Chapter I General Provisions Article 1 In order to strengthen the management of safety production training, standardize the order of safety production training, ensure the quality of safety production training and promote the healthy development of safety production training, these measures are formulated in accordance with the provisions of the Safety Production Law and relevant laws and administrative regulations. Article 2 These Measures shall apply to safety training institutions, production and business units engaged in safety training (hereinafter referred to as safety training), and supervision and management of safety training by safety production supervision and management departments and coal mine safety supervision institutions. Where laws, administrative regulations and the State Council have other provisions, those provisions shall prevail. Article 3 The term "safety training" as mentioned in these Measures refers to education and training activities aimed at improving the safety quality of safety supervisors, employees of production and business units and personnel engaged in safety production. The safety supervisors mentioned in the preceding paragraph refer to the safety production supervisors and coal mine safety supervisors engaged in safety supervision and administrative law enforcement sent by the safety production supervision and management departments of the people's governments at or above the county level and coal mine safety supervision institutions at all levels; Employees of production and business operation entities refer to the principal responsible persons, safety production management personnel, special operators and other employees of production and business operation entities; Relevant personnel engaged in safety production refer to teachers engaged in safety education and training, registered personnel of hazardous chemicals, personnel undertaking safety evaluation, consultation, testing and inspection, and registered safety engineers. Article 4 The principles of unified planning, centralized management, graded implementation, classified guidance and separation of teaching and examination shall be applied to safety training. State administration of work safety (State Administration of Coal Mine Safety) (hereinafter referred to as the State Administration of Work Safety) guides the national safety training, and supervises and manages the national safety training according to law. The safety production supervision and management departments of provinces, autonomous regions and municipalities directly under the Central Government shall supervise and manage the safety training within their respective administrative areas according to law. Provinces, autonomous regions and municipalities directly under the central government that have established coal mine safety supervision institutions shall supervise and manage the safety training of coal mine enterprises within their respective jurisdictions according to law. Chapter II Safety Training Institutions Article 5 Safety training institutions must obtain corresponding qualification certificates when engaging in safety training activities. The qualification certificate is divided into four grades. The first-class and second-class qualification certificates are approved and issued by the State Council; Grade III and IV qualification certificates shall be approved and issued by the safety production supervision and management departments of provinces, autonomous regions and municipalities directly under the Central Government. The provinces, autonomous regions and municipalities directly under the Central Government that set up coal mine safety supervision institutions are responsible for approving and issuing the third-and fourth-level qualification certificates of training institutions engaged in coal mine safety training activities within their respective jurisdictions. Article 6 The safety training institutions that have obtained the first-class qualification certificate may be the safety production inspectors and coal mine safety inspectors of the safety production supervision and management departments and coal mine safety supervision institutions at or above the provincial level; The main person in charge and safety management personnel of the production and business operation units of the central enterprise corporation, general factory or group company; Registration personnel of hazardous chemicals; Personnel who undertake safety evaluation, consultation, testing and inspection; Training of registered safety engineers and teachers in safety training institutions below the first level. The safety training institution that has obtained the two-level qualification certificate can undertake the work of safety production inspectors of the municipal and county-level safety production supervision and management departments; The main persons in charge and safety production management personnel of provincial production and business units, branches and subsidiaries of central enterprises and their subordinate units; Registration personnel of hazardous chemicals; Personnel who undertake safety evaluation, consultation, testing and inspection; Training for registered safety engineers and teachers in safety training institutions below Grade II. The safety training institution that has obtained the three-level qualification certificate can undertake special operations personnel; The city (prefecture) is the training ground for the main person in charge of the production and business operation entity and the safety production management personnel. A safety training institution that has obtained a four-level qualification certificate may undertake the training of employees of production and business units other than the first, second and third paragraphs of this article. A safety training institution at the next higher level may undertake the training of a safety training institution at the next lower level. Article 7 To apply for a first-class qualification certificate, a safety training institution shall meet the following conditions: (1) The registered capital or start-up expenses shall be more than 6,543,800 yuan; (2) Having full-time management personnel; (3) Having a sound constitution, management system and working system; (4) Full-time or part-time teachers with bachelor degree or above 15 or more, including at least 8 full-time teachers with associate senior titles or above who have passed the training and examination of the National Bureau; (5) Having fixed, independent and relatively centralized teaching and living facilities that can meet the training needs of more than 0/00 people in the same period, of which the use area of special classrooms is more than 0/50 square meters; (six) other conditions required for safety training. Article 8 To apply for a second-level qualification certificate, a safety training institution shall meet the following conditions: (1) The registered capital or start-up cost is more than 800,000 yuan; (2) Having full-time management personnel; (3) Having a sound constitution, management system and working system; (4) There are more than 10 full-time or part-time teachers with bachelor degree or above, and at least 5 full-time teachers with intermediate titles or above have passed the training and assessment of the National Bureau; (5) There are fixed, independent and relatively centralized teaching and living facilities that can meet the training needs of more than 80 people in the same period, in which the use area of special classrooms is greater than 1.20 square meters; (six) other conditions required for safety training. Article 9 A safety training institution applying for a three-level qualification certificate shall meet the following conditions: (1) Its registered capital or start-up cost is more than 500,000 yuan; (2) Having full-time or part-time management personnel; (3) Having a sound constitution, management system and working system; (4) Having more than 8 full-time or part-time teachers with bachelor degree or above, of which at least 5 full-time teachers with intermediate titles or above have passed the training and examination by the safety production supervision and management departments of provinces, autonomous regions and municipalities directly under the Central Government or provincial coal mine safety supervision institutions; (5) Having teaching and living facilities that can meet the training needs of more than 50 people in the same period, of which the use area of special classrooms is more than 100 square meter; (six) other conditions required for safety training. Article 10 A safety training institution applying for a Grade-4 qualification certificate shall meet the following conditions: (1) Its registered capital or start-up cost is more than 300,000 yuan; (2) Having full-time or part-time management personnel; (3) Having a sound constitution, management system and working system; (4) Having more than five full-time or part-time teachers with bachelor degree or above, of which at least three full-time teachers with intermediate titles or above have passed the training and examination by the safety production supervision and management departments of provinces, autonomous regions and municipalities directly under the Central Government or provincial coal mine safety supervision institutions; (five) teaching and living facilities that can meet the training needs of more than 30 people in the same period, of which the use area of special classrooms is more than 60 square meters. Article 11 The application for the first-class and second-class qualification certificates shall be handled according to the following procedures: (1) The qualification applicant shall submit an application for the qualification of the safety training institution, the approval document for the establishment of the safety training institution or the registration certificate of enterprises and institutions as a legal person and the materials specified in Articles 7 and 8 of these Measures to the General Administration; (two) the State Council shall complete the examination within 20 days from the date of accepting the application. Meet the conditions, issue the corresponding qualification certificate; Do not meet the conditions, notify the applicant in writing and explain the reasons. (1) The applicant for qualification shall submit an application for the qualification of safety training institutions, the approval document for the establishment of safety training institutions or the Registration Certificate of Enterprises and Institutions as a Legal Person and the materials specified in Articles 9 and 10 of these Measures to the safety production supervision and management departments of provinces, autonomous regions and municipalities directly under the Central Government or the provincial coal mine safety supervision institutions; (2) The safety production supervision and management departments of provinces, autonomous regions and municipalities directly under the Central Government or provincial coal mine safety supervision institutions shall complete the examination within 20 days from the date of accepting the application. Meet the conditions, issue the corresponding qualification certificate, and report to the State Bureau for the record; Do not meet the conditions, notify the applicant in writing and explain the reasons. Thirteenth teachers of safety training institutions should receive special training, and only after passing the examination can they teach at their posts. Fourteenth safety training institutions qualification certificate shall not be lent or leased to other institutions or individuals. The validity period of the qualification certificate of the safety training institution is 3 years. If the expiration of the qualification certificate of the safety training institution needs to be extended, the extension formalities shall be handled within 30 days before the expiration of the qualification certificate of the safety training institution. Fifteenth safety training institutions and their teachers shall be assessed and certified, and no fees shall be charged. Chapter III Safety Training Article 16 Safety training shall be conducted in accordance with the safety training outline formulated by the State Bureau and the provincial safety production supervision and management departments. The safety training plan for safety supervisors, principals of dangerous goods production, management and storage units and mining enterprises, safety production management personnel and special operations personnel, and relevant personnel engaged in safety production work shall be formulated by the State Administration. The safety training plan for the main person in charge, safety production management personnel and other employees of dangerous goods production, management and storage units and production and business units other than mining enterprises shall be organized and formulated by the provincial safety production supervision and management department. Seventeenth national bureau, provincial safety production supervision and management departments organize an excellent textbook selection every two years. Safety training institutions should give priority to the use of excellent teaching materials. Article 18 The State Bureau is responsible for the training of safety inspectors of the safety production supervision and management departments at or above the provincial level and coal mine safety inspectors of coal mine safety supervision institutions at all levels; Organize, guide and supervise the training of the principal responsible persons and safety management personnel of the production and business operation units of the central enterprise corporation, general factory and group company. The provincial safety production supervision and management department is responsible for the training of safety production inspectors in the city and county safety production supervision and management departments; Organize, guide and supervise the training of provincial production and business units, branches and subsidiaries of central enterprises and their subordinate units; Organize, guide and supervise the training of special operators. City and county safety production supervision and management departments shall organize, guide and supervise the training of the main persons in charge and safety production management personnel of other production and business operation entities except central enterprises and provincial production and business operation entities within their respective administrative areas. Provincial coal mine safety supervision institutions shall organize, guide and supervise the training of the main persons in charge, safety production management personnel and special operations personnel of coal mining enterprises within their respective jurisdictions. Safety training for hazardous chemicals registrants, personnel undertaking safety evaluation, consultation, testing and inspection, and registered safety engineers shall be implemented in accordance with the provisions of relevant laws, regulations and rules. In addition to the main person in charge, safety production management personnel and special operations personnel, the safety training of employees in production and business units shall be undertaken by the production and business units. Nineteenth production and business units should carry out safety education and training for employees corresponding to their posts; Employees who adjust their jobs or adopt new processes, technologies, equipment and materials should receive special safety education and training. Employees without safety education and training are not allowed to work at their posts. Twentieth safety training institutions engaged in safety training fees shall comply with the provisions of laws and regulations. If there are no provisions in laws and regulations, fees shall be charged according to industry self-discipline standards or guiding standards. Chapter IV Assessment of Safety Training Article 21 The assessment of safety training shall adhere to the separation of teaching and examination, unified standards and graded responsibility. Twenty-second safety supervisors, dangerous goods production, management and storage units and the main person in charge of mining enterprises, safety production management personnel and special operations personnel assessment standards, formulated by the State Bureau. Except for dangerous goods production, management and storage units and mining enterprises, the assessment standards for the principal responsible persons, safety production management personnel and other employees of other production and business units shall be formulated by the provincial safety production supervision and management departments. Article 23 The State Bureau is responsible for the assessment of safety inspectors of production safety supervision and management departments at or above the provincial level and coal mine safety inspectors of coal mine safety supervision institutions at all levels; Responsible for the assessment of the principal responsible persons and safety production management personnel of the central enterprise corporation, general factory and group company. The provincial safety production supervision and management department is responsible for the assessment of the safety production inspectors of the municipal and county safety production supervision and management departments; Responsible for the assessment of the main responsible persons and safety management personnel of provincial production and business units and branches and subsidiaries of central enterprises and their subordinate units; Responsible for the assessment of special operations personnel. City and county safety production supervision and management departments shall be responsible for the assessment of the principal responsible persons and safety production management personnel of other production and business operation entities except central enterprises and provincial production and business operation entities within their respective administrative areas. Provincial coal mine safety supervision institutions shall be responsible for the assessment of the main persons in charge, safety production management personnel and special operations personnel of coal mining enterprises within their respective jurisdictions. In addition to the main person in charge, safety production management personnel and special operations personnel, other employees of production and business operation entities shall accept the assessment. Twenty-fourth safety production supervision and management departments, coal mine safety supervision institutions and production and business units shall formulate safety training assessment systems and establish assessment management files. Chapter V Proof of Safety Training Article 25 If a person who has received safety training passes the examination, the examination department shall issue the corresponding certificate. Twenty-sixth production safety inspectors after passing the examination, issued a certificate of production safety inspectors; After passing the examination, the coal mine safety inspector shall be issued with a coal mine safety inspector certificate; The main person in charge of the production, management and storage units and mining enterprises of dangerous goods and the safety production management personnel shall be issued with safety qualification certificates after passing the examination; After passing the examination, special operations personnel will be issued with special operations qualification certificates (including IC cards); Hazardous chemicals registration personnel shall be issued with post certificates after passing the examination; Other personnel will be awarded training certificates after passing the examination. Twenty-seventh safety inspector certificate, coal mine safety inspector certificate, safety qualification certificate, special operation qualification certificate (including IC card) and the style of work permit shall be uniformly stipulated by the State Bureau. The style of training certificate shall be stipulated by the department responsible for training assessment. Twenty-eighth production safety inspector certificate, coal mine safety inspector certificate and safety qualification certificate are valid for 3 years. If it is necessary to extend the validity period of safety production inspector certificate, coal mine safety inspector certificate and safety qualification certificate, it shall go through the extension formalities at the original issuing department within 2 months before the expiration period. The validity period of the qualification certificate for special operations is 6 years, and it is reviewed every 2 years. If the qualification certificate for special operations needs to be renewed or re-examined, it shall be renewed or re-examined within 1 month before the expiration of its validity. The contents of the review include accident records, violation records, training records, etc. Those who fail the second interview shall go through the extension formalities after passing the second interview safety training exam. Individuals who have been engaged in this type of work 10 for more than 0 years within the validity period of the special operation qualification certificate, and strictly abide by the laws and regulations on safety in production, will not be re-examined after the expiration of the validity period of the special operation qualification certificate with the consent of the original issuing department or relevant departments in different places, and the validity period of the special operation qualification certificate will be extended for 2 years. Twenty-ninth special operation qualification certificates and safety qualification certificates issued by provincial safety production supervision and management departments or coal mine safety supervision institutions are valid throughout the country. Chapter VI Supervision and Management Article 30 The safety production supervision and management departments and coal mine safety supervision institutions shall strengthen the supervision and management of safety training in accordance with the provisions of laws, administrative regulations and these Measures. Thirty-first safety production supervision and management departments, coal mine safety supervision institutions and their staff should adhere to the principles of openness, fairness and impartiality, and examine and issue qualification certificates of safety training institutions in strict accordance with laws, administrative regulations and these Measures. Safety training institutions, safety production supervision and management departments and coal mine safety supervision institutions that have obtained qualification certificates shall conduct an evaluation and inspection every 3 years. Safety production supervision and management departments and coal mine safety supervision institutions shall regularly announce to the public the list of safety training institutions that have obtained qualification certificates and accept social supervision. Thirty-second safety production supervision and management departments and coal mine safety supervision institutions shall supervise the safety training activities carried out by safety training institutions. Any unit or individual has the right to report to the safety production supervision and management department and the coal mine safety supervision institution about the illegal acts of safety training institutions. Article 33 The safety production supervision and management departments and coal mine safety supervision institutions shall supervise and inspect the safety training and certificates of the principal responsible persons, safety production management personnel, special operations personnel and other employees of production and business units. Thirty-fourth supervisory organs shall, in accordance with the provisions of the Administrative Supervision Law and other laws and administrative regulations, supervise the safety production supervision and management departments, coal mine safety supervision institutions and their staff to perform their duties of safety training supervision and management. Chapter VII Punishment Article 35 Any staff member of the safety production supervision and management department or the coal mine safety supervision institution who abuses his power, neglects his duty or engages in malpractices for personal gain in the supervision and management of safety training shall be given administrative sanctions in accordance with relevant regulations; If a crime is constituted, criminal responsibility shall be investigated according to law. Thirty-sixth safety training institutions in any of the following circumstances, shall be ordered to make corrections within a time limit; If it fails to make corrections within the time limit, it shall be given a warning and fined 10000 yuan; If the circumstances are serious and there are illegal gains, a fine of less than 3 times the illegal gains shall be imposed, but the maximum amount shall not exceed 30,000 yuan, and the corresponding qualification certificate shall be suspended or revoked; If there is no illegal income, the corresponding qualification certificate shall be withheld or revoked: (1) failing to organize teaching and training in accordance with the unified training outline; (two) the full-time teachers engaged in safety training have not passed the examination, or the examination is unqualified; (3) Lending or leasing the safety training qualification certificate to other institutions or individuals. Safety training institutions that engage in safety training activities without obtaining qualification certificates shall be punished in accordance with the provisions of the preceding paragraph. Article 37 If a safety training institution continues to engage in safety training activities without passing the assessment and inspection, it shall be given a warning and fined 10000 yuan; If the circumstances are serious and there are illegal gains, a fine of less than 3 times the illegal gains shall be imposed, but the maximum amount shall not exceed 30,000 yuan, and the corresponding qualification certificate shall be suspended or revoked; If there is no illegal income, the corresponding qualification certificate shall be withheld or revoked. Thirty-eighth production and business units in any of the following circumstances, shall be ordered to make corrections within a time limit; If it fails to make corrections within the time limit, it shall be ordered to stop production and suspend business for rectification, and may be fined up to 20,000 yuan: (1) The main person in charge and safety production management personnel of the production, operation and storage units and mining enterprises of dangerous goods fail to pass the examination and obtain safety qualification certificates according to regulations; (two) employees did not receive education and training in production safety before taking up their posts or adopting new technologies, materials and equipment; (three) special operations personnel have not received special safety technical training and obtained the qualification certificate for special operations.
