Regulations of Shanghai Municipality on Emergency Medical Care (revised in 2020)

Chapter I General Provisions Article 1 These Regulations are formulated for the purpose of standardizing emergency medical services, maintaining emergency medical order, improving the emergency medical service system and realizing the purpose of saving lives. Article 2 These Regulations shall apply to pre-hospital first aid, in-hospital first aid, social first aid and other activities and their management within the administrative area of this Municipality. Article 3 Pre-hospital emergency medical service as mentioned in these Regulations refers to the medical activities with on-site rescue, emergency treatment and transit monitoring as the main contents, which are dispatched by emergency centers and emergency stations (hereinafter referred to as pre-hospital emergency institutions) under unified command before the patients are sent to medical institutions for treatment.

The term "in-hospital emergency medical service" as mentioned in these Regulations refers to medical activities in which medical institutions with emergency departments (hereinafter referred to as in-hospital emergency institutions) provide emergency treatment for patients sent to pre-hospital emergency institutions or patients who come to see a doctor themselves.

The term "social first aid" as mentioned in these Regulations refers to the activities or behaviors that social organizations and individuals use basic operations such as cardiopulmonary resuscitation, hemostasis and bandaging, and fixed handling to rescue the injured in time and reduce the injury. Article 4 The municipal and district people's governments shall strengthen the leadership of emergency medical services, incorporate emergency medical services into the national economic and social development plan, establish a perfect financial input mechanism and operating fund compensation guarantee mechanism, and form an emergency medical network and service system with perfect plane emergency stations, complete three-dimensional emergency categories, advanced hardware configuration and orderly connection between pre-hospital and in-hospital to ensure the coordinated development of emergency medical services and economic and social development and meet the daily emergency needs of the masses. Fifth municipal health administrative departments in charge of emergency medical services within the city; The district health administrative department is responsible for the management of emergency medical services within its jurisdiction.

Development and reform, finance, planning resources, public security, fire protection, construction, economic informatization, transportation, human resources and social security, education, civil affairs, cultural tourism and other departments shall, according to their respective responsibilities, do a good job in emergency medical services. Article 6 The administrative department of health shall organize pre-hospital and in-hospital first-aid institutions to carry out publicity, education and training on first-aid knowledge and skills, and guide citizens to rationally use first-aid medical resources.

Newspapers, television, radio, internet and other media should carry out public welfare publicity of first aid knowledge and skills, advocate the concept of self-help and mutual rescue, and publicize the spirit of saving lives. Article 7 Citizens shall respect and cooperate with the emergency medical service activities carried out by pre-hospital emergency institutions and in-hospital emergency institutions, use emergency medical resources in a reasonable, standardized and orderly manner, and consciously maintain the emergency medical order. Eighth units and individuals are encouraged to donate to pre-hospital and in-hospital first aid institutions to support the development of first aid. Article 9 Pre-hospital first-aid and non-first-aid transshipment services shall be classified and managed.

Pre-hospital emergency services are provided by pre-hospital emergency agencies through ambulances.

Non-first-aid transshipment services can be provided by social forces through special transshipment vehicles, and the specific management norms are formulated by the Municipal People's Government. Chapter II Pre-hospital Emergency Medical Services Article 10 The municipal public health administrative department shall, jointly with the municipal planning and resources department, organize the preparation of a special plan for the construction of pre-hospital emergency facilities, reasonably determine the number and layout of first-aid stations, and incorporate them into the corresponding urban and rural planning after approval by the Municipal People's Government.

The municipal planning and resources department and the District People's Government shall reserve land for the construction of pre-hospital emergency facilities.

The District People's Government shall, in accordance with the special plan for the construction of pre-hospital emergency facilities in this Municipality, build relevant facilities of pre-hospital emergency institutions. Eleventh pre-hospital emergency institutions shall, in accordance with the relevant provisions of laws and administrative regulations, apply to the municipal and district health administrative departments for pre-hospital emergency medical practice registration.

Without the approval of the administrative department of health, no unit or individual may set up a pre-hospital emergency medical service without authorization. Twelfth municipal health administrative departments shall organize the formulation of pre-hospital emergency medical work norms and quality control standards, and establish a statistical reporting system.

Pre-hospital emergency institutions shall, in accordance with the pre-hospital emergency medical work norms and quality control standards, formulate corresponding management systems, organize regular emergency business training and assessment, and submit relevant statistical information to the health administrative department. Article 13 The employees of pre-hospital first-aid institutions include first-aid doctors, medical first-aid command and dispatch personnel, administrative personnel, first-aid auxiliary personnel and professional maintenance personnel of medical first-aid equipment. The post setting and staffing of pre-hospital emergency institutions shall be implemented in accordance with the relevant provisions of the state and this Municipality. Article 14 This Municipality shall reasonably determine the number of ambulances in pre-hospital emergency institutions (hereinafter referred to as ambulances) according to the regional service population, service radius, geographical environment, traffic conditions and business needs, and equip them with a certain number of special ambulances. The specific number of ambulances shall be compiled by the municipal public health administrative department and reported to the Municipal People's Government for approval.

Ambulances shall conform to national standards, have obvious signs and names of first-aid medical treatment uniformly prescribed by the industry, install positioning systems, communication equipment and video monitoring systems in accordance with relevant regulations, equip with alarms, sign lamps, first-aid equipment and medicines, and spray "120" and other signs and patterns.

Ambulances should only be used by cars. No unit or individual may use ambulances to carry out non-pre-hospital emergency medical services.

Any social vehicle shall not use logo patterns such as "120".
