Where there are other provisions in laws and regulations on the management of scenic spots, nature reserves, wetland parks, forest parks and geological parks, those provisions shall prevail. Article 3 The park mentioned in these Regulations refers to a public activity place that is open to the public, has a good landscaping environment and corresponding supporting facilities, and has the functions of improving ecology, beautifying the environment, sightseeing and leisure, inheriting culture, popular science education, disaster prevention and avoidance, including comprehensive parks, characteristic parks and strip parks.
The square as mentioned in these Regulations refers to the open space surrounded by buildings, roads or green belts, equipped with certain public facilities, with a certain scale of public green space and landscape facilities for public recreation, fitness, entertainment or memorial, hedging and other public activities. Article 4 The protection and management of park squares shall advocate socialist core values, embody the nature of public welfare, and adhere to the principles of government leading, rational layout, standardized use, public participation and social supervision.
Encourage and support natural persons, legal persons and unincorporated organizations to participate in the construction, protection and management of park squares through investment, funding, donation and participation in voluntary service activities. Article 5 The people's governments of cities and counties (districts) shall incorporate the protection and management of park squares into the national economic and social development plan, and incorporate the funds needed for the construction, maintenance and management of park squares invested by the government into the fiscal budget at the corresponding level to ensure and promote the healthy development of park squares. County (District) administrative department in charge of park square is responsible for the protection and management of the park square in this area, except for the park square managed by the administrative department of city park square.
The relevant administrative departments of the people's governments of cities and counties (districts) shall, in accordance with their respective responsibilities, coordinate the implementation of these regulations. Article 7 The municipal administrative department of park square shall formulate the technical rules for the management service and maintenance of park square, standardize the management service and maintenance operation of park square, and announce the name, address, telephone number and other relevant information of the park square management institution to the society. Article 8 Park Square shall be subject to catalogue and classified management. The list of park squares shall include the name, category, location, area, scope and management unit of park squares.
The determination and adjustment of the list and classification of park squares shall be put forward by the administrative department of park squares in the city, approved by the Municipal People's government, and announced after being reported to the Standing Committee of the Municipal People's Congress for approval. Chapter II Protection and Management Article 9 If it is necessary to temporarily occupy the land of the park square due to major infrastructure construction, key project construction and major urban disaster prevention and relief projects, the construction unit shall solicit the opinions of the administrative department of the park square and go through the formalities for temporary land use in accordance with relevant regulations; After the expiration of temporary land use, it shall be restored to its original state. If the occupying unit cannot be restored to its original state, it shall be restored by the park square management organization, and the required expenses shall be borne by the occupying unit. Article 10 The administrative department in charge of Park Square shall, jointly with the administrative departments in charge of natural resources, ecological environment, housing and urban and rural construction, strictly control the delineation of the protection scope of the Green Line.
The height, outline and color of all kinds of buildings and structures newly built, rebuilt and expanded within the protection scope of the Green Line shall be in harmony with the landscape of the park square. Eleventh park square management agencies should maintain the existing water area of the park square, and shall not reduce the water area or change the use of water without authorization to keep the water clean.
It is forbidden for any unit or individual to dump, throw wastes or discharge sewage and waste water into the water surface of Park Square.
Sewage and waste water produced by various facilities in Park Square should be discharged into the sewage pipe network. Twelfth park square facilities maintenance, vegetation conservation and environmental sanitation management shall meet the following requirements:
(a) buildings, structures, public service facilities, signs and signs are kept in good condition, clean and tidy, and maintained and replaced in time;
(2) The vegetation grows well and the plants are beautiful in appearance;
(three) dead branches of trees should be cleaned up in time, and plant defects should be replanted in time;
(four) clean environment, no bare garbage, dirt, sputum and cigarette butts and other debris, cleaning and cleaning operations in line with environmental health quality standards;
(five) in accordance with the relevant provisions of the prevention and control of rodents, mosquitoes, flies, cockroaches and other harmful organisms. Thirteenth construction units should protect the old and famous trees, cultural relics and historical buildings within the construction scope of the park square, formulate protection plans, and report to the park square management department for approval before construction. Involving the protection of cultural relics and historical buildings, it shall also obtain the consent of the cultural relics protection department.
The construction unit shall abide by the management regulations, protect the park square landscape and various facilities, take effective safety measures and set up safety warning signs. Fourteenth park square shall not add new units and households. Units and households that have been stationed shall abide by the management system of the park square, and shall not destroy the landscape and facilities of the park square, and shall not affect the safety of tourists, and shall not carry out new construction, reconstruction or expansion projects in the park square.
