Chapter II Acquisition of Donated Organs
Article 4 The acquisition of donated organs shall be carried out after the death of the donor.
Article 5 Provincial health (health and family planning) administrative departments must, under the unified leadership of the National Health and Family Planning Commission, set up one or more human organ acquisition organizations composed of human organ transplant surgeons, neurosurgeons, doctors in critical care medicine and nurses.
The acquisition of donated organs must be carried out by OPO according to the classification standard of organ donation for cardiac death in China. The relevant management norms of OPO shall be formulated separately by the National Health and Family Planning Commission.
Article 6 OPO shall perform the following duties:
(1) Making relevant medical evaluation on potential blood donors within its service scope;
(two) in accordance with the provisions of the "Regulations on Human Organ Transplantation", and the donor or his spouse, adult children, parents (hereinafter referred to as close relatives) signed the informed consent of human organ donation and other legal documents of human organ donation;
(3) Maintaining the function of organ donation;
(four) the clinical data and legal documents of potential donors, donors and their donated organs are input into the computer system of human organ distribution and enjoyment in China (hereinafter referred to as the organ distribution system);
(five) the use of organ distribution system to start the automatic distribution of donated organs;
(6) Obtaining, preserving and transporting the donated organs, and confirming the handover of the donated organs with the hospital (hereinafter referred to as the transplant hospital) where the human organ transplant waiting person who obtained the organs (hereinafter referred to as the waiting person) is located;
(seven) in accordance with the ethical principles of medical treatment of the donor's body, and participate in the memory and condolences;
(eight) to protect the personal information of donors, recipients and recipients, and to protect their legitimate rights and interests;
(nine) to organize the relevant medical personnel of medical institutions within the scope of their services to participate in professional training, assist the administrative department of health (health and family planning) to regularly train and assess the coordinator of human organ donation, and carry out academic exchanges and scientific research;
(ten) to provide the public with the popularization, education and publicity of human organ donation knowledge.
Article 7 OPO must establish a team of human organ donation coordinators with special skills and qualifications, formulate medical standards for identifying and screening potential donors, establish standard technical specifications for obtaining human donated organs, and equip professionals and equipment to ensure the quality of organ acquisition.
Article 8 A coordinator of human organ donation shall meet one of the following conditions:
(1) A medical practitioner with a bachelor's degree or above in medical major in an institution of higher learning, a valid medical practitioner's certificate in People's Republic of China (PRC) and China, more than two years' clinical work experience and medical work in a medical institution;
(2) A registered nurse with a college degree or above in nursing, a valid Nurse Practice Certificate in People's Republic of China (PRC), more than two years of clinical nursing experience and clinical nursing activities in medical institutions.
Article 9 A coordinator of human organ donation shall perform the following duties:
(a) to provide professional education and training on human organ donation to relevant medical personnel of medical institutions within the service scope;
(2) Seek and determine potential donors, collect clinical information, and assist medical experts in OPO to make relevant medical evaluation;
(3) Explain the laws, regulations, policies and donation procedures of human organ donation to donors and their close relatives, and sign the informed consent form of human organ donation and other relevant legal documents with donors or their close relatives on behalf of OPO;
(four) to help maintain the function of donated organs;
(5) Organizing and coordinating the work arrangements for the acquisition and transportation of donated organs, witnessing the whole process of acquiring donated organs, and verifying and recording the types and quantities of human organs acquired;
(six) within 7 days after the completion of human organ donation, notify the donor's close relatives of the donation results.

Provisions on the Administration of the Acquisition and Distribution of Human Donated Organs (for Trial Implementation)
Article 21 The provincial health (health and family planning) administrative department must promptly publish the list of medical institutions, OPO list and service scope of registered human organ transplant diagnosis and treatment subjects, as well as the list of qualified human organ donation coordinators and their contact information.
Article 22 In case of any of the following circumstances in violation of these Regulations, in accordance with the provisions of the Law of People's Republic of China (PRC) on Medical Practitioners, the Regulations on the Administration of Medical Institutions, the Regulations on Human Organ Transplantation and other laws and regulations,
By the health (health and family planning) administrative departments at or above the county level shall be dealt with according to law. Suspected to constitute a crime, in accordance with the provisions of the Criminal Law Amendment (VIII), the Regulations on Human Organ Transplantation and other laws and regulations, transferred to the public security organs and judicial departments for investigation:
(1) Failing to make a death judgment in strict accordance with the death judgment procedure;
(2) Obtaining a citizen's corpse organ against his wishes before his death, or obtaining his corpse organ against the wishes of his close relatives without his consent before his death;
(3) failing to distribute donated organs through the organ distribution system;
(four) the organ distribution results have not been implemented;
(5) Forging medical data to defraud organ donation;
(6) OPO obtains donated organs outside the service scope;
(7) Medical institutions and their medical staff introduce potential donors to designated institutions, organizations and individuals other than OPO;
(eight) suspected of buying and selling donated organs or engaging in activities related to buying and selling donated organs;
(nine) other acts in violation of the provisions of this management.
