Nanchang Low-carbon Development Promotion Regulations (Draft for Comment)

Chapter I General Provisions

Article 1 In order to promote the economic and social transformation to a low-carbon development mode and strengthen the control and management of greenhouse gas emissions, these Regulations are formulated in accordance with the provisions of relevant laws and regulations and combined with the actual situation of this Municipality.

Article 2 These Regulations shall apply to the activities related to promoting low-carbon development and building a low-carbon city within the administrative area of this Municipality.

Article 3 The low-carbon development of this Municipality follows the principles of combining government guidance with market operation, coordinating greenhouse gas emission reduction with adaptation to climate change, promoting enterprise implementation with public participation, and unifying voluntary emission reduction with compulsory emission reduction.

Article 4 This Municipality focuses on promoting the following low-carbon development:

(1) Promote the improvement of energy efficiency in industrial activities;

(2) Promoting the development of low-carbon ecological agriculture;

(3) Building sustainable and safe urban traffic;

(4) promoting green buildings;

(five) green municipal infrastructure construction;

(6) Strengthen the management of water resources and solid waste;

(seven) to enhance the carbon sink capacity in ecological protection;

(8) Guide residents to live a low-carbon life.

Article 5 The Municipal People's Government shall establish a leadership mechanism for low-carbon development organizations, make decisions on major issues of low-carbon development, formulate major measures for low-carbon development, and deploy performance appraisal.

Article 6 The municipal and county (district) development and reform departments shall be responsible for the supervision, management and coordination of low-carbon development promotion.

Relevant departments such as planning, construction, industry and informatization, transportation, science and technology, forestry, environmental protection, landscaping, urban management, commerce, meteorology, agriculture, water affairs, housing management, public security, tourism, education, health and family planning, and government affairs management shall, according to their respective responsibilities, do a good job in promoting low-carbon development.

Article 7 The whole society is encouraged to actively participate in the propaganda, promotion, implementation and supervision of low-carbon development.

The Municipal People's Government shall reward units and individuals that have made outstanding contributions to low-carbon development every two years.

Chapter II Planning and Standard Formulation

Eighth municipal development and reform department shall organize the preparation of the city's low-carbon development plan and the annual implementation plan for low-carbon development, and report it to the Municipal People's government for approval before implementation.

Low-carbon development planning should specify the peak year of greenhouse gas emissions in this city, the requirements for emission intensity reduction, and the main means of controlling greenhouse gas emissions. (3) Regional population migration policy;

(four) building energy-saving transformation policy;

(5) Domestic waste classification policy;

(7) Decentralized policy of prohibiting coal burning;

(8) Policies to encourage carpooling operation;

(9) Other major public policies.

Twelfth municipal development and reform department shall, jointly with relevant departments, formulate low-carbon living standards, which shall be implemented after being approved by the Municipal People's government.

Low-carbon living standards include low-carbon industrial park standards, industrial enterprise standards, service enterprise standards, agricultural enterprise standards, public institution standards, community standards, family standards, energy efficiency and greenhouse gas emission standards of equipment, vehicles and buildings.

Low-carbon living standard is an important basis for management, control, supervision and evaluation of low-carbon development.

Thirteenth low-carbon development planning and low-carbon living standards, should listen to opinions. Listening to opinions can take various forms such as symposiums, argumentation meetings and hearings.

Chapter III Promoting Low-carbon Economy

Article 14 This Municipality aims to realize the low-carbon pillar of low-carbon industries and low-carbon traditional industries, promote the construction of modern industrial system, upgrade the industrial structure dominated by service industry, and promote independent innovation, agglomeration development, transformation and upgrading of manufacturing industry.

Article 17 The Municipal People's Government shall integrate and establish a resource and environment management system for industrial investment projects. Eighteenth development and reform departments should organize environmental protection, industry and information technology, investment promotion, water, land and resources and other relevant departments. In the investment stage of major investment projects, carry out industrial damage and environmental cost assessment with pollutant and greenhouse gas emission assessment as the core, and issue evaluation opinions as an important reference for whether to introduce major investment projects.

This Municipality shall not introduce projects with high greenhouse gas emissions, heavy environmental pollution and high resource consumption.

Enterprises should regularly publish greenhouse gas emission information.

Enterprises and institutions shall establish relevant files in low-carbon R&D and technological transformation.

Twentieth municipal development and reform department shall, jointly with the market and quality supervision departments, carry out low-carbon certification of typical products in key industries in a planned way; Other products and projects that need low-carbon certification can also apply for certification. Enterprises with low-carbon certification can implement the standard system of production and consumption of carbon-emitting products.

Article 21 The municipal competent department of industry and information technology shall organize the formulation of a time-limited elimination plan for production technologies, processes, equipment and products that seriously pollute the environment and emit high greenhouse gases, which shall be promulgated and implemented after being approved by the Municipal People's Government.

Article 22 This Municipality shall develop low-carbon ecological agriculture with pollution-free agricultural products, green food and organic agricultural products as the main body, implement a scientific food consumption pattern that is conducive to health and environmental protection, and implement a safety inspection and supervision and management system in the whole process of food production, processing, circulation and consumption.

The city prohibits the cultivation of genetically modified agricultural products.

Chapter IV Building a Low-carbon Society

Article 23 This Municipality implements the bus priority strategy, develops rail transit and bus rapid transit system, and the travel sharing rate of urban public transport increases year by year. Promote new energy buses and taxis, and promote the application of intelligent traffic management technology. Eliminate public transport vehicles with high pollution and high emission within a time limit.

In airports, railway stations, passenger hub stations, subway stations and other transportation distribution centers, a variety of modes of transportation have gradually formed a seamless connection.

Article 24 This Municipality shall implement the clean energy plan, develop new energy sources such as solar energy, wind energy and biomass energy, increase the proportion of traditional low-carbon energy sources such as natural gas, and improve the energy utilization structure.

By 2020, hybrid energy should be widely used in urban buses and taxis. Official vehicles should be gradually replaced by electric vehicles.

The city gradually implements the renewable energy quota system, and a certain proportion of the electricity supplied by power supply units is renewable energy for power generation.

The city promotes the use of solar water heaters and solar lighting, giving priority to the development of garbage power generation and kitchen waste conversion energy.

Article 31 This Municipality shall make full use of the characteristics of ecology, land resources and water resources, improve the forest coverage rate, protect and utilize wetland resources, and enhance the carbon sink capacity.

The landscaping project should adopt advanced greening construction and maintenance technology to vertically afforest the roofs, balconies, walls, overpasses, rivers and lakes of buildings.

Thirty-second departments of land and resources should strictly protect basic farmland, ensure a sufficient scale of soil carbon sinks and crop carbon sinks, and improve the comprehensive utilization efficiency of land.

Article 33 The municipal departments of development, reform, industry and informatization should design the smart city at the top level, comprehensively promote the role of informatization in urban ecological environment, transportation, energy supply, comprehensive management, intelligent buildings, medical education and other fields, make intelligent responses to various needs of the city, reduce resource consumption, and reduce environmental pollution and greenhouse gas emissions.

Article 34 This Municipality advocates low-carbon lifestyles and consumption patterns, guides consumers to buy and use energy-saving, water-saving and electricity-saving products, reduces the use of disposable products, and accelerates the formation of simple, moderate, green, low-carbon, civilized and healthy consumption behaviors.

Hotels in this city do not provide disposable toiletries and slippers.

Thirty-fifth organs, enterprises, institutions and other organizations in this Municipality shall economize on the use of office supplies, water and electricity.

Thirty-sixth kindergartens, primary and secondary schools in this city should integrate low-carbon culture into relevant courses, and cultivate and improve the low-carbon ecological concept and environmental protection concept of children and adolescents.

City and county (District) people's governments should incorporate low-carbon development into the training courses for leading cadres and civil servants.

Encourage enterprises, institutions or other organizations to regularly conduct low-carbon knowledge training for their employees.

Thirty-seventh newspapers, radio, television, Internet and other media in this Municipality should set up special topics or columns on low-carbon development, widely publicize low-carbon knowledge such as low-carbon economy, green consumption and ecological human settlement, and create a low-carbon city atmosphere.

The Municipal People's Government shall build a series of "visible low-carbon cities" demonstration projects in a planned way, and set up eye-catching low-carbon development public welfare billboards all the year round in urban access roads and areas with large traffic.

Thirty-eighth city and county (District) people's governments can entrust qualified social organizations and research institutions to carry out public services and special research to promote low-carbon development by purchasing services.

Encourage and support industry associations, intermediaries and other organizations to carry out low-carbon publicity, low-carbon technology promotion and consulting services.

Chapter V Policy Promotion

Article 39 This Municipality's government procurement shall gradually expand the proportion of products and projects that have obtained low-carbon certification, and give priority to the procurement of products, equipment and facilities that are energy-saving, water-saving, land-saving, material-saving and conducive to environmental protection.

Article 40 This Municipality encourages and guides financial institutions to increase credit support for circular economy, cleaner production and technological transformation projects of energy conservation and emission reduction, and gives priority to providing direct financing services for eligible projects. Encourage financial, insurance and social audit institutions to implement green credit, green insurance and green audit.

Article 41 The Municipal People's Government shall implement the fiscal transfer payment policy for the restricted development zones and prohibited development zones in the main functional areas, so as to promote the restoration of the ecological environment in the region and the residents' enjoyment of the city's equal basic public services; The Municipal People's Government shall withdraw from restricted development zones and prohibited development zones within a time limit.

Article 42 This Municipality shall establish a carbon emission trading market, and key greenhouse gas emitting units may independently participate in the carbon emission quota trading in this Municipality's carbon emission trading market.

Encourage and support other units to voluntarily participate in carbon emission trading.

Article 43 The Municipal People's Government shall set up special funds for low-carbon development and incorporate them into the fiscal budget. Special funds for low-carbon development shall be earmarked for special purposes and shall not be used for other purposes, and shall be subject to social supervision.

Special funds are mainly used for the following work:

(1) low-carbon capacity system construction;

(2) Low-carbon demonstration project construction;

(3) Building a low-carbon public service platform;

(four) other basic and demonstration work related to supporting the development of low-carbon cities.

Special funds for low-carbon development are increasing year by year with the economic growth of this city.

Article 44 This Municipality shall strengthen the introduction of low-carbon and high-end talents, and provide convenience for talents to settle down, medical care, insurance, entry and exit, housing, spouse employment and children's enrollment. To provide financial support for scientific research, academic exchanges and skills training, and to give special preferential policies to key talents in short supply.

Forty-fifth city and county (District) people's governments should give preferential policies, improve social investment guidance policies, broaden the field of private investment, and encourage social capital to participate in the construction and operation of low-carbon development infrastructure.

Article 46 This Municipality shall levy and set up a carbon fund according to the consumption of coal, natural gas, oil and electric energy in major greenhouse gas emission industries.

The carbon fund supports the key projects of energy conservation and emission reduction, clean production, circular economy, new energy and carbon sink and the construction of eco-industrial parks in this city by means of subsidies, incentives and interest subsidies, and promotes high-efficiency energy-saving products and new energy-saving mechanisms for limiting the ecological compensation of development zones and prohibiting development zones.

Forty-seventh policies to promote and encourage low-carbon development in these regulations shall be formulated separately by the municipal development and reform department in conjunction with the municipal finance department and implemented after the approval of the Municipal People's government.

Chapter VI Management Supervision

Forty-eighth city and county (District) People's Congress Standing Committee shall include the relevant contents of supervision and promotion of low-carbon development in the annual work plan.

City and county (District) people's governments shall make a special report on low-carbon development to the Standing Committee of the National People's Congress at the same level in the fourth quarter of each year, and accept the supervision of the Standing Committee of the National People's Congress at the same level.

Forty-ninth city and county (District) people's governments should invest in the construction of low-carbon development major project library, comprehensive public service platform and greenhouse gas emission monitoring and early warning system.

Fiftieth municipal development and reform department shall formulate the city's low-carbon development target responsibility system, clarify the tasks and responsibilities of the county (District) government and relevant departments, formulate a low-carbon development evaluation index system, and implement it after approval by the Municipal People's government.

The target management assessment of the Municipal People's Government shall include the assessment of low-carbon development goals.

The people's governments of cities and counties (districts) shall conduct performance appraisal on the implementation of low-carbon development by relevant departments.

The city implements the chief executive responsibility system for low-carbon development and greenhouse gas emission reduction targets.

Article 51 The municipal development and reform department shall compile an inventory of greenhouse gas emissions in this Municipality year by year, regularly allocate emission quotas to key greenhouse gas emission units in this Municipality, and may take the following measures to control and manage the total amount:

(a) Clear greenhouse gas emission limits;

(2) formulating energy consumption standards or greenhouse gas emission standards;

(3) On-line monitoring of greenhouse gas emissions;

(four) the implementation of power supply quota;

(5) Ordering rectification within a time limit;

(6) public exposure;

(7) punish according to law.

Fifty-second key greenhouse gas emitting units shall fulfill their greenhouse gas emission control and emission responsibilities within the scope of their emission quotas.

Encourage other units to join the scope of greenhouse gas emission control and consciously carry out greenhouse gas emission reduction actions. Article 53 The municipal statistical department shall establish a statistical accounting system for greenhouse gas emissions and carry out statistics and monitoring of carbon emissions.

Chapter VII Supplementary Provisions

Article 54 These Regulations shall come into force as of the date of promulgation.
