Regulations of Zhejiang Province on Medical Security

Chapter I General Provisions Article 1 In order to protect citizens' basic medical needs, establish and improve a high-quality modern medical security system, and promote the construction of healthy Zhejiang, these Regulations are formulated in accordance with the Social Insurance Law of People's Republic of China (PRC), the Basic Medical and Health Promotion Law of People's Republic of China (PRC) and other relevant laws and administrative regulations, combined with the actual situation of this province. Article 2 These Regulations shall apply to the construction of medical security system, the collection and deposit of medical security funds, medical security benefits, medical security handling services and their supervision and management within the administrative area of this province. Article 3 Medical insurance adheres to the principles of universal coverage, overall planning of urban and rural areas, clear rights and responsibilities, moderate security and sustainability, and follows the principles of matching the level of security with the level of economic and social development, corresponding rights and obligations, and combining fairness and efficiency, and promotes the coordinated reform of medical insurance, medical care and medicine as a whole. Article 4 People's governments at or above the county level shall strengthen their leadership over medical security, incorporate medical security into the national economic and social development plan, establish and improve the coordination mechanism and target assessment mechanism of medical security, incorporate the funds needed for medical security into the fiscal budget, and strengthen the construction of medical security talents.

People's governments at all levels should strengthen the connection and cooperation between medical security and basic public health services in disease prevention, diagnosis, treatment, nursing and rehabilitation, and promote the development of medical and health undertakings. Article 5 The competent department of medical security of the people's government at or above the county level shall be responsible for the management of medical security within its administrative area, and its affiliated medical security institutions shall undertake specific affairs related to medical security in accordance with the prescribed responsibilities.

Health, drug supervision and management, finance, civil affairs, human resources and social security, taxation and other departments shall do a good job in medical security according to their respective responsibilities.

Township people's governments and sub-district offices shall do a good job in medical security in accordance with the provisions of the people's governments at higher levels.

The village (neighborhood) committee shall assist in the work related to medical security. Sixth citizens have the right and obligation to participate in the basic medical insurance according to law, to participate in insurance and pay fees according to law, and to enjoy the corresponding medical security benefits according to the insurance situation.

Citizens should establish and practice the concept of health management responsible for their own health, actively learn health knowledge, improve health literacy and strengthen health management. Article 7 The Provincial Department of Medical Security shall establish a unified, efficient, compatible, convenient and safe medical security digital platform in the whole province, rely on the provincial public data platform, promote information sharing and application between relevant departments and regions, strengthen the intelligent and integrated digital medical security construction, promote medical security cooperation in the Yangtze River Delta, and enhance the governance capacity of medical security. Chapter II Medical Security System Article 8 This province has established and improved a multi-level medical security system with basic medical insurance as the main body, serious illness insurance as the extension, medical assistance as the basis, commercial health insurance, mutual medical care for employees and medical charity services as the supplement. Article 9 The expenses paid by the basic medical insurance fund of the insured shall be guaranteed according to the prescribed standards.

Basic medical insurance includes basic medical insurance for employees and basic medical insurance for urban and rural residents. Tenth state organs, enterprises and institutions, social organizations, social service institutions, individual industrial and commercial households with employees and other employers and their employees shall participate in the basic medical insurance for employees.

Individual industrial and commercial households without employees, part-time employees who have not participated in the basic medical insurance for employees and other flexible employees (hereinafter referred to as flexible employees) may choose to participate in the basic medical insurance for employees or the basic medical insurance for urban and rural residents.

Persons who have participated in the basic medical insurance for employees or enjoyed other medical security benefits shall participate in the basic medical insurance for urban and rural residents in accordance with the regulations. The scope and methods of medical assistance shall be implemented in accordance with the relevant laws and regulations on social assistance and medical security. Article 13 Encourage the development of commercial health insurance, guide commercial insurance companies to establish commercial health insurance for all participants in basic medical insurance, without setting preconditions such as health status and past medical history, and decouple the premium from personal disease risk, so as to provide supplementary protection for medical expenses other than basic medical insurance and serious illness insurance for the participants.

Employees who participate in basic medical insurance can use the balance of personal accounts over the years to pay commercial health insurance premiums; Encourage employers to purchase commercial health insurance for employees in accordance with regulations. Fourteenth steadily promote a unified long-term care insurance system covering employees and urban and rural residents, and guarantee the necessary nursing expenses incurred by insured persons with a certain degree of disability according to the prescribed standards.

Provincial medical security departments should strengthen the regulation and guidance of long-term care insurance. Fifteenth support the orderly development of medical assistance for employees.
