Article 4 Implementation Rules for Certification of Food Safety Management System
The certification body shall require the certification client to meet the following conditions:
(1) Obtain the legal person qualification (or its component) registered by the national and local market supervision and management departments or relevant institutions;
(2) Having obtained the administrative license prescribed by relevant laws and regulations (if applicable);
(3) It is not included in the list of serious violations of law and dishonesty;
(4) The products produced, processed and operated or the services provided meet the requirements of relevant laws, regulations, standards and norms;
(five) to establish and implement a food safety management system in accordance with the certification basis stipulated in these rules, and to operate effectively for more than 3 months;
(6) There is no food safety accident that violates relevant laws and regulations within one year;
(seven) within three years, the certification certificate has not been revoked by the certification body because of food safety accidents, violation of national laws and regulations on food safety management, or falsehood or concealment of the information needed to obtain the certificate.
