Regulations of Baotou Municipality on the Administration of Municipal Engineering Facilities

Chapter I General Provisions Article 1 In order to strengthen the management and protection of municipal engineering facilities and give full play to the social, economic and environmental benefits of municipal engineering facilities, these Regulations are formulated in accordance with the provisions of relevant state laws and regulations and combined with the actual situation of this Municipality. Article 2 The following municipal engineering facilities fall within the scope of administration of these Regulations:

(1) Urban roads: carriageways, sidewalks, public squares, open spaces, car isolation belts, shoulders and their ancillary facilities within the red line of roads (including streets and lanes);

(2) Urban bridges and culverts: bridges, overpasses, underpasses and interchanges;

(3) Urban drainage facilities: rainwater pipes, sewage pipes, rainwater and sewage confluence pipes, channels, pumping stations, sewage treatment plants and their ancillary facilities;

(4) Urban public lighting facilities: lighting facilities for roads, bridges, public squares and public parking lots;

(5) Urban flood control facilities: reservoirs, flood discharge canals, dams and their ancillary facilities. Article 3 These Regulations shall apply to the urban areas of this Municipality, Baiyun Obo mining area, Shiguai mining area, suburban Shahe, Chengguan Town of Guyang County and Salaqi Town of Tumd Right Banner. Article 4 The Municipal Urban and Rural Construction Bureau is the administrative department in charge of municipal engineering facilities, and provides business leadership, supervision and inspection to the municipal engineering facilities management departments of cities, counties and districts.

The municipal engineering facilities management department shall strengthen the management, maintenance and repair of municipal engineering facilities according to law. Fifth municipal engineering facilities to implement unified planning and construction, city, flag, county, district level management. Municipal engineering facilities built with public assistance, public assistance from the Democratic National Construction Association and fund-raising shall be received and managed by the municipal engineering facilities management department in accordance with the principle of hierarchical management after completion.

Municipal engineering facilities built by enterprises and institutions shall be managed by themselves. Sixth municipal engineering facilities maintenance and construction funds, used to ensure the maintenance, repair and construction of municipal engineering facilities.

Municipal engineering facilities shall be used for compensation within the scope prescribed by the state.

Municipal engineering facilities fees shall be used for the renovation, maintenance and management of municipal engineering facilities, and shall not be used for other purposes. Article 7 All units and individuals have the right and obligation to protect municipal engineering facilities, and have the right to supervise, report and accuse acts that damage municipal engineering facilities. Those who have made outstanding contributions to the protection of municipal engineering facilities shall be rewarded by the municipal people's governments at all levels. Chapter II Management of Urban Roads, Bridges and Culverts Article 8 Urban roads, bridges and public squares are not allowed to set up stalls, pile up articles, build illegally or conduct market trade. If temporary occupation is really necessary, it must be approved by the municipal engineering facilities management department and approved by the public security traffic management department. Article 9 Any unit or individual that carries out engineering construction within the scope of urban roads must hold a construction project planning permit issued by the competent department of urban planning administration. After being approved by the municipal engineering facilities management department, the public security traffic management department shall go through the examination and approval procedures. Article 10 Where roads are occupied or dug, guardrails and safety signs must be set on the construction site to keep the site clean and tidy, ensure the safety of pedestrians and vehicles, and restore the road surface within a time limit. Eleventh caterpillar vehicles and other vehicles that damage municipal engineering facilities are prohibited from driving on paved roads and bridges and culverts. If it is necessary to pass because of special circumstances, it must be approved by the municipal engineering facilities management department and run at the time and route designated by the public security traffic management department. Twelfth all kinds of motor vehicles are strictly prohibited from doing test braking on bridges, culverts and roads outside the regulations.

It is strictly forbidden for all kinds of motor vehicles to drive on the paved sidewalk and park at will.

It is strictly prohibited to dig sand, borrow soil, dump garbage or engage in operations that damage bridge and culvert facilities within the designated bridge and culvert management scope. Thirteenth occupation, excavation of roads, tracked vehicles and other vehicles that damage municipal engineering facilities shall pay the occupation fee and compensation fee to the municipal engineering facilities management department in accordance with the regulations when driving on paved roads and bridges. Chapter III Management of Urban Drainage Facilities Article 14 It is forbidden to occupy, move or damage drainage pipelines and their ancillary facilities without authorization. Do not occupy land or build buildings or structures on drainage channels. Do not dump garbage, feces, muck and other sundries into open ditches, inspection wells and rain outlets. No pipe plugging, river closure or pumping irrigation is allowed in urban drainage ditches. Fifteenth rainwater and sewage pipes are not allowed to be mixed. All units and individuals who take over the drainage to the urban drainage facilities must be examined and approved by the municipal engineering facilities management department, and pay the fees according to the regulations. Sixteenth in order to ensure the engineering quality of laying drainage pipes within the red line of urban roads, it must be undertaken by a professional construction team recognized by the municipal engineering facilities management department, and accepted by the municipal engineering facilities management department after completion. Seventeenth sewage discharged into urban drainage channels must meet the water quality standards formulated by the competent department of the state. Eighteenth municipal engineering facilities management departments should be required to detect the quality of sewage, to block the pipeline, damage the drainage facilities, affect the treatment effect, municipal engineering facilities management departments in accordance with the provisions of the sewage units and individuals to collect compensation fees. Chapter IV Administration of Urban Public Lighting Facilities Article 19 It is forbidden to occupy, move or damage public lighting facilities without authorization; Do not pull wires, connect electricity or install other ancillary facilities on public lighting facilities. Twentieth any unit or individual, due to engineering construction or other reasons, need to occupy, dismantle, disconnect the public lighting facilities, must be approved by the municipal engineering facilities management department, and compensation in accordance with the provisions.
