Measures for the administration of health examination of catering service professionals in Handan City

Article 1 In order to regulate the health examination management of catering service employees in this Municipality, these Measures are formulated in accordance with the provisions of the Food Safety Law of People's Republic of China (PRC) and its implementing regulations, the Measures for the Supervision and Administration of Food Safety in Catering Services and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the health examination of employees in the catering service industry within the administrative area of this Municipality. Article 3 The municipal food and drug supervision and administration department is responsible for the supervision and guidance of the health examination of employees in the catering service industry in the whole city, and is specifically responsible for the health examination of employees in the catering service industry in congtai district, Hanshan District, Fuxing District, Jinan New District and Handan Economic Development Zone.

Other counties (cities, districts) food and drug supervision and management departments are responsible for the supervision and management of the health examination of employees in the catering service industry within their respective administrative areas. Article 4 A medical and health institution applying for health examination of catering service employees shall meet the following conditions:

(1) Having the Practice License of Medical Institution that includes health examination items or having the qualification of preventive health examination;

(2) Having the qualification of a legal person and being able to bear civil liability independently;

(3) Having inspection, laboratory tests, facilities, equipment and sanitary conditions suitable for health examination;

(4) Having an attending physician, a competent technician or a professional technician with corresponding titles;

(5) Having a sound health examination system;

(six) the configuration of digital photography and printing equipment, to apply for health examination personnel's proof head on-site collection and printing;

(seven) other conditions stipulated by the food and drug supervision department. Article 5 An institution that meets the requirements for health examination shall apply to the local food and drug supervision and administration department, which shall strictly examine the application and determine it according to the principle of reasonable layout and convenient inspection.

The county-level food and drug supervision and administration department shall, within fifteen days after determining the inspection institution, file with the municipal food and drug supervision and administration department. The municipal food and drug supervision and administration department regularly announces to the public the list of medical and health institutions that undertake the health examination of catering service employees. Article 6 Health inspection institutions shall abide by the following provisions:

(1) Conduct inspection according to the specified inspection items, issue true inspection results, and inform the health inspector of the unit and the local food and drug supervision and administration department of the inspection results in writing within 10 days;

(two) the use of food and drug supervision and management departments unified supervision of the "food and beverage service practitioners health checklist";

(three) to collect health examination fees according to the charging standards stipulated by the price department;

(four) accept and cooperate with the supervision and inspection of the food and drug supervision and administration department;

(five) other matters stipulated by laws, regulations and rules. Article 7 Employees engaged in catering services shall have an annual health examination and obtain the Health Certificate of Catering Service Employees in Handan City.

The person in charge of the catering service unit, food safety management personnel, chefs and auxiliary personnel, waiters, buyers, decontamination personnel, warehousing personnel and other post personnel shall undergo health examination.

Catering service providers shall, in accordance with the provisions of Article 34 of the Food Safety Law of People's Republic of China (PRC), establish and implement a health management system for employees and establish health records for employees. Eighth city and county food and drug supervision and management departments shall establish a health certificate management information platform to provide inquiry services for catering service supervision departments and catering service providers.

Food and drug supervision and management departments, health inspection institutions and catering service enterprises shall take confidential measures for information related to health inspection. Article 9 The health examination of employees shall be conducted in accordance with the following items:

(1) previous medical history;

(2) palpation of liver and spleen;

(3) skin examination;

(4) chest fluoroscopy;

(5) Examination of dysentery and typhoid fever;

(six) clinically suspected or with a history of other intestinal infectious diseases within one year, and it is necessary to do corresponding laboratory tests;

(7) liver function examination. If alanine aminotransferase is abnormal, HAV-IgM (hepatitis A) and HEV-IgM (hepatitis E) should be checked. Tenth catering service employees to conduct a health examination every year. In case of public health emergencies and other special circumstances, the municipal food and drug supervision and management department may appropriately increase the frequency of health examination. Eleventh employees who fail to pass the health examination, catering service enterprises should adjust them to other jobs that do not affect the safety of catering food.

Persons suffering from infectious diseases of digestive tract such as dysentery, typhoid fever, viral hepatitis A and viral hepatitis E, and diseases that hinder food safety such as active tuberculosis, suppurative or exudative dermatosis shall not engage in direct contact with food. Twelfth catering service practitioners suffering from the diseases listed in the second paragraph of Article 11 of these measures, and need to resume direct contact with food after being cured, they shall apply for a new health certificate. Thirteenth health inspectors have objections to the health examination results, they can apply to the original health examination institution for re-examination within 7 days from the date of receiving the health examination results. The institution that originally undertook the health examination shall accept it in time and make a re-inspection conclusion within 15 days.
