The term "small food workshops" as mentioned in these Regulations refers to operators engaged in food production and processing activities with fixed production and processing sites, fewer employees, simple production conditions and processes, and small production and operation scale.
The term "food vendor" as mentioned in these Regulations refers to an operator who sells food without a fixed place of business or in a relatively fixed area or sells and sells food on the spot. Article 3 The people's governments at or above the county level shall lead, organize and coordinate the supervision and management of small food workshops and food vendors within their respective administrative areas, and implement the responsibility for food safety.
The departments of the people's governments at or above the county level that undertake the functions of food safety supervision and management (hereinafter referred to as food safety supervision departments) are responsible for the food safety supervision and management of food workshops and food vendors within their respective administrative areas.
The health, urban management, public security, education and other departments of the people's governments at or above the county level shall be responsible for the supervision, management and service of food workshops and food vendors within their respective administrative areas.
Township people's governments and sub-district offices shall assist the food safety supervision departments to do a good job in the food safety supervision and management of food workshops and food vendors within their respective administrative areas. Article 4 The people's governments at or above the county level shall make overall planning and rational layout, build or transform trading markets, blocks, shops and other fixed production and operation places suitable for the production and operation of small food workshops and food vendors, improve infrastructure and supporting facilities, improve the production and operation environment and raise the level of food safety.
The people's governments at or above the county level shall regulate the production and operation of small food workshops and food vendors, encourage and support them to improve their production and operation conditions and improve the level of food safety production and operation. Article 5 Small food workshops and food vendors shall engage in production and business operations according to law, abide by food safety standards and supervision and management systems, be honest and self-disciplined, accept social supervision, be responsible for the safety of their food production and business operations, and shall not produce and sell foods that endanger human health and life safety. Article 6 Small food workshops and food vendors are encouraged to form trade associations or join relevant food trade associations.
Food industry associations should strengthen industry self-discipline, guide and urge small food workshops and food vendors to produce and operate in good faith according to law, and publicize and popularize food safety knowledge. Seventh radio, television, newspapers, Internet and other media should carry out public welfare propaganda of food safety knowledge, report food safety information objectively and fairly, and strengthen public opinion supervision over food safety.
Encourage consumer associations and other social organizations, village (neighborhood) committees and schools to publicize food safety-related knowledge, advocate healthy eating styles, and enhance public awareness of food safety and self-protection ability. Article 8 Any organization or individual has the right to report illegal acts in the production and business activities of small food workshops and food vendors.
The food safety supervision department shall establish and improve the reward system for complaints and reports of small food workshops and food vendors, publish the telephone number, website and e-mail address of complaints and reports, and accept complaints and reports from the public. The department that accepts complaints and reports shall keep the complainant confidential. Chapter II Small Food Workshops Article 9 A licensing management system shall be implemented for small food workshops.
Small food workshops can only engage in food production and business activities after obtaining the License for Small Food Production and Processing Workshops (hereinafter referred to as the License for Small Food Workshops).
The license for a small food workshop shall specify the name of the small food workshop, the producer and operator, the production and processing place, the food varieties produced and operated, the license number, the validity period and other matters. Article 10 To apply for a license for a small food workshop, the following conditions shall be met:
(1) Having food raw material handling and food processing and storage places suitable for the variety and quantity of food produced and operated, and keeping a prescribed distance from toxic and harmful places and other pollution sources;
(2) Having facilities for food processing and preservation and sanitary protection facilities for waste disposal and storage that are suitable for the variety and quantity of food produced and operated;
(3) Having the technology and management system to ensure food safety;
(4) Other conditions stipulated by laws and regulations. Eleventh small food workshops shall, within 30 days from the date of obtaining the business license, apply to the food safety supervision department of the local people's government at the county level for the license of small food workshops, and submit the following materials:
(1) an application;
(2) A copy of the business license;
(3) A copy of the applicant's identity card;
(4) Health certificates of employees;
(5) List of technologies, food varieties, food raw materials and food additives for food production and operation;
(six) the certificate of the right to use the production and processing places;
(seven) management system to ensure food safety. Article 12 After accepting the application, the food safety supervision department of the people's government at the county level shall review the application materials, conduct on-site verification, and make a decision on whether to approve it within 15 working days from the date of acceptance. If the license is granted, a license for a small food workshop will be issued and announced to the public; If the license is not granted, it shall inform the applicant in writing and explain the reasons.
