the quantity of goods, market measurement behavior and measurement arbitration verification; Supervise and manage quality inspection institutions, metrological verification institutions, measuring instruments calibration institutions, special equipment safety inspection and testing institutions and other institutions and social intermediary institutions that provide fair data for the society according to law.
(thirteen) responsible for the management of standardization work; To organize the formulation and promulgation of local standards and technical specifications of the Special Zone; Guide and coordinate the standardization work of relevant departments; Guide the adoption of international standards and advanced foreign standards; Organize and supervise the implementation of standards, and supervise and manage the work of organization code and commodity bar code.
(fourteen) to undertake the responsibility of special equipment safety supervision; Supervise and manage the registration of special equipment according to law, and supervise and inspect the implementation of energy-saving standards for high-energy-consuming special equipment. Responsible for product quality accidents, special equipment accidents and related emergency rescue responsibilities.
(fifteen) to undertake the responsibility of intellectual property protection; Responsible for the standardization and management of the patent market; Organizing the implementation of patent preferential policies and measures; To undertake the protection of trademarks, special signs and copyrights according to law, protect the exclusive right to use registered trademarks, and investigate and deal with trademark infringement; Supervise and guide copyright trade activities, collective management of copyright and agency work.
(sixteen) the establishment of intellectual property early warning, rights assistance mechanism; Organize and implement the publicity and promotion of intellectual property rights; Carry out foreign exchanges and cooperation on intellectual property rights.
(seventeen) to undertake other tasks assigned by the municipal government and higher authorities.
