Provisions of Chengdu Municipality on the Classification Management of Surface Water Environmental Functions

Article 1 In order to strengthen the environmental management of our city, control water pollution, improve and improve the quality of water environment, safeguard human health, make rational and effective use of water resources, and promote economic development, these Provisions are formulated according to the national Environmental Quality Standard for Surface Water (GB 3838-88) and combined with the actual situation of surface water areas in our city. Article 2 These Provisions shall apply to rivers, lakes, reservoirs, ponds, agricultural irrigation channels, water storage farmland and other surface waters within the administrative area of our city. Article 3 According to the use purpose and protection target of surface water in our city, surface water environmental function zoning can be divided into five categories:

1 is mainly applicable to source water, national and provincial nature reserves.

The second category is mainly suitable for centralized drinking water source first-class protected areas, precious fish protected areas, fish and shrimp spawning grounds, etc.

The three types are mainly suitable for centralized drinking water source secondary protection areas, general fish protection areas and swimming areas.

The four types are mainly suitable for general industrial water areas and recreational water areas where human bodies are not in direct contact.

The five categories are mainly suitable for agricultural water use areas and waters with general landscape requirements. Article 4 The principle of environmental function classification of surface water areas in our city:

(a) Give priority to the protection of drinking water sources;

(two) do not reduce the current water function;

(three) when the same water area has multiple functions, it is classified according to the highest function;

(4) Rational utilization of water environmental capacity is beneficial to control water pollution and promote sustainable economic development;

(5) Take the overall situation into consideration. The functional category of the upper reaches of waters is generally not lower than that of the lower reaches. The quality of water sources entering rivers, lakes, reservoirs, ponds and farmland must meet the functional requirements;

(six) the surface water mixed area formed by sewage discharge shall not affect the water quality of adjacent functional areas and fish migration channels. Fifth Municipal Environmental Protection Bureau in charge of the city's surface water environmental function classification. And in conjunction with the municipal administrative departments of water conservancy, agriculture, health, planning, urban construction, urban management, public utilities, etc., it is responsible for organizing and implementing the environmental function classification of the main surface water areas in the city. Article 6 The administrative department of environmental protection of a district (city) county shall, jointly with the administrative departments of water conservancy, agriculture, urban construction and public health at the same level, put forward opinions on the implementation of functional classification for the waters that need strict protection, such as rivers, streams, small reservoirs, lakes, flat ponds and agricultural irrigation canals, and may partially classify the waters that have been classified by the city in the district (city) county. Functional classification of waters that do not involve the water quality of adjacent districts (cities) and counties shall be implemented with the approval of the district (city) and county people's government and reported to the Municipal Environmental Protection Bureau for the record; Involving neighboring districts (cities) and counties, the implementation of functional categories must be applied to the Municipal Environmental Protection Bureau, which will be implemented after being approved by the Municipal Environmental Protection Bureau in conjunction with the relevant municipal administrative departments. Seventh city, district (city) and county environmental protection administrative departments of environmental monitoring stations, responsible for the monitoring and evaluation of surface water quality within their respective jurisdictions. Monitoring and evaluation shall be carried out as required.

(a) monitoring sampling points, should be arranged in the representative position of each functional area. The monitoring and analysis method shall be implemented according to the method specified in GB 3838-88, Environmental Quality Standard for Surface Water.

(three) the single monitoring value exceeds the standard, which means that the function cannot be guaranteed. The degree of harm should be comprehensively evaluated with reference to background values, survey data of aquatic organisms, hardness correction equation and related basic data. Eighth city, district (city) county environmental protection administrative departments to implement unified supervision and management of surface water environmental functions within their respective jurisdictions. Water conservancy, health, agriculture, fisheries and other relevant administrative departments. In accordance with the provisions of the "People's Republic of China (PRC) Environmental Protection Law", supervise and manage the relevant waters within the jurisdiction within the scope of duties.

(a) the administrative department of environmental protection and the administrative department of water resources of the people's governments of cities, districts (cities) and counties shall be responsible for the supervision and management of the implementation of the national environmental quality standard for surface water (GB 3838-88), and the waters with different functional categories shall implement corresponding water quality standards. The water quality of rivers, branches, buckets, canals and other water sources entering the waters of designated functional areas must meet the water quality requirements of designated functional areas.

(II) Centralized drinking water intakes in cities, towns and villages and their nearby waters shall be supervised and managed by the municipal, district (city) and county environmental protection administrative departments in conjunction with the health departments at the same level and other relevant departments in accordance with the national Hygienic Standard for Drinking Water GB 5749-85.

(3) The fishery waters shall be supervised and managed by the fishery administrative department in accordance with the national fishery water quality standard GB 1 1607-89.

(four) agricultural irrigation water, by the competent department of environmental protection and agricultural administration according to the national "farmland irrigation water quality standard GB 5048-85" supervision and management.

(five) radiation indicators, by the environmental protection department according to the national "radiation protection regulations GB 8703-88" supervision and management. Article 9 The Chengdu Environmental Protection Bureau shall be responsible for the interpretation of these Provisions.
