Opinions of the Party Group of Henan Provincial Department of Land and Resources on Accelerating the Transformation of Resource Utilization Mode, Serving and Promoting Scientific Development

In recent years, under the leadership of party committees and governments at all levels, the province's land and resources system has strictly protected resources, worked hard to ensure scientific development, and actively promoted the efficient use of resources, providing strong support for the steady and rapid economic and social development. However, on the whole, the situation faced by land and resources work is still very grim, the structure and layout of resource utilization are not reasonable, the way of resource development and utilization is still extensive, the phenomenon of destruction and waste of resources is still widespread, some deep-seated contradictions and problems in the resource field have not been effectively solved, and the supply of resources also implies a certain degree of risk and unsustainability. In order to thoroughly implement the central government's major decision-making arrangements on accelerating the transformation of economic development mode, further accelerate the transformation of resource utilization mode, and serve and promote the economic and social scientific development of the province, we hereby put forward the following opinions:

First, unify thinking and understanding and accelerate the transformation of resource utilization mode.

(1) Seriously study and understand the spirit of the Central Committee, the Provincial Party Committee and the Ministry of Land and Resources.

The 17th National Congress of the Communist Party of China put forward the strategic task of accelerating the transformation of economic development mode, emphasizing the need to promote the transformation of economic growth from relying mainly on investment and export to relying on the coordinated development of consumption, investment and export, from relying mainly on the secondary industry to relying on the coordinated development of the primary, secondary and tertiary industries, and from relying mainly on increasing the consumption of material resources to relying mainly on scientific and technological progress, improving the quality of workers and management innovation. At the Central Seminar, General Secretary Hu Jintao proposed to speed up the adjustment of economic structure, industrial structure, independent innovation, the transformation of agricultural development mode, the construction of ecological civilization, the coordinated development of economy and society, the development of cultural industries and the transformation of foreign economic development mode. Lu Zhangong, secretary of the provincial party committee, stressed at the seminar of the provincial party committee that it is necessary to raise awareness, speed up the transformation, persist in development and speed up the transformation, pay attention to sustainability and speed up the transformation, highlight innovation and speed up the transformation, and make overall coordination, effective operation and speed up the transformation. All units and departments of the whole system should conscientiously study and understand, and effectively unify their thoughts and actions with the decision-making arrangements of the central and provincial committees and the Ministry of Land and Resources.

(b) Deeply understand the necessity and urgency of changing the way resources are used.

Land and resources are the material basis and important support for economic and social development. Saving and intensive use of resources is not only an inevitable requirement and an important focus for changing the mode of economic development, but also an important way to stimulate economic growth. For a long time to come, the basic situation of less arable land per capita, less reserve arable land resources, less mineral resources per capita and insufficient endowment in our province will not change, the demand for resources for population growth and economic development will continue to rise, and the contradiction between supply and demand of resources will become more and more prominent. The whole system should deeply realize that the increasing pressure on the protection of land and mineral resources is ostensibly the pressure of insufficient total supply of resources, but in essence it is the impact on the existing structure and mode of resource utilization, the impact on the traditional industrial structure and economic development mode, and it is the concentrated expression and intensification of the long-term accumulated contradictions in the field of land and resources development and utilization. Therefore, the fundamental way to relieve pressure and solve problems lies in thoroughly implementing Scientific Outlook on Development, promoting reform and innovation, and promoting the transformation of economic development mode through the transformation of resource utilization mode.

(three) to study and implement policies and measures to promote the transformation of resource utilization mode.

All units and departments of the whole system should take accelerating the transformation of resource utilization mode as an important starting point and focus of current land and resources management, seriously study policies and measures, and do a good job in implementation. It is necessary to combine the 20 10 action of "Protecting Development and Protecting Red Line" project to promote the transformation of economic development mode as the main line, highlight the theme of "stabilizing growth, adjusting structure, promoting transformation and protecting red line", actively serve and strictly standardize management, focus on deepening land regulation and control policies, improve the mechanism of saving and intensive land use, adhere to the "red line" of cultivated land protection, and promote economic development through the transformation of land use mode. It is necessary to combine the achievements of consolidating and expanding the discussion on the reform and development of geological prospecting with the goal of improving the level of mineral resources security, further explore and build a new mechanism for mineral resources exploration and development that meets the requirements of scientific development, and strive to make efforts in implementing deep prospecting and comprehensive exploration, deepening the integration of mineral resources, and strengthening the comprehensive development and utilization of mineral resources. Improve the mining circular economy system, protect the geological environment, promote enterprise management and work mode innovation, and constantly improve the level of protection, development and utilization of mineral resources.

Second, strengthen planning guidance and optimize the allocation of resources and the spatial distribution of productive forces.

(D) Optimize the structure and layout of land use

We will fully implement the new round of overall land use planning, give priority to the construction of the national grain core area, the construction of key areas such as the Central Plains urban agglomeration and the development of industrial agglomeration areas, and promote the industrial upgrading and economic restructuring of the province. In accordance with the requirements of "three regulations in one" of land planning, urban planning and industrial agglomeration planning, we will further give play to the guiding and regulating role of the overall land use planning, rationally guide the spatial distribution of productive forces, guide the development direction of regional economy, industrialization and urbanization, guide, standardize and guarantee the construction of various projects, optimize the land layout in different regions, and promote the agglomeration of production factors to key regions, key industrial belts, industrial agglomeration areas and central towns. The planning of cities, towns, transportation, water conservancy, energy, tourism and ecological construction must conform to the land use scale and spatial layout determined by the overall land use planning.

(5) Coordinating the exploration, development and utilization of mineral resources.

Actively strive for the early approval and implementation of the Master Plan of Mineral Resources in Henan Province (2008-20 15) by the state, and accelerate the compilation of mineral resources planning at the provincial and county levels. Adhere to both open source and throttling, pay equal attention to development and protection, further strengthen basic and public welfare geological work, and deploy important mineral resources exploration in advance; Actively promote the cooperation between provinces and departments, speed up the implementation of the "Henan Province Geological Prospecting Master Plan" and implement the "6 139" geological prospecting plan; Adhere to the combination of mineral resources exploration and development with economic and social development layout, and promote the healthy development of mining economy based on provincial conditions; Coordinate "two resources and two markets", based on this province, and extensively carry out foreign cooperation in mineral exploration and development; Adhere to the unity of mineral development and environmental protection, and correctly handle the relationship between mineral development and other natural resources, ecological environment and related industries; Adhere to the combination of macro-control and market allocation of resources, so that mineral exploration and development can be carried out in an orderly manner.

(six) scientific planning of land spatial development and utilization pattern.

Make full use of the cooperation platform between provinces and ministries, speed up the preparation of the land planning of the Central Plains urban agglomeration, coordinate the spatial planning of land use, urban and rural construction, energy, transportation and water conservancy in the whole province, coordinate urban and rural development, adjust and optimize the industrial layout, and regulate the total supply and structure of resources. By 2020, land resources and land space in the planning area will be rationally allocated, forming a land pattern with clear land development and utilization functions, rational land spatial structure, and benign interaction among the core layer, compact layer and radiation layer of urban agglomeration. The agglomeration, radiation-driven, independent innovation and overall competitiveness of urban agglomeration will be significantly enhanced, and the regional ecological environment and urban and rural living environment will be significantly improved.

Third, deepen resource control and promote economic restructuring and industrial transformation and upgrading.

(seven) the implementation of differentiated land supply policy.

According to the requirements of changing the mode of economic development and industrial transformation and upgrading, combined with local conditions, the total amount, layout, structure and timing of land supply for each specific project should be reasonably regulated. Strictly implement the national industrial policy and land supply policy, adhere to classified guidance, maintain pressure, give priority to the protection of major industrial upgrading projects and low-carbon economic industrial land determined by the provincial government, and actively protect the land demand of key urban new areas, industrial clusters, affordable housing, social undertakings, people's livelihood projects and other key projects. Strictly control the pre-approval of project land, resolutely curb "two high and one capital", overcapacity and low-level redundant construction projects, intensify the elimination of backward production capacity, limit the excessive growth of industries with high energy consumption and high emissions, and promote the optimization and upgrading of economic structure and energy conservation and emission reduction. Explore the method of organically combining the price of industrial land, the transfer period and the output benefit after completion and production, and implement the supply policy different from the general project land in terms of price, rent and supply order for the land that conforms to the direction of industrial structure adjustment and optimization, so as to further enhance the flexibility and pertinence of land regulation.

(eight) regulate the supply and supervision of real estate land.

Scientifically compile and strictly implement the annual supply plan of housing, especially affordable housing land, reasonably determine the total supply and structure of housing land, ensure that the construction land for affordable housing, shantytown renovation and self-occupied small and medium-sized commercial housing is not less than 70% of the total supply of housing construction land, strictly limit the supply of low-density and large-sized housing construction land, and prohibit land supply to villa projects. Standardize the transfer of commercial housing land, adhere to and improve the transfer system of bidding, auction and listing in accordance with the principles of openness, fairness and justice and the requirements of unified and standardized market construction. Strengthen the supervision of real estate land, implement the declaration system for the completion acceptance of housing land, strengthen the dynamic monitoring of the development and utilization of residential land, strengthen the post-supply supervision of real estate land, especially affordable housing land, and seriously investigate and deal with violations of laws and regulations.

(9) Strengthen land acquisition, reserve and market supervision.

Under the premise of adhering to the government's leading, centralized and unified, the urban stock of construction land and other land listed in the acquisition reserve according to law will be included in the scope of land acquisition and reserve, and the land control ability of city and county governments will be enhanced. All localities should, according to the needs of economic and industrial development, scientifically formulate land acquisition, reserve and supply plans in accordance with the provisions of the Measures for the Administration of Land Reserve of the Ministry of Land and Resources, the Ministry of Finance and the People's Bank of China, adjust the total supply and demand of land in a timely and appropriate manner, adjust the land use structure, regulate the land supply price, and guide investment and construction. Explore the industrial land reserve system in industrial clusters, develop and sort out the newly-added land in industrial clusters through land reserve institutions at all levels and appropriate infrastructure, form industrial land conditions as soon as possible, give priority to high-tech industrial projects or investment projects that meet industrial orientation, strive to alleviate the contradiction between urgent land use and long land acquisition time for some industrial projects, gradually change the passive situation of "land follows projects" and form a virtuous circle of "land guiding projects".

(10) Deepen the development and integration of important mineral resources.

Conscientiously implement the Opinions of the General Office of the People's Government of Henan Province on Further Promoting the Development and Integration of Mineral Resources (Ban [2010] No.25), focus on minerals such as coal, aluminum, iron, gold, molybdenum, tungsten, copper, lead, zinc and antimony, deepen the integration of resources, further improve the scale and intensive level of mineral exploration and development, and accelerate the development of mineral resources. On the premise of protecting the legitimate rights and interests of mining rights holders, we should comprehensively use economic, legal, technical and necessary administrative means, and adopt various ways such as merger, acquisition and reorganization to deeply integrate the established mining rights, so that the mining rights can meet the needs of integrated exploration and large-scale development. Reasonably set the access conditions for mineral resources exploration and development, appropriately raise the access threshold for enterprises in terms of registered capital, production capacity and technical and economic indicators, explore the establishment of an elimination and withdrawal mechanism, and strive to improve the scale efficiency of mineral development.

(eleven) the establishment of important mineral resources reserve system.

According to the principle of finding out the family property and being ahead of others, the government will invest in geological exploration of important minerals such as molybdenum, bauxite, coal, trona, deep coverage and low-grade iron ore, as well as rare minerals such as rare earth and uranium, so as to form a number of important mineral occurrences and bring them into the reserve. Orderly reserve important mineral areas invested by the state, mineral areas where exploration and mining are prohibited, mineral areas with immature technical conditions and uneconomical development and utilization, and mineral areas that need total control. According to the needs of our province's economic and social development and the market supply and demand situation, we will transfer the reserve mineral land in a planned way, effectively regulate the market, and ensure the safety and sustainability of resource supply.

Fourth, innovative ways of utilization, and actively build a resource-saving and intensive utilization system.

(twelve) to strengthen the guidance of land conservation and intensive use.

In accordance with the principles of land conservation, intensive development and rational layout, we will strictly control the scale of urban land use and actively take measures to encourage and guide the construction of compact cities. According to the principle that price reflects scarcity, we will strive to concretize the land interest adjustment mechanism. On the one hand, the acquisition, use and retention costs of new construction land will increase; On the other hand, actively broaden the channels to revitalize the existing construction land, and accelerate the "reverse" mechanism of economical and intensive land use with internal tapping potential as the main feature. For the land that has been approved but not requisitioned, adjust the position of construction land according to the law and make full use of it; We will intensify efforts to clean up and dispose of unused land that has been requisitioned and not supplied, and adjust land use. Study and establish an evaluation index system of land use status, land use efficiency and land management performance, and formulate assessment methods for the consumption of new construction land for the growth of unit GDP and fixed assets investment scale. Focus on strengthening the assessment and evaluation of economical and intensive land use in industrial clusters, take the results as the basis for the allocation, expansion and upgrading of land use indicators in industrial clusters, and build industrial clusters into demonstration areas of economical and intensive land use according to laws and regulations.

(thirteen) vigorously promote the application of advanced land-saving technology.

Strictly implement land use conditions and standards, resolutely stop the disorderly expansion of urban construction, prohibit the construction of wide roads, large squares and green belts that are divorced from actual needs, limit low-rise buildings, and reasonably increase the floor area ratio of urban buildings. Actively study policies, encourage the development and utilization of underground space, and increase the construction and use of multi-storey standard factories. For the project land for the construction of multi-storey standard factory buildings, priority should be given to solving the land use index; Construction projects that require the use of standard workshops must enter the standard workshops.

(fourteen) to improve the level of development and utilization of mineral resources.

Improve the technical and economic index system such as mining recovery rate, mineral processing recovery rate and comprehensive utilization rate, promote the application of comprehensive mining and utilization technology of minerals, and encourage both rich and poor mining and comprehensive recovery. Focusing on the adjustment of industrial structure, the extension of industrial chain and the development of high value-added follow-up industries are regarded as important conditions for the allocation of reserve resources, supporting the development or joint development of deep processing industries such as provincial key coal enterprises, key alumina enterprises and molybdenum enterprises, and encouraging the development of mining circular economy. Actively promote advanced and applicable technologies for energy conservation and emission reduction, improve the efficiency of resource and energy utilization, and promote the transformation of resource utilization from extensive to intensive.

Five, do a good job in overall coordination, and promote the comprehensive, coordinated and sustainable development of urban and rural areas.

(fifteen) strict protection of cultivated land, especially basic farmland.

Adhere to the strictest farmland protection system, conscientiously implement the responsibility of farmland protection with the overall responsibility of the government, the relevant departments performing their duties and the wide participation of the whole society, and strengthen assessment, supervision, rewards and punishments. Strictly manage the balance of cultivated land occupation and compensation, strive to increase the effective cultivated land area and improve the quality of cultivated land. Strengthen the basic construction of basic farmland protection, put the basic farmland protection map into storage at the provincial, city, county and township levels for record management, decompose the basic farmland protection indicators step by step, and implement them to maps, plots, village groups and farmers to ensure that the basic farmland in the province remains above 654.38+0.01.700 million mu.

(sixteen) to promote the comprehensive improvement of rural land.

According to the overall land use planning and urban and rural construction planning, we will integrate and use all kinds of special funds for land, strive to aggregate other funds related to agriculture, coordinate and coordinate various activities such as agricultural land consolidation, rural construction land consolidation, wasteland reclamation and unused land development, actively promote the pilot project of "thousand villages renovation", and explore new ways to protect cultivated land and promote coordinated urban and rural development under the new situation. Accelerate the implementation of the speed-up project of land development and consolidation, improve agricultural production conditions and build high-standard basic farmland. Accelerate the construction of major land consolidation projects at the head of the South-to-North Water Transfer Project and along the route, and improve the comprehensive grain production capacity. Explore and innovate the management mechanism of land development and consolidation projects, and encourage powerful state-owned geological prospecting units to participate in land development and consolidation.

Further improve the engineering quality. Increase the vitality of clearing idle land, wasteland, abandoned land and inefficient land in rural areas, make full use of the policy platform linked to the increase and decrease of urban and rural construction land, and provide land space for industrial cluster construction and county economic development.

(seventeen) to increase the protection of geological environment.

Fully implement the deposit system for mine geological environment restoration, clarify the responsibilities and obligations of mining enterprises for restoration, and supervise and inspect the project management of mining enterprises. For the geological environment problems of mines left over from history, we will strive to further increase financial investment for the management and restoration of geological environment of abandoned mines left over from history and without responsible subjects. Focus on harnessing contiguous demonstration areas around urban and rural residential areas, within the visible range of traffic trunk lines, with great environmental impact, high attention from all walks of life and outstanding social and ecological benefits after harnessing, and improve the mine geological environment in the whole province within 5 to 10 years.

Six, promote reform and innovation, and strive to improve the ability to ensure scientific development.

According to the national macro-control policies, industrial policies, land supply policies and the actual economic and social development of our province, actively cooperate with the development and reform departments to do a good job in selecting key projects, scientifically compile land budgets, and strive to make the total land use scale of key projects adapt to the annual land use plan indicators of our province issued by the state. In accordance with the principle of "limiting indicators to ensure key points", the planned indicators of reserved land for construction projects included in the scope of key projects shall be uniformly allocated when approving land use. For projects that meet the requirements of entering development zones and industrial clusters, in principle, no separate site is selected for land supply. In accordance with the principle of "general projects rely on tapping potential", cities and counties are encouraged and guided to rely on intensive tapping potential to solve the land demand for county economic development and other construction projects. Strengthen the tracking management and inspection of the implementation of land use planning indicators, and transfer unused land to other construction projects that are in urgent need of land.

(nineteen) promote the reform of rural land management system in an orderly manner.

Deepen the research on the reform and construction of rural land property rights system, improve the registration system of land ownership, and further improve the registration and certification of collective land ownership, homestead use right and collective construction land use right. Explore the reform of land expropriation system, expropriate rural collective land according to law, fully implement the comprehensive land price of the expropriated area, pay land acquisition compensation in full and on time according to the principle of the same place and the same price, and properly resettle the landless farmers. Do a good job in the pilot, sum up experience, further standardize the paid transfer of rural collective construction land use rights, and accelerate the establishment of a unified urban and rural construction land market. Focusing on the process of urbanization, rural construction and urban-rural integration, this paper studies the reuse of collective land after farmers enter the city, actively explores new ways such as changing farmers' homestead into urban housing, and promotes the rational utilization of land resources.

(twenty) explore the construction of a new mechanism for the exploration and development of mineral resources.

In accordance with the laws of the socialist market economy and the requirements of geological work, we will explore a new mechanism for geological exploration, in which governments at all levels interact with enterprises, public welfare geological work, geological exploration funds and commercial mineral exploration are organically linked, geological exploration and mineral development are closely combined, and geological exploration is coordinated with mining rights management and the reform and development of geological prospecting units. Closely combined with the reality of resources and economic and social development in our province, we will actively build a mining right management system with planning as the leading factor, mining right management as the core, mining right access system as the guidance, and mining right planning as the adjustment means, so as to form a long-term mechanism of departmental cooperation, up-and-down linkage and * * * promoting the rational development and utilization of mineral resources. In accordance with the general requirements of establishing and improving the socialist market economic system and the reform of national and provincial institutions, we will actively and steadily promote the reform and development of state-owned geological prospecting units according to local conditions, give guidance by classification, and introduce policies as soon as possible to improve the external environment of geological exploration, give priority to the allocation of mining rights, distribute the benefits of achievements, reward exploration achievements, and support and encourage geological prospecting units to explore internal management system reform and mechanism innovation.

(twenty-one) to study and implement the "two guarantees and one high" incentive and restraint mechanism.

Thoroughly implement the spirit of "Several Opinions of the People's Government of Henan Province on Strict Protection of Cultivated Land, Scientific Development and Efficient Use of Land" (Yufa [2008] No.44), actively cooperate with relevant departments, establish and improve the incentive and restraint mechanism of "two guarantees and one high" from the aspects of policies, funds, projects and indicators, and study the specific measures for introducing the "four links" policy. That is, the paid land use fee for new construction land and the centralized land use right transfer income in the province are linked to the performance of "two guarantees and one high" in various places, the allocation of construction land planning indicators is linked to the construction of key projects in various places, the allocation of construction land planning indicators is linked to revitalizing the potential stock of construction land, and the performance of "two guarantees and one high" is linked to the annual responsibility target assessment of the municipal and county (city, district) governments. By establishing and perfecting the incentive and restraint mechanism, we will further promote the protection and efficient utilization of land and resources.

(twenty-two) continue to promote the transformation of land and resources system.

We will improve the online submission and internal joint examination procedures for land, mineral and other licensing and approval matters, strictly implement the one-time notification system for the correction of application materials, optimize the examination and approval procedures, simplify the application materials, compress the time limit for completion, strengthen communication and departmental coordination, and strengthen the accountability for administrative faults, so as to be legal, timely and efficient. Strengthen the construction of cadres in the whole system, continue to promote the "two transformations and two upgrades", highlight the transformation of functions and styles, further improve administrative efficiency, and strive to achieve greater results in protecting resources, ensuring development, safeguarding rights and interests, and serving the society.
