Article 1 In order to protect citizens' personal health and safety, maintain social public order, protect city appearance and environmental sanitation, and strengthen the construction of socialist spiritual civilization, these Provisions are formulated in accordance with the relevant provisions of the state and combined with the actual situation of this Municipality.
Article 2 This Municipality implements the principle of strict control, strict management and combination of prohibition and restriction on raising dogs.
Article 3 The administrative areas of Haishu District, jiangdong district District and Jiangbei District of this Municipality are restricted dog-raising areas (hereinafter referred to as restricted dog-raising areas).
Rural areas outside Yongjiang Street in Jiangbei District and natural villages where farmers live in restricted areas are temporarily excluded from the scope of dog raising restrictions, and the specific areas are designated by the Municipal People's Government.
Restricted dog-raising areas in counties (cities), Yinzhou District, zhenhai district and Beilun District shall be designated by the county (city) and district people's governments and reported to the Municipal People's government for the record.
Article 4 The public security departments at all levels are the competent authorities to restrict dog raising, and are responsible for the registration and annual inspection of dogs in restricted areas, the handling of illegal dogs and the killing of rabies and wild dogs.
Animal husbandry and veterinary departments are responsible for the epidemic prevention and quarantine of dogs, the supply and inoculation of rabies vaccine for animals and the monitoring of rabies epidemic in dogs.
The person in charge of the health and epidemic prevention department is responsible for the supply and inoculation of rabies vaccine, diagnosis and treatment of rabies patients, epidemic monitoring and rabies prevention publicity.
Township (town) people's government, neighborhood offices, neighborhood (village) committees and residential property management organizations shall cooperate with relevant departments to do a good job in restricting dog raising.
Article 5 Units and individuals shall assist public security organs in implementing these Provisions, and have the right to stop or report violations of these Provisions to public security organs. The public security organ shall keep the informer confidential and reward him.
Article 6 Individuals are prohibited from keeping strong dogs and large dogs in restricted areas.
Individuals raising small ornamental dogs in restricted areas must meet the following conditions:
(1) Having a permanent or temporary residence in this Municipality;
(2) Having full capacity for civil conduct;
(3) There is a single room.
The size standard of small ornamental dogs allowed to be kept shall be determined and published by the Municipal Public Security Bureau.
Seventh individuals in the restricted area to raise small ornamental dogs, should obtain the consent of the local residents (village) committee, each household is limited to one. For those who meet the requirements of raising dogs, the neighborhood (village) committees shall issue certificates that meet the requirements of raising dogs.
Dog owners shall, within thirty days from the date of obtaining the certificate issued by the neighborhood (village) people's Committee that meets the requirements for raising dogs, apply to the local police station for dog registration.
After receiving the application for dog registration, the public security organ shall register those who meet the requirements for dog raising and issue a Dog Registration Certificate and a Dog License; Do not meet the conditions for raising dogs, it shall make a written decision and explain the reasons.
Article 8 If it is really necessary for medical scientific research units, professional performance groups and key security units in the restricted support area to raise dogs, they shall report to the higher authorities for approval, and the local police station shall sign their opinions and register after examination and approval by the district public security bureau.
If a large professional family of planting and breeding in the restricted area needs to raise a dog due to production, it shall be reported to the township (town) people's government for approval, signed by the local police station and registered after being audited by the district public security bureau.
The management of military dogs, police dogs and dogs kept in zoos shall be implemented in accordance with the relevant provisions of the state.
Article 9 Individuals and units registered to raise dogs shall take dogs to the local animal husbandry and veterinary department for quarantine, inject rabies vaccine free of charge, and receive the Dog Immunity Certificate and the Immunity Certificate.
Article 10 Individuals and units registered to raise dogs shall pay management service fees. Every dog goes to 600 yuan in the first year, and then to 300 yuan every year.
Eleventh registered dog individuals and units must comply with the following provisions:
(a) the dog neck should be hung with the dog license and immunization certificate issued by the public security organ and the animal husbandry and veterinary department;
(two) strong dogs and large dogs must be kept in captivity or in captivity;
(3) Small ornamental dogs must be tied up and led by adults when going out; Dogs are not allowed to defecate in corridors, public balconies and public green spaces; Dogs excrete feces outdoors, and dog owners should immediately remove them;
(four) dogs are not allowed to enter the market, shops, restaurants, schools, hospitals, stations, docks, airports, stadiums, parks, cultural and entertainment places and other public places;
(five) dogs are not allowed to take public transport;
(six) raising a dog shall not interfere with the normal life of others;
(7) If the dog is put out for adoption, slaughtered, died or lost, the dog breeder shall go through the formalities of cancellation or change of registration with the original license issuing and licensing department within seven days, and return the certificate and dog-raising license;
(eight) when the dog owner moves his address, he must go through the registration formalities with the public security organ;
(nine) regularly to the local animal husbandry and veterinary departments for quarantine and immunization of dogs;
(ten) shall not be lent, fraudulently used, altered, forged and trading dog license.
The Dog Registration Certificate shall be examined once a year, and the dog owner shall produce the Dog Registration Certificate and the Dog Immunization Certificate during the annual inspection. The time, place and requirements for the annual inspection of the dog registration certificate shall be announced by the public security organ.
Twelfth registered dogs produce puppies, the dog owner shall, within 30 days from the date of birth of the puppies, dispose of them or send them to the local police station; If you need to change puppies, you need to go through the registration formalities at the original registration authority.
Thirteenth dogs carried by foreigners must have valid rabies quarantine and immunization certificates issued by animal husbandry and veterinary departments at or above the county level before they are allowed to enter this city.
Dogs brought into this city from abroad shall abide by the relevant provisions of the Law of People's Republic of China (PRC) on Entry-Exit Animal and Plant Quarantine.
Dogs imported from other places or abroad that have been kept in the restricted areas of this Municipality for more than one month shall go through the registration formalities in accordance with these regulations.
Article 14 Anyone who engages in dog breeding, sales and exhibition activities shall do a good job in immunization and prevention of animal diseases in accordance with the relevant provisions of the state, handle industrial and commercial registration according to law, and file with the animal husbandry and veterinary department and the public security organ.
Engaged in dog diagnosis and treatment activities, it shall obtain the animal diagnosis and treatment license issued by the animal husbandry and veterinary department according to law, handle the industrial and commercial registration, and file with the public security organ.
Article 15 If a dog is not kept in violation of the provisions of Article 6, Article 7, Article 8 and Article 9, the dog shall be confiscated, and a fine of not less than 1,000 yuan but not more than 10,000 yuan shall be imposed on the unit, and a fine of not less than 500 yuan but not more than 5,000 yuan shall be imposed on the individual.
Sixteenth in violation of the provisions of the provisions of article eleventh, shall be ordered to stop the illegal act, and may impose a fine of fifty yuan to one thousand yuan; If the circumstances are serious, the dog shall be confiscated and the dog registration certificate shall be revoked.
If a dog is brought into a public place in violation of regulations, the management personnel of the public place can detain the dog first and then report it to the public security organ for handling.
Seventeenth in violation of the provisions of Article 12, Article 13, paragraph 1 and paragraph 3 of this Ordinance, dogs can be confiscated, and a fine of 500 yuan to 3000 yuan can be imposed.
Eighteenth in violation of the provisions of the provisions of article fourteenth, engaged in dog breeding, sales, diagnosis and treatment, exhibition and other activities, by the administrative department for Industry and commerce or animal husbandry and veterinary departments according to law.
Nineteenth dogs hurt others, dog owners or managers should immediately send the injured to medical institutions for treatment, and bear all the medical expenses of the victims and compensate other losses; If a dog injures a person and the circumstances are serious enough to constitute a crime, criminal responsibility shall be investigated according to law.
The injured dog shall be immediately sent to the animal husbandry and veterinary department for quarantine.
Article 20 If the staff of public security organs and other relevant departments neglect their duties, abuse their powers or engage in malpractices for selfish ends in dog management, they shall be given administrative sanctions by their units or the competent department at a higher level; If a crime is constituted, criminal responsibility shall be investigated according to law.
Article 21 These Provisions shall come into force on June 1998 65438+ 10/day.
