Article 9 Newly-built pharmaceutical production enterprises shall be approved by the pharmaceutical administrations (head offices) of provinces, autonomous regions and municipalities directly under the Central Government before they can be started. Upon completion, it will be inspected and accepted in accordance with the requirements of the Drug Administration Law. Those who pass the examination shall be issued a certificate of pharmaceutical production enterprise, and the enterprise shall apply to the administrative department of health for a license of pharmaceutical production enterprise and to the administrative department for industry and commerce for a business license.
It is legal to sell your own food, but you must obtain a business license, permit or record certificate. Drugs must be produced in accordance with the national drug standards and the production process approved by the drug supervision and administration department of the State Council, and the production records must be complete and accurate. Drug production enterprises must report to the original approval department for examination and approval if they change the production process that affects the quality of drugs.
Definition of self-service pharmacy
According to the fourth chapter of the Drug Administration Law of People's Republic of China (PRC) (hereinafter referred to as the Drug Administration Law), drugs prepared by medical institutions according to clinical needs, which are not available in the market, belong to "self-use drugs prepared by medical institutions".
Legal basis: Article 34 of the Food Safety Law of People's Republic of China (PRC) has obtained food production license, food circulation license and catering service license according to law. Among them, individual farmers sell their own edible agricultural products without obtaining food circulation permission. Sellers who make their own food and sell it online are both food producers and operators. The seller shall provide food production license, food hygiene license, health certificate, business license, product certificate and other documents. If the above documents are not available, this kind of homemade food is the "three no products" illegally sold, and the seller does not have the relevant production and sales qualifications.
