Xi regulations on the promotion of aged care services

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Law of the People's Republic of China on the Protection of the Rights and Interests of the Elderly in order to cope with the aging population, meet the needs of the aged care service, improve the aged care service system and promote the healthy development of the aged care service. Measures of Shaanxi Province for Implementing the Law of the People's Republic of China on the Protection of the Rights and Interests of the Elderly and relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the old-age service and its supervision and management within the administrative area of this Municipality. Article 3 The term "aged care service" as mentioned in these Regulations refers to the socialized aged care service which is based on the legal support and maintenance obligations of family members and consists of basic public services of the government, public welfare mutual aid services of social organizations and market-oriented services of enterprises. Article 4 Old-age care services shall adhere to the principles of government leading, policy support, social participation, market operation, basic guarantee and moderate universal benefits, and establish an old-age care service system based on home, supported by community, supplemented by institutions and combining medical care with nursing care. Article 5 The municipal, district and county people's governments shall incorporate pension services into the national economic and social development plan, and include the funds required for pension services in the fiscal budget at the corresponding level. Article 6 The civil affairs departments of the people's governments of cities, districts and counties are the competent departments of pension services within their respective administrative areas, and are responsible for the guidance, management and supervision of pension services.

Development and reform, finance, human society, resource planning, housing construction, health and wellness, auditing, public security, market supervision, emergency management, medical security, industrial informationization, education, sports, big data and other departments and mass organizations shall, according to their respective responsibilities, do a good job in the related work of old-age services.

The town people's government and sub-district offices specifically organize and implement the old-age service work in this area.

The residents' committees and villagers' committees shall support and assist the work of providing for the aged. Article 7 Encourage, support and guide social organizations, enterprises, individuals and other social forces to provide and participate in pension services through various forms. Eighth news media should actively carry out publicity and education activities to respect, care and help the elderly, and create a social atmosphere of respect, support and help the elderly. Article 9 The municipal, district and county people's governments and their relevant departments shall commend and reward the units and individuals that have made remarkable achievements in the old-age service. Chapter II Planning and Construction of Service Facilities Article 10 The municipal civil affairs department shall, jointly with the municipal resource planning department, work out a special plan for old-age service facilities according to the level of economic and social development, the aging trend of the population and the demand for old-age services, and organize its implementation after being approved by the Municipal People's Government. Eleventh Municipal People's Government shall incorporate the land for the construction of old-age service facilities into the national spatial planning, and give priority to the land for the construction of old-age service facilities.

Without legal procedures, the land use of pension service facilities shall not be changed. Twelfth city, district and county people's governments shall, according to the per capita land of not less than 0. 1 square meter, plan and set up pension service facilities at different levels. Thirteenth new residential areas should be in accordance with the planning and standards supporting the construction of old-age service facilities, and with the residential synchronous planning, synchronous construction, synchronous acceptance, synchronous delivery.

If there are no old-age service facilities in the built residential area or the existing old-age service facilities do not meet the planning requirements and construction standards, the municipal, district and county people's governments shall formulate plans and annual plans, and set them up by means of purchase, replacement and lease according to the principle of convenience nearby.

Local civil affairs departments perform their supervisory and management duties by supporting the construction or purchase, replacement and lease of old-age service facilities to ensure that they are used for old-age services. Fourteenth residential areas supporting the construction of old-age service facilities, built by the development and construction units, should be handed over to the local civil affairs departments free of charge after completion. Fifteenth city, district and county people's governments should formulate policies and measures to encourage social forces to integrate and transform idle enterprise factories, commercial facilities and other available social pension resources. Article 16 District and county people's governments shall strengthen the construction of comprehensive old-age service centers in township streets, rural mutual happiness homes, rural nursing homes and other old-age service facilities through new construction, reconstruction, expansion and leasing. Seventeenth old-age service facilities should be built in accordance with the construction standards and design specifications of public facilities and old-age facilities, and meet the requirements of environmental protection, barrier-free facilities and fire safety. Eighteenth city, district and county people's governments should promote the construction of barrier-free facilities for the elderly in public buildings and other public places.

The municipal, district and county housing construction departments shall, jointly with urban management, civil affairs, finance, health and other departments, formulate plans for the renovation of barrier-free facilities, promote and support the renovation of barrier-free facilities for elderly families, and promote the aging renovation of public facilities such as ramps, elevators, handrails and seats in residential areas. The owner or manager is responsible for the renovation of barrier-free facilities.

Those who are included in the poor elderly and the elderly, disabled and disabled elderly families to carry out barrier-free facilities renovation services shall enjoy financial subsidies in accordance with relevant regulations. Nineteenth any unit or individual shall not change the use of the old-age service facilities or dismantle, occupy or destroy the old-age service facilities without authorization.

If it needs to be changed or demolished due to public interests, it should be built or replaced in time according to the requirements of not less than the original scale and standard. During the construction of old-age service facilities, transitional housing should be arranged to meet the needs of the elderly for old-age services.
