Note: According to the Regulations of Tianjin Municipality on the Administration of Work Safety, which was adopted at the 10th meeting of the Standing Committee of the 14th Tianjin Municipal People's Congress on March 25th, 2004 and came into effect on May/KLOC-0, 2004, items (1) to (5) of Article 110 and item (11) of Article 19 in Chapters VI to XVIII of Chapter III.
Chapter I General Provisions
Article 1 In order to ensure the safety and health of workers, strengthen the management of labor protection and improve working conditions, these Regulations are formulated in accordance with the Labor Law of People's Republic of China (PRC) and relevant laws and regulations, combined with the actual situation of this Municipality.
Article 2 These Regulations shall apply to enterprises, individual economic organizations (hereinafter referred to as employers) and laborers within the administrative area of this Municipality.
Article 3 Labor protection must adhere to the principle of safety first and prevention first, and implement a management system of enterprise responsibility, industry management, state supervision and mass supervision.
Article 4 The municipal labor administrative department is in charge of labor protection in this Municipality.
The municipal public health administrative department, public security department, comprehensive economic management department, industry department, people's procuratorate and trade union shall be responsible for the implementation of these regulations according to their respective responsibilities.
Article 5 Employers and laborers shall abide by laws, regulations, rules, systems and standards related to labor protection.
Chapter II Obligations of Employers
Article 6 The employing unit must implement the labor protection laws and standards of the state and this Municipality, and the labor protection work shall be planned, arranged, inspected, summarized and evaluated simultaneously with the production and operation work.
Article 7 An employing unit shall, in accordance with the relevant provisions of the State and this Municipality, improve working conditions and provide a working environment to ensure the safety and health of workers. Workers engaged in operations with occupational hazards shall have regular health checks. Workers who are diagnosed with occupational diseases or engaged in the forbidden labor scope stipulated by the state and this Municipality shall be transferred from their posts in time.
Article 8 The employing unit shall establish and improve the responsibility system for production safety, the management system for labor protection, the safety technical operation rules for various types of work and other labor protection rules and regulations, and strictly implement them.
Article 9 The employing unit shall take labor protection as an important part of contracting and leasing, and conduct strict assessment.
Article 10 The employing unit shall establish and improve the labor protection education system, and educate laborers to abide by the labor protection rules and regulations.
The employing unit shall conduct safety and health education in factories, workshops and posts for newly hired workers before taking up their posts; Workers who change jobs and operate new equipment should be given post safety and health education again.
Eleventh the employer shall establish and improve the labor safety inspection system, carry out general inspection and professional inspection, and designate special personnel to inspect and monitor dangerous equipment and parts.
When the employing unit conducts labor safety inspection, it shall make a labor safety checklist in accordance with the relevant provisions and conduct inspection item by item according to the checklist. The hidden dangers identified should be registered item by item, and improvement measures should be formulated and rectified in time; For those that cannot be eliminated temporarily, reliable temporary safety measures should be taken.
Article 12 The legal representative of the employing unit shall be fully responsible for the labor protection work of the unit.
The employing unit shall set up labor protection institutions or designate corresponding departments to be equipped with labor protection technical management personnel to be responsible for supervising, inspecting and implementing the labor protection work of the unit.
Chapter III Workplaces
(This chapter has been abolished by the Regulations of Tianjin Municipality on the Administration of Work Safety 2004050 1)
Thirteenth workplaces should be kept clean, raw materials, semi-finished products and finished products must be packed firmly, waste materials and wastes should be removed in time, and tools should be stored in a fixed place.
Fourteenth factory (field) roads should be flat and smooth; Clear traffic signs and warning signs must be set at bends, intersections and dangerous work areas.
The erection of pipelines, lines and supports on the passage shall conform to the national standards.
Temporary bridges should be strong and equipped with handrails and anti-skid facilities.
Fixed steel straight ladders, inclined ladders and fixed industrial platforms shall meet the national standards.
The greening of the factory (field) area shall comply with the relevant provisions of safety production.
Fifteenth pits, mouths, ditches and pools needed for production must be covered or fenced. Guardrails should be set for pits and ditches excavated during construction, and warning lights should be set at night and in poor visibility weather.
Sixteenth buildings must be strong, the structure should comply with safety regulations. The load of stacked items shall not exceed the design load of the building.
It is forbidden to use the roof truss or roof beam which is not allowed by the design as the hanging beam frame.
Production houses shall comply with relevant national design codes, and it is forbidden to share or connect production and storage houses with residential houses.
Article 17. Drainage, anti-skid, anti-corrosion and anti-seepage facilities should be installed in workplaces where there is often water, grease or other liquids.
Eighteenth machines, workstations and other equipment and facilities layout should be convenient for workers to operate. The channel width shall not be less than1m. A fence should be set on the runway, and the height of the fence should not be less than1.05m.. Dangerous gaps in mechanical equipment or assembly lines should be closed with fences; When crossing due to work, a safety bridge should be erected.
Article 19 The light and local lighting in the workplace shall meet the design standards for daylighting and lighting.
Twentieth indoor workplace ventilation conditions must be good. When the indoor working temperature reaches the national high and low temperature operation standard, cooling or heating measures should be taken.
Twenty-first open-air workplaces should take protective measures such as sun protection, cold protection, rain protection, wind protection and lightning protection, and provide rest places for workers engaged in open-air operations for a long time.
Twenty-second overhead transmission lines, lifting machinery operation is prohibited; When lifting on one side, a specified safe distance must be kept; In other operations, measures should be taken to prevent electric shock.
Twenty-third when the gust is above six, no open air or lifting operations are allowed. If emergency repairs are needed due to faults, disasters or special production needs, corresponding safety measures must be taken.
Article 24 A safe distance must be demarcated, warning signs should be set up and special personnel should be assigned to guard the blasting operation site.
Twenty-fifth into holes, pits, pipelines, containers and cabins and other places with poor air, ventilation, exhaust, detection, special monitoring and other protective measures should be taken.
Chapter IV Special Labor Protection for Female Workers and Juvenile Workers
Article 26 The employing unit shall implement special labor protection for female workers and underage workers.
Twenty-seventh it is forbidden to arrange female workers to engage in underground mines, the fourth-level physical labor intensity stipulated by the state and other contraindications.
Twenty-eighth female workers shall not be arranged to engage in high-altitude, low-temperature, cold water and third-level physical labor intensity stipulated by the state during menstruation.
Twenty-ninth female workers shall not be arranged to engage in the third-level physical labor intensity stipulated by the state during pregnancy and lactation, or the labor that is forbidden during pregnancy and lactation.
Female employees who are pregnant for more than seven months and are breastfeeding may not be arranged to extend their working hours and work at night.
Pregnant female workers, during working hours, should be counted as working hours for prenatal examination according to regulations. ;
