Land users engaged in land development and utilization activities, enterprises, institutions and other producers and operators engaged in production and business activities shall take effective measures to prevent and reduce soil pollution, and shall be responsible for the soil pollution caused by it according to law. Article 5 The local people's governments at or above the county level shall strengthen their leadership in the prevention and control of soil pollution, and organize, coordinate and urge the relevant departments to perform their duties of supervision and management in the prevention and control of soil pollution according to law. Establish and improve the coordination mechanism of soil pollution prevention and control, and study, coordinate and solve major problems and issues in soil pollution prevention and control. The prevention and control of soil pollution across administrative regions shall be settled by the relevant people's governments through consultation; If negotiation fails, it shall be settled by the people's government at the next higher level.
Township people's governments and sub-district offices shall, in accordance with the provisions of laws and regulations and the entrustment of relevant departments of the people's governments at higher levels, carry out relevant work on the prevention and control of soil pollution.
Villagers' committees and residents' committees shall assist in the prevention and control of soil pollution. Article 6 The competent department of ecological environment shall exercise unified supervision and management over the prevention and control of soil pollution within their respective administrative areas.
The competent departments of agriculture, rural areas and forestry shall supervise and manage the prevention and control of soil pollution such as cultivated land and forest land according to their respective responsibilities.
The competent departments of natural resources and ecological environment shall supervise and manage the prevention and control of soil pollution in the process of land development and utilization according to their respective responsibilities.
The competent department of housing and urban construction shall supervise and manage the prevention and control of soil pollution during the treatment and disposal of domestic garbage and domestic sewage.
The competent departments of development and reform, industry and information technology, transportation, water conservancy, health, market supervision and emergency response shall do a good job in the prevention and control of soil pollution within their respective functions and duties.
The departments specified in the first to fourth paragraphs of this article are hereinafter collectively referred to as the departments responsible for the supervision and management of soil pollution prevention and control. Article 7 Local people's governments at various levels shall be responsible for the prevention and control of soil pollution and the safe utilization within their respective administrative areas.
This province implements the target responsibility system and evaluation system for the prevention and control of soil pollution, and takes the completion of the target for the prevention and control of soil pollution as the content of the evaluation of the local people's governments at all levels and their responsible persons, the departments responsible for the supervision and management of soil pollution prevention and control and their responsible persons. Article 8 Support the research and development, achievement transformation and popularization and application of pollution prevention science and technology such as soil pollution risk control, remediation and monitoring, strengthen the training of professional and technical personnel for soil pollution prevention and control, and promote the scientific and technological progress of soil pollution prevention and control. Ninth with the Yangtze River Delta and other adjacent areas to establish a linkage mechanism for soil pollution prevention and control, to carry out cooperation in the fields of soil pollution prevention and control, risk management and restoration, law enforcement and emergency response. Article 10 Local people's governments at all levels, relevant departments, neighborhood offices, villagers' committees, residents' committees and news media shall strengthen publicity, education and scientific popularization of soil pollution prevention and control, enhance public awareness of soil pollution prevention and control, and guide the public to participate in soil pollution prevention and control according to law. Chapter II Planning and Prevention Article 11 Local people's governments at or above the county level shall incorporate the prevention and control of soil pollution into their national economic and social development plans and ecological environment protection plans.
The competent department of ecological environment of a province or a city divided into districts shall, jointly with the competent departments of development and reform, natural resources, urban and rural housing construction, transportation, water conservancy, agriculture and rural areas, forestry, etc. According to the requirements of ecological environment protection planning, land use, soil pollution investigation, detailed investigation and monitoring results, the prevention and control plan of soil pollution is formulated. , reported to the people's government at the same level for approval before promulgation and implementation.
The people's governments at the county level shall organize the relevant departments to formulate the work plan for the prevention and control of soil pollution in their respective administrative areas according to the plan for the prevention and control of soil pollution, and promulgate and implement it. The work plan shall include the requirements for the prevention and control of soil pollution in chemical parks and industrial parks involving heavy metal emissions, and the main contents such as the safe use of polluted cultivated land and key construction land.
The key construction land mentioned in the preceding paragraph refers to the land whose use has been changed to residential, public management and public service land. Twelfth local people's governments at or above the county level shall, according to the carrying capacity of ecological environment and the quality of soil environment, scientifically determine the regional functional orientation and rationally plan the industrial layout and spatial layout.
In the preparation of national spatial planning, the requirements for prevention and control of soil pollution should be implemented, the risk of soil pollution should be fully considered, and the land use should be reasonably determined. Strictly control non-ferrous metal mining, non-ferrous metal smelting, oil mining, petroleum processing, chemical industry, coking, electroplating, tanning, pesticide, lead storage battery, steel and hazardous waste utilization and disposal (hereinafter referred to as key industries for soil pollution prevention and control) to use land plots with serious soil pollution. It should not be planned as residential areas, schools, kindergartens, hospitals, nursing homes and sanatoriums, but can be used to expand ecological space.
Local people's governments at or above the county level shall, in accordance with the relevant provisions of the state and the province, organize relevant departments to promote the "one map" management of land and space planning. The competent department of ecological environment shall share data and information related to soil pollution with the competent department of natural resources.
