The term "rural domestic waste" as mentioned in these Regulations refers to the solid waste generated by villagers, resident units and individuals in rural areas (hereinafter referred to as resident units and individuals) in their daily lives or activities providing services for their daily lives, as well as the solid waste regarded as domestic waste according to laws and regulations.
Where there are other provisions in laws and regulations on the management of solid waste such as hazardous waste, medical waste and construction waste, those provisions shall prevail. Article 3 The treatment of rural domestic garbage shall follow the principles of government leading, social participation, urban and rural planning, territorial management, source treatment and classified treatment, so as to promote the reduction, recycling and harmlessness of rural domestic garbage. The fourth is to establish a fund investment mechanism for rural domestic waste treatment that combines financial security, village collective subsidies, villagers' payment and social capital participation.
The Municipal People's Government shall increase the financial investment in the treatment of rural domestic waste, and may set up incentive funds for the assessment and reward of rural domestic waste treatment.
The people's governments of counties (cities, districts) and townships shall include the funds for rural domestic garbage disposal in the annual budget, which shall be used to ensure the construction and management of rural domestic garbage disposal infrastructure, rural domestic garbage transportation and terminal disposal, and village (community) cleaners.
The village (neighborhood) committee may charge the villagers, permanent units and individuals for the treatment of domestic garbage in accordance with the principle of "who benefits, who pays" and the village rules and regulations, or after discussion and decision by the village (neighborhood) people's meeting and the village (neighborhood) people's representative meeting, it may extract a certain proportion of funds from the village collective economic income to subsidize the collection, transportation equipment configuration, storage and storage of domestic garbage in the village (community).
The people's governments of cities and counties (cities, districts) shall formulate relevant policies, encourage and guide social capital to participate in the collection, transportation and disposal of rural domestic waste through bidding and franchising, and encourage and support scientific and technological innovation and application of achievements in rural domestic waste treatment. Article 5 The Municipal People's Government shall co-ordinate the treatment of rural domestic garbage in the whole city, incorporate the treatment of rural domestic garbage into the national economic and social development plan, clarify the standards for ensuring county-level financial funds, determine the treatment targets, and improve the coordination, assessment, supervision and incentive mechanisms.
Urban and rural construction department is the competent department of rural domestic waste treatment in the city, responsible for the overall planning, comprehensive coordination, assessment and supervision of rural domestic waste treatment in the city. Article 6 The people's governments of counties (cities, districts) and the Administrative Committee of the Development Zone shall be responsible for the management of rural domestic waste within their respective administrative areas, incorporate the management of rural domestic waste into the national economic and social development plan, and specifically perform the following duties:
(a) to determine the local rural domestic waste disposal departments, clear responsibilities of relevant departments;
(two) in accordance with the standards for the implementation of rural domestic waste disposal funds;
(three) to formulate a special plan for the treatment of local rural domestic waste;
(four) overall planning and construction of township (street) domestic waste transfer stations and county-level domestic waste treatment facilities, to provide technical and professional support for the construction of village-level domestic waste collection and classification facilities;
(five) reasonable arrangement of acquisition outlets, support and guide market players to participate in the recycling of low value-added recyclable waste such as waste plastics, waste glass and waste fabrics;
(six) the establishment of a comprehensive assessment system for rural domestic waste management, and incorporated into the performance appraisal system for various functional departments and township people's governments (street offices);
(seven) other matters stipulated by laws and regulations. Seventh Township People's governments and street offices shall organize and implement the management of rural domestic waste in their respective jurisdictions, and perform the following duties:
(a) to formulate a work plan for the treatment of rural domestic waste;
(two) to help promote the construction of domestic waste transfer stations;
(three) responsible for the organization of rural domestic waste transfer, to ensure the normal operation of domestic waste transfer station;
(four) to supervise, guide and evaluate the garbage disposal work of the village (neighborhood) committees;
(5) Other matters stipulated by laws and regulations. Article 8 The village (neighborhood) committee shall organize the cleaning, classification and collection of domestic garbage in the village (community), and perform the following duties:
(a) through the village (neighborhood) people's meeting or the village (neighborhood) people's representative meeting, the domestic garbage disposal will be included in the village rules and regulations, and the village (neighborhood) people, resident units and individuals will be publicized and guided to consciously carry out garbage sorting and actively participate in domestic garbage disposal;
(two) the establishment of domestic waste classification management system, the development of domestic waste classification reduction plan;
(three) the formation of cleaning staff, the implementation of the responsibility of classified collection of domestic waste;
(four) equipped with domestic waste cleaning, collection and transportation equipment and tools, the construction of domestic waste collection transfer room (point), classification and temporary storage places and organic waste centralized composting point;
(five) regularly organize environmental sanitation cleaning, keep the village clean and tidy;
(six) to guide and supervise the village (neighborhood) people, units and individuals to put domestic garbage in different categories, and to discourage the delivery behavior that does not meet the requirements;
(seven) other matters stipulated by laws and regulations.
In areas where the market-oriented operation of rural domestic garbage disposal is implemented, the village (neighborhood) committees may determine the relevant market entities to bear the responsibilities related to rural (community) domestic garbage disposal according to the actual situation.
