Regulations of Yingkou Municipality on Domestic Service

Chapter I General Provisions Article 1 In order to regulate domestic service activities, safeguard the legitimate rights and interests of all domestic service parties and promote the healthy development of domestic service industry, these Regulations are formulated in accordance with the provisions of relevant laws and regulations and in light of the actual situation of this Municipality. Article 2 These Regulations shall apply to domestic service activities and their supervision and management within the administrative area of this Municipality. Article 3 The term "domestic service" as mentioned in these Regulations refers to the paid service activities that domestic service personnel assigned, introduced by domestic service agencies or employed by domestic service users (hereinafter referred to as users) enter users' residences or provide care, cleaning, cooking and other daily needs in places designated by users.

The term "domestic service institutions" as mentioned in these Regulations refers to enterprises, institutions, private non-enterprise units and individual economic organizations established in accordance with the law to engage in domestic service business activities, including employee-based domestic service institutions and domestic service intermediaries.

Employee-based domestic service institutions refer to domestic service institutions that sign labor contracts or service agreements with domestic service personnel according to law, sign service contracts with users, uniformly arrange domestic service personnel to provide services for users, directly pay or pay labor remuneration to domestic service personnel, and continuously train and manage domestic service personnel.

A domestic service organization refers to a domestic service organization that provides domestic service information to users and domestic service personnel as an intermediary. Fourth domestic service activities should follow the principles of voluntariness, equality, honesty and trustworthiness, safety and convenience. Article 5 The municipal and county (city) district people's governments shall incorporate the domestic service industry into the national economic and social development plan at the corresponding level, establish and improve the financial input guarantee mechanism, and formulate policies and measures to promote the healthy development of the domestic service industry. Sixth city and county (city) District Department of commerce is responsible for the supervision and management of domestic service industry within their respective administrative areas.

Development and reform, finance, human resources and social security, education, health, market supervision and management, housing and urban and rural construction, civil affairs, banking and insurance supervision and other departments, according to their respective responsibilities, do a good job in the management and promotion of domestic service industry.

Trade unions, the Communist Youth League, women's federations and other organizations help promote the development of domestic service industry.

Residents' committees and villagers' committees assist in the related work of domestic service industry. Chapter II Standardized Management Article 7 A domestic service institution shall publicize information such as relevant licenses, service items, charging standards, complaint supervision telephone numbers, etc. in prominent positions such as its business premises and websites. Article 8 An employee-based domestic service institution shall conclude a labor contract with the employed domestic service personnel according to law and pay social insurance premiums.

If the hired domestic service personnel do not meet the conditions for concluding a labor contract, the employee-based domestic service institution shall conclude a service agreement with them, and the domestic service personnel may voluntarily participate in social insurance in accordance with the regulations.

Employee-based domestic service institutions shall train their domestic service personnel in service skills, professional ethics, laws and regulations, safety norms, hygiene and health, etiquette and emergency rescue knowledge, establish work files and personal credit files, and establish and improve the service quality tracking management system. Ninth domestic service institutions shall sign domestic service contracts or domestic service intermediary contracts with users according to law.

If domestic service personnel and users reach an agreement through domestic service intermediaries, they shall conclude a domestic service contract according to law; If an agreement is reached by other means, domestic service contracts are encouraged to be concluded in writing.

Domestic service institutions shall truthfully inform users and domestic service personnel of matters related to the conclusion of contracts, and shall not intentionally conceal important facts related to the conclusion of contracts or provide false information.

Advocate the use of model texts of domestic service contracts. The demonstration text of domestic service contract shall be formulated by the municipal human resources and social security department in conjunction with the commercial department. Article 10 When recruiting domestic service personnel or introducing domestic service work to domestic service personnel, a domestic service institution shall examine their identity, skills, health and other valid certificates, and learn about their work experience, service specialty, service will, home address and other basic information. , and shall not detain the ID card, skill certificate, health certificate and other documents of domestic service personnel. Eleventh domestic service agencies shall have the following acts:

(1) Assigning or introducing persons who have not provided valid identification to engage in domestic service;

(two) to assign or introduce domestic service personnel to users who do not provide valid identification;

(3) Assigning or introducing domestic service personnel who fail to participate in the medical examination or fail to pass the medical examination as required to engage in domestic service;

(four) other acts prohibited by laws and regulations. Twelfth municipal commerce department in conjunction with the administrative department of health to determine the physical examination items and standards of different types of domestic service personnel. Physical examination standards are divided into general domestic service personnel, home-based domestic service personnel, elderly care personnel and maternal and child care personnel according to the strictness from low to high, and different types of domestic service personnel apply different physical examination standards.

Domestic service personnel shall carry out pre-job health examination in accordance with the determined physical examination items and standards. The physical examination results are valid for one year, and the domestic service personnel should have a physical examination again after the expiration. Thirteenth domestic service personnel shall truthfully inform the domestic service agencies and users of their own identity, education, age, work experience, service skills, health status, contact information and whether there are any bad hobbies.

When providing domestic service, domestic service personnel should behave in a civilized manner, standardize language, respect the living habits of users, and provide services in accordance with the service contents and standards agreed in the domestic service contract.

If the health condition of domestic service personnel is not suitable for domestic service, they shall not engage in domestic service before they are cured.
