Article 1 In order to improve the city's urban domestic waste disposal fee system, accelerate the pace of harmless, resourceful, and reduced treatment of urban domestic waste, and improve the quality of urban ecological environment, according to the "Law of the People's Republic of China on Prevention and Control of Environmental Pollution by Solid Wastes of the People's Republic of China*** and the State", the "Notice of the State Planning Commission, the Ministry of Finance, the Ministry of Construction, State Environmental Protection Administration on the implementation of municipal garbage disposal fee system to promote the industrialization of garbage disposal notice "(Price [2002] No. 872)," the "municipal garbage management methods" (Ministry of Construction Decree No. 1 57)," Interim Measures for the Management of Municipal Garbage Disposal Charges in Jiangsu Province "(Su price [2009] No. 60) and other relevant provisions, combined with the actual situation in the city, to formulate this interim measures
The second article of the Interim Measures is the "Interim Measures for the Management of Urban Living Waste Disposal Charges in Jiangsu Province" (Su Price Gong [2009] No. 60).
Article 2 The urban living garbage referred to in these measures refers to the urban population in their daily lives or to provide services for the city's daily life in the activities of solid waste (excluding construction waste, industrial solid waste and hazardous wastes, etc.) and laws, administrative regulations, considered as municipal living garbage of solid waste. The municipal domestic waste disposal fee is used to compensate for the collection, transportation and disposal costs incurred in the implementation of harmless centralized treatment of municipal domestic waste.
Article 3 In accordance with the "polluter pays" principle, the city's urban areas within the authorities, institutions, troops, social organizations, schools, enterprises (including provinces, ministries, foreign units in Xu, all types of enterprises, hereinafter referred to as "units"), urban residents (including permanent residents) ), urban residents (including permanent residents, temporary residents, hereinafter referred to as "households") and individual business households, shall pay the urban waste disposal fees.
Article 4 of the city's living garbage disposal fee is an administrative fee, by the municipal environmental sanitation administrative department is responsible for the collection. Its charges by the Municipal Price Bureau in conjunction with the Municipal Finance Bureau, the municipal environmental sanitation administrative department approved by the municipal government for approval and implementation, and reported to the provincial price, finance, construction (environmental sanitation) department for the record.
Article 5 The collection of urban garbage disposal fee shall be based on the principle of simplicity, effectiveness and ease of operation, and different billing methods shall be adopted according to different charging objects. Municipal garbage disposal fee can be monthly or one-time billing. Specific charges are:
(a) households by household pricing fixed levy, at the rate of 4 yuan per household per month, at the expense of the household. For households that have implemented property management, the property management enterprise is responsible for environmental health work in the area of responsibility, and will be centralized transportation of domestic garbage to the jurisdiction of the municipal sanitation department designated garbage transfer station, the city departments concerned according to the amount of garbage transported by the property management enterprise, the implementation of metered compensation. Property management enterprises shall make appropriate adjustments to the current property charges (or the owners' committee shall decide on their use) according to the compensation collected. In the ripe conditions of residential neighborhoods, the implementation of domestic garbage classification bagging pilot, the more obvious results, in the collection of domestic garbage disposal fees, take the "first levy and then return" way to be rewarded.
(ii) units to participate in the basic health insurance for urban workers in the number of people on the job pricing fixed levy, at a rate of 3 yuan per person per month, by the unit; universities, colleges and vocational education school students are charged at a rate of 1.5 yuan per person per month, by the unit.
(3) Individual industrial and commercial households according to the number of people engaged in the fixed-price levy, charged at a rate of 3 yuan per person per month, borne by the individual industrial and commercial households.
(d) Building construction units are charged at four ten-thousandths of the total cost of the contracted work, which is borne by the building construction units.
(5) Some of the industry charges:
1. Hotels, guest houses industry, according to its actual number of beds, each bed is charged at 6 yuan per month, of which the catering, sauna, entertainment part of the corresponding standards are charged separately, and borne by the operators.
2. Catering, sauna, dance halls, beauty salons and other related catering and entertainment industry, according to the business area of 1 yuan per square meter per month, at the expense of the operator.
3. Farmers' markets and professional markets without tax registration, coach passenger points (state-owned, social) according to the actual amount of garbage produced 40 yuan per ton, to be borne by the host or business management units.
4. Household decoration and repair of the garbage generated by the house, according to the standard of 1 yuan per square meter of the floor area of the house is charged, borne by the households.
Article VI In accordance with the principle of conducive to improving the collection rate, reduce the cost of fees and charges as well as facilitating the payment of fees by the municipal administrative department of environmental sanitation entrusted with public **** management or social service functions on behalf of the collection of the agency, and signed a commissioned fee agreement. Specifically:
(a) the use of piped water households by the city water supply enterprises in the households to pay the water bill era collection.
(b) belonging to the city and district financial allocation range of state organs, institutions by the city and district finance department to collect, the rest of the units by the municipal tax bureau in the unit to pay the basic medical insurance of urban workers era.
(3) Registered individual business households shall be levied by the Municipal Local Taxation Bureau when they file tax returns or apply for tax exemptions and reductions.
(4) Building construction units are levied by the Municipal Urban and Rural Construction Bureau when they apply for building construction permits. Building construction units within the Xuzhou Economic and Technological Development Zone and the New Urban District shall be levied by the Administrative Committee of the Xuzhou Economic and Technological Development Zone and the New Urban District respectively. For building construction units that have not (or do not) apply for building construction permits, they will be levied by the Municipal Local Taxation Bureau when they issue sales tax invoices.
(5) Students enrolled in universities, colleges and vocational education schools, some industries, households not included in the water charging system and unregistered individual business households are levied by the governments of the jurisdictions.
(F) other units and individuals not included, by the municipal environmental sanitation department in charge of the city according to the actual situation, to determine the way of levy, reported to the municipal government for approval and implementation.
Article 7 The unit collecting on behalf of the collection may extract 4% of the handling fee from the collected municipal domestic waste disposal fee.
Article VIII of the Federation of Trade Unions, the civil affairs department identified as special hardship households, low-income people and other poor people in society, to take the "first levy and then return" approach, exempted from the urban garbage disposal fee. For enterprises started by college students with college student entrepreneurship certificates, they are exempted from the municipal garbage disposal fee for three years on the basis of "levy first and return later". Households that do not use 5 tons of water in total are exempted from municipal garbage disposal fees.
Article IX Collection and Management of Urban Living Waste Disposal Fee:
(1) The competent department of municipal environmental sanitation shall apply to the municipal price department for a fee license, and at the same time sign a letter of entrustment with its commissioned levy and collection unit. The collection unit shall not expand the scope of charges and raise the charges, is strictly prohibited to reduce or waive the charges.
(b) the collection of urban garbage disposal fee funds paid in full into the city's financial account, the strict implementation of the two lines of income and expenditure, any department or unit shall not be retained, squeezed and misappropriated.
(C) the collection of municipal garbage disposal fees are specifically for the collection of municipal garbage, transportation and disposal. For the actual collection of urban domestic waste disposal fees part of the city for the payment of waste incineration, landfill and other disposal costs, and the other part of the municipal environmental sanitation department in charge of the city in accordance with the proportion of the amount of garbage sent to the garbage treatment plant in the districts, the regular allocation of the district municipal sanitation departments, used to make up for the collection of domestic garbage, transportation costs.
(4) municipal finance, audit, supervision, pricing, city sanitation and other departments to strengthen the collection of garbage disposal fees, management, use and use of financial instruments in accordance with the law, to ensure that earmarked for special purposes. In violation of the provisions of their own charges, raise the charges, expand the scope of charges, repeat charges, arbitrary exemptions, unauthorized retention and misappropriation and other acts, according to the relevant provisions of the law, seriously investigated and dealt with.
(E) units and individuals entrusted with environmental health operations unit to undertake paid services, its charges as business service charges management, the specific standards by the municipal price authorities in accordance with the principle of reasonable compensation for the cost of appropriate profitability approved.
Article 10 of the municipal environmental sanitation department in conjunction with the municipal price, finance department to establish the urban waste disposal fee collection and use of regular statistics and announcement system, timely announcement of the situation to the community, to improve the transparency of the collection and use of urban waste disposal fee, and consciously accept the supervision of the community.
Article XI of the units, households and individual industrial and commercial households that generate municipal household waste, etc., not in accordance with these measures and still refuse to pay the municipal household waste disposal fees after reminders, in accordance with the "Measures for the Management of Municipal Household Waste", the unit shall be subject to a penalty of less than three times the amount of municipal household waste disposal fees payable and not exceeding 30,000 yuan, and households and individual industrial and commercial households shall be subject to a penalty of less than three times the amount of municipal household waste disposal fees payable and not exceeding 1,000 yuan. A fine of not more than three times and not exceeding 1,000 yuan shall be imposed on units and households and individual industrial and commercial households, and the levying authority may apply to the people's court for compulsory enforcement.
Article 12 The counties (cities), Jawang District, Tongshan District, with the approval of the people's governments of the counties (cities) and districts in which they are located, may refer to these measures to levy urban garbage disposal fees.
Article XIII of these measures since April 1, 2011 shall come into force, the city previously issued documents related to domestic garbage disposal fees and inconsistent with the implementation of these measures.
