Article 1 In order to establish and improve the kindergarten registration system, strengthen the scientific management of kindergartens, and improve the quality of conservation education, these measures are formulated in accordance with the Regulations on Kindergarten Management, the Working Rules of Kindergartens, and the Interim Measures for the Registration of Kindergartens and Preschools in Nanchang, combined with the actual situation in our district.
Article 2 Kindergartens are institutions that provide care and education for preschool children over three years old. They are an organic part of basic education and the basic stage of the school education system.
Article 3 The main tasks of kindergartens are: to implement the policy of combining conservation with education, to educate children to develop in an all-round way in physical, intellectual, moral and aesthetic aspects, and to promote the harmonious development of children's body and mind.
Article 4 The state encourages enterprises, institutions, social organizations, other social organizations and individual citizens to make use of non-state financial education funds to set up early childhood education institutions for the society. Encourage kindergartens to develop to a high level and scale.
Fifth kindergartens implement territorial management. The education administrative departments at or above the county (district) level shall examine, approve, register and issue school licenses before the establishment and enrollment. No unit or individual may set up a kindergarten without registration.
Article 6 The basic conditions for starting a kindergarten are:
(a) the kindergarten must be set in a safe area, the surrounding environment is free from danger, pollution and noise, there are no dangerous buildings and facilities in the kindergarten, and the garden is solid, safe, ventilated and applicable. There are indoor and outdoor children's activities.
(two) the kindergarten has an independent name and articles of association, and the legal representative should be a citizen who loves education, has good conduct and has a fixed residence in this city.
(three) enterprises and institutions, street collective kindergartens should have more than 654.38 million yuan of fixed assets investment; Private individual kindergartens should have fixed assets investment of more than 50 thousand yuan and standby education funds of more than 50 thousand yuan.
(four) principals and teachers should have formal pre-school education technical secondary school or above (including preschool normal schools and vocational schools). Nurses and other staff should have a high school education or above, and obtain professional qualification certificates and post certificates. The ratio of teaching staff to children shall not exceed 1: 12, and the ratio of teachers to children shall not exceed 1:24.
(5) The kindergarten director (legal representative) must be a person who can engage in preschool education full-time, has a technical secondary school degree or above in preschool education or has obtained a teacher qualification certificate, must have more than three years of experience in preschool education, and has not received any administrative punishment in preschool education for five years before the date of application.
Article 7 To apply for starting a kindergarten, the following materials shall be submitted:
(a) application (public, enterprises and institutions, street collective kindergarten by the competent authorities to apply);
(two) the articles of association of the park and the internal management system of the kindergarten;
(three) the legal representative, teachers, nurses and other staff roster. Attach the original resume, ID card, academic certificate, professional qualification certificate, employment certificate, health certificate and other materials.
(4) Capital verification report on fixed assets, annual report on investment in fixed assets, and proof of reserve education funds;
(five) the certificate of use of the office space that meets the requirements. (including land certificate, real estate license, lease contract, etc.). )
(six) the certificate that the garden meets the fire safety (issued by the local public security fire department or the fire department of the competent unit).
Article 8 The articles of association for running a garden shall include the following contents:
(a) the name of the kindergarten and the specific location and basic situation of the practice place;
(two) the purpose and mode of kindergarten;
(3) the organizational form, internal institutions and class settings of kindergartens. ;
(four) the composition and responsibilities of the kindergarten committee;
(five) the responsibilities of kindergarten directors and the procedures for their emergence and change;
(six) the rights and obligations of preschool teachers and other staff;
(seven) the amount of fixed assets, start-up expenses and sources of education funds;
(eight) financial management system, distribution system and debt methods and responsibilities;
(nine) the conditions and procedures for the change and termination of kindergartens;
(ten) other matters that need to be explained.
The contents of the articles of association of kindergartens must comply with the provisions of the Regulations on the Administration of Kindergartens, and the articles of association of kindergartens shall take effect as of the date when kindergartens are allowed to start.
Article 9 After an organization or individual applying to start a kindergarten submits the application materials to the administrative department of education under its jurisdiction, the administrative department of education shall complete the preliminary investigation and put forward opinions within 15 days. Kindergartens with complete materials and meeting the registration conditions shall be registered within 15 days, and a "Park Permit" shall be issued. For those who cannot register, explain the reasons and put forward rectification opinions.
Tenth kindergarten registration, should truthfully fill in the "approval form" and "kindergarten (class) registration form".
Eleventh after registration, the registration authority shall issue a * * provincial kindergarten (preschool) registration license to the kindergarten, and make an announcement in the municipal newspapers and periodicals in the autumn of that year;
Kindergarten registration license is divided into original and copy. The original is used for hanging in class places, and the copy is used for inspection and annual review. The original and the copy have the same legal effect. If the original or copy is lost for some reason, the kindergarten should immediately report to the issuing authority and report the loss and reissue it.
Twelfth kindergartens shall handle other relevant licenses, engrave official seals and open bank accounts with their registration certificates.
Thirteenth kindergarten registration license shall not be forged, altered, lent, mortgaged or transferred. Otherwise, the legal representative of the kindergarten shall bear all legal responsibilities for all consequences.
Fourteenth kindergarten name, articles of association, garden site, legal representative changes, should be reported to the registration authority, return the original certificate, go through the formalities of change registration.
Fifteenth kindergarten due to dissolution or other reasons to terminate the school, should go through the formalities of cancellation of registration at the original registration authority, and return the original certificate.
Kindergarten closure should be submitted to the director of the cancellation of registration application report, debt clearance documents.
Sixteenth kindergartens that fail to carry out education and teaching activities within six months or stop running schools for one year after receiving the registration license shall be deemed to have stopped running schools by themselves, and the registration authority has the right to cancel their qualifications for running schools.
Reorganization of kindergartens, personnel changes, relocation of kindergartens, etc. Re-apply for registration as required, and cancel and withdraw the original registration license.
Seventeenth kindergarten registration license is renewed every four years. The registration authority conducts annual evaluation and annual inspection of registered kindergartens. For kindergartens that failed the assessment in that year, the annual review was suspended; If the examination is still unqualified in the second year, the registration authority has the right to cancel its qualification for running the park. Kindergarten fails to participate in the annual inspection, the registration authority may cancel the kindergarten.
Eighteenth after the cancellation of the kindergarten, the registration authority shall withdraw the kindergarten registration license and official seal, and issue a cancellation decision.
Nineteenth kindergartens should take the initiative to submit * * kindergarten registration annual report, annual report statistics, annual financial statements. Submitted to the registry during the annual review.
Twentieth kindergartens in any of the following circumstances, according to the situation were given a warning, rectification, stop running the park administrative punishment.
(a) the kindergarten safety accident, not timely report, and improper handling;
(two) the contents and methods of education seriously violate the laws of early childhood education, and corporal punishment or corporal punishment in disguised form occurs from time to time, which seriously damages the physical and mental health of young children;
(3) concealing the real situation in the annual statistics and annual review, and practicing fraud, if the circumstances are serious;
(4) Forging, altering, lending, mortgaging or transferring the kindergarten registration license;
(five) major changes have taken place in the registered items, and the change registration has not been handled according to the regulations;
(six) in violation of the charging policy, not according to the provisions of the project and standard fees, arbitrary charges occur from time to time;
(seven) other acts in violation of laws, regulations and rules.
Twenty-first kindergarten in any of the following circumstances, as the year failed the examination:
(a) a kindergarten safety accident, but did not cause adverse effects;
(two) the registration authority has received many reports, and the implementation is true after investigation;
(3) Concealing the real situation and practicing fraud in the annual statistical statements;
(four) corporal punishment or corporal punishment of children in disguised form;
(five) in violation of the provisions of fees, financial management confusion, there is a phenomenon of arbitrary charges;
(6) Refusing the management of the registration authority without reason. Directors (legal representatives) are absent from important meetings for no reason at least twice a year; Delaying the completion of assigned work without reason, affecting the progress of work; Do not participate in any activities for no reason throughout the year;
(seven) other irregularities were found in the work inspection in that year, and the rectification was ineffective, and the circumstances were serious;
(eight) in violation of laws, regulations and rules of the park.
