In order to strictly implement the environmental supervision and law enforcement responsibilities of local governments in this administrative region, innovate the environmental supervision system and mechanism, clarify the supervision tasks, improve the efficiency of law enforcement, and promote the full coverage of environmental supervision and law enforcement, according to the Notice on Strengthening Environmental Supervision and Law Enforcement by the General Office of the State Council (Guo Ban Fa [2014] No.56) and the General Office of the State Council "On Implementing Guo Ban Fa [20 14]56"

I. Guiding ideology and objectives and tasks

(1) guiding ideology. Guided by the spirit of the 18th National Congress of the Communist Party of China and the Third, Fourth and Fifth Plenary Sessions of the 18th National Congress, with the goal of improving environmental quality, ensuring environmental safety and serving scientific development, and with the focus on integrating management resources, improving supervision efficiency and eliminating blind spots in environmental supervision, a grid-based environmental supervision system will be scientifically established, forming a large-scale environmental supervision pattern that is organized and implemented by governments at all levels, coordinated by environmental protection departments, performed by relevant departments and units, and widely participated by all sectors of society.

(2) objectives and tasks. In accordance with the principle of "territorial management, graded responsibility, clear responsibility and comprehensive coverage" and the requirements of "defining areas, responsibilities, personnel, tasks and assessment", a three-level grid environmental supervision system of cities, counties (municipal development zones) and towns (streets) will be established to strengthen the leadership responsibility of governments at all levels (development zone management committees) for environmental supervision and law enforcement in their administrative areas.

Second, the grid division and responsibilities

(A) grid division

Unified organization by the municipal government, the establishment of city, county (including municipal development zones, the same below), town (street) three-level environmental supervision grid.

First-level grid: the municipal government divides the county into first-level grids, with the municipal government as the responsible unit and the relevant departments and directly affiliated units of the municipal government with environmental supervision functions as the responsible units, and undertakes environmental supervision tasks within the grid according to the prescribed responsibilities. The mayor is the leader of the first-level grid, the mayor in charge is the direct leader of the grid, and the main leaders of the relevant departments and directly affiliated units of the municipal government are the main leaders of the grid.

Secondary grid: the county and city governments divide the local administrative areas into secondary grids, and the main body of responsibility is the county and city governments. Relevant departments and units of counties and cities with environmental supervision functions are responsible units, and undertake environmental supervision tasks within the grid according to defined responsibilities. The main leaders of county and city governments are secondary grid leaders, the district heads in charge of counties and cities are direct grid leaders, and the main leaders of relevant departments and units in counties and cities are grid leaders.

Three-level grid: the town government (street office) is divided into three-level grids according to the local administrative region, with the town government (street office) as the main body of responsibility, the relevant departments of the town (street office) with environmental supervision functions as the responsible units, the main leaders of the town government (street office) as the person in charge of the three-level grid, and the mayor in charge (street office director) as the direct leader.

(1) is responsible for guiding and supervising the establishment and operation of the secondary and tertiary grids and the performance of duties by the responsible person.

(two) to be responsible for investigating and handling environmental violations under the jurisdiction of the corresponding level in a timely manner, and to disclose the information of pollution sources under the jurisdiction of the corresponding level and investigate and deal with environmental violations as required.

(3) Responsible for integrating the supervision and law enforcement forces of environmental protection departments at the same level and other departments with environmental protection supervision functions, determining the supervision working groups corresponding to each secondary grid, and defining the key supervision objects (timely and dynamic adjustment), supervision tasks and supervision responsible persons. Each working group is responsible for strengthening the inspection, spot check and supervision of the supervised grid, promptly urging the local government to conduct investigation or direct investigation when problems are found and complaints are received, and supervising the local government (administrative committee) to implement grid supervision measures.

2. Secondary grid: the main body of responsibility is the county and city governments (the administrative committee of the municipal development zone), which is mainly responsible for formulating major principles and policies for environmental protection at the corresponding level and making decisions on major issues that have a bearing on the overall situation.

(1) is responsible for guiding the establishment and operation of the three-level grid, seriously investigating and handling environmental pollution cases assigned by the superior grid, and reporting relevant information on grid environmental supervision in time.

(II) To undertake the daily environmental protection supervision and law enforcement tasks in this area, investigate and deal with all kinds of environmental violations in this area according to law, properly handle environmental letters and visits, environmental pollution disputes, investigate environmental safety hazards such as industrial and mining enterprises and drinking water sources, and disclose information related to pollution sources and information on investigation and punishment of environmental violations in accordance with regulations.

(3) Responsible for integrating the supervision and law enforcement forces of environmental protection departments at the same level and other departments with environmental protection supervision functions, determining the supervision working groups corresponding to each three-level grid, and defining the key supervision objects (timely and dynamic adjustment), supervision tasks and supervision responsible persons. Each working group is responsible for strengthening the inspection, spot check and supervision of the supervised grid, finding problems, accepting reports and complaints, promptly investigating and handling matters supervised by superiors, and urging local authorities to implement grid supervision measures.

3. Three-level grid: the main body of responsibility is the town government (street office), which is mainly responsible for formulating and organizing the implementation of environmental protection work plans and tasks within its jurisdiction, discovering and stopping environmental violations and reporting illegal information within its jurisdiction, and completing the environmental protection work objectives assigned by the main body and responsible unit at the next higher level; Responsible for supervising the performance of sub-grid responsible subjects and responsible units at the same level, and evaluating their work performance.

Third, the power grid operation.

(A) the implementation of grid supervision responsibility.

1. Implement the "Five Resolutions". Namely: determine the area, personnel, responsibilities, tasks, rewards and punishments. Make the grid boundary clear, the responsible subject clear, the objectives and tasks specific, and the assessment objectives clear, and publicize the relevant contents to the public.

2. Establish a responsibility system. Grids at all levels should sign letters of responsibility at all levels to clarify tasks and rewards and punishments. It is necessary to strengthen horizontal coordination, establish a linkage mechanism, and earnestly fulfill regulatory responsibilities.

3. Construction of environmental supervision information system. Make full use of modern information technology, establish a grid environmental supervision system by municipal organizations, and gradually realize digital grid supervision.

(2) Defining the key points of power grid supervision.

1. Strengthen inspection and reporting. The department in charge of environmental supervision should make a supervision work plan every year, clarify the supervision object, content and frequency, and the person directly responsible for the grid should carry out inspection and supervision as planned, find and stop environmental violations in time, report to the higher grid, and assist in investigating environmental violations.

2. Investigate and handle in time. After receiving the report of environmental violations, the grid responsible subject or relevant departments will investigate and deal with it in time. If it is not under the jurisdiction of the department at the corresponding level, it shall be handed over and transferred in time, and cooperate with the relevant units in the investigation. The accepting unit shall complete the investigation within the specified time, and feedback the results of the investigation to the unit. For the need for multi-sectoral joint investigation, the grid responsible subject at the same level is responsible for organizing and implementing joint law enforcement.

3. Strengthen communication and feedback. Do a good job in information communication between the responsible subjects of the upper and lower grids, give timely feedback and reply to the investigation results of environmental violations, and make them public as required. Improve the information notification system, and all departments in the grid regularly disclose the daily environmental supervision and investigation of environmental violations to the public, and implement information sharing. Establish a coordination and communication system, and the grid team leader or direct team leader will convene all relevant departments, and hold at least 1 coordination meeting every year to inform the environmental supervision grid operation and management of all departments and coordinate to solve related problems.

4. Regular evaluation and supervision. Power grids at all levels conduct self-assessment on the operation of the power grid at the same level every year, and the superior power grid conducts assessment on the lower power grid, studies improvement measures, and reports the assessment results step by step. The supervision mechanism of "first-level supervision and first-level supervision" shall be implemented, and the higher-level power grid shall supervise and inspect the operation of the lower-level power grid, and the county and municipal governments shall supervise and inspect the implementation of grid management by the relevant departments of the power grid at the same level.

(C) Strengthen the performance supervision of grid supervision

1. Strengthen supervision by superiors. The upper grid should supervise the daily operation of the lower grid, incorporate the assessment content, and constantly improve and optimize the grid environment supervision system.

2. Encourage public supervision. Encourage the masses to actively participate in environmental supervision, enhance public awareness of the environment, and protect the people's right to know and supervise. Encourage each grid to set up environmental supervisors, take the lead in coordinating and organizing representatives from all walks of life to supervise the development and implementation effect of the main body responsible for grid environmental supervision.

3. Accept the supervision of public opinion. Give full play to the role of the news media, use newspapers, television, internet and other media to publicize environmental protection laws and regulations, expose environmental violations, follow up investigation results, and participate in environmental supervision.

Fourth, the division of responsibilities

All relevant departments and units at all levels should strictly follow laws and regulations, conscientiously perform their environmental supervision duties, and focus on the following tasks:

(1) governments at all levels

City, county and municipal government: responsible for the establishment and operation of the "grid" environmental supervision system within their respective jurisdictions; Formulate an implementation plan and clarify the environmental supervision responsibilities of relevant departments; Enterprises with serious illegal sewage discharge shall be closed down, and relevant departments shall be instructed to take corresponding measures to put them in place. Do a good job in the construction and management of environmental infrastructure in accordance with the principle of territorial management, speed up the construction of environmental pollution control projects in key areas and key parts, and prevent all kinds of environmental pollution incidents. Organize all departments in this administrative region to strengthen law enforcement and supervision of environmental protection, strictly enforce environmental access, severely investigate and deal with environmental violations, and ban or close enterprises that seriously pollute the environment and do not conform to national industrial policies according to law. Comprehensively promote the standardization of environmental protection capabilities such as monitoring, supervision, education and information, and enhance environmental protection capabilities.

Town government (street office): responsible for the establishment and operation of the "grid" environmental supervision system within its jurisdiction, performing the duties of environmental protection supervision and management, organizing the supervision of pollutant discharge enterprises, accepting environmental petition cases, cleaning up local (small) enterprises, protecting rural drinking water sources within its jurisdiction, and closing or relocating livestock and poultry farms (communities) and specialized households in the no-breeding areas according to law.

(two) the relevant departments and units directly under the municipal government.

Propaganda Department of the Municipal Party Committee: responsible for overall planning, coordinating and promoting environmental protection publicity and education, opening columns in Weifang Daily, Weifang Radio Station and Weifang TV Station to publicize environmental protection laws, regulations and policies, and giving full play to the supervisory role of news and public opinion.

Municipal government supervision room: to supervise and inspect the implementation of grid environmental supervision in counties and cities, relevant departments and directly affiliated units of the municipal government.

Municipal Environmental Protection Bureau: to perform the environmental supervision duties of the municipal environmental protection department; Coordinate the establishment of a "horizontal to edge, vertical to the end" grid environmental supervision system at all levels within the jurisdiction, and conduct regular inspections and guidance; Implement the supervision responsibility of industrial pollution sources and deal with environmental violations according to law. Clarify the responsible leaders and responsible personnel of enterprises at the same level, implement classified management of pollution sources, and improve the on-site law enforcement responsibility system.

Municipal Development and Reform Commission: responsible for coordinating and handling the relationship between economic and social development, resource conservation and environmental protection, and incorporating ecological civilization construction and environmental protection into economic and social development planning. When examining and approving the project feasibility report or project application report submitted by the project unit, if the environmental impact assessment document and the examination and approval opinions of the environmental protection department are not provided, it shall not be examined or approved; If it belongs to the filed project, it shall inform the project owner to submit the environmental impact assessment document to the environmental protection department after the project is filed.

Municipal Economic and Information Committee: organize and implement industrial restructuring, eliminate backward production capacity and technology explicitly prohibited by laws and regulations and national industrial policies, promote technological innovation and product upgrading of enterprises, and promote the development and transformation of green industries. Improve the development level of circular economy in the city, speed up the pace of establishing a national circular economy demonstration city, and do a good job in "co-creating cities and counties' parks", recycling transformation of parks above the provincial level, voluntary cleaner production audit and acceptance, and construction of circular economy education demonstration bases. Organize the implementation of key energy-saving projects and complete the energy-saving task objectives issued by the provincial government. Responsible for dust control of coal storage business units. Cooperate with relevant departments and units to upgrade oil products.

Municipal Public Security Bureau: responsible for investigating and handling cases of environmental noise pollution in businesses, families and public places according to law, and supervising and managing mobile pollution sources such as muck transport vehicles. Establish a supervision and management system for the prevention and control of motor vehicle exhaust pollution that shares information with environmental protection departments, and cooperate with environmental protection departments to carry out the prevention and control of motor vehicle exhaust pollution according to law. Responsible for starting the ban measures for yellow-label vehicles in extreme weather and completing the task of eliminating yellow-label vehicles; Responsible for properly handling sudden environmental incidents caused by traffic, fire, explosion, leakage and other accidents, and doing a good job in maintaining the stability of environmental mass incidents. Cooperate with environmental protection departments to strengthen law enforcement, investigate and deal with environmental pollution accidents, illegal acts and other criminal cases and public security cases according to law. According to relevant laws and regulations, in conjunction with relevant departments and units, do a good job in the safety management of dangerous chemicals and radioactive substances. Strengthen the supervision of muck transport vehicles.

Municipal Supervision Bureau: Strengthen the supervision of the performance of duties by various departments in various regions, and be seriously accountable for problems such as inadequate implementation of environmental protection laws and regulations and inadequate environmental supervision.

Municipal Finance Bureau: gradually increase financial support, timely allocate national, provincial and municipal special funds for environmental protection, strengthen supervision and use management, ensure the efficiency of fund use, ensure the establishment and normal operation of grid environmental supervision system, and improve the ability and level of environmental supervision.

Municipal Bureau of Land and Resources: In the process of compiling the master plan of land use and the master plan of mineral resources, the environmental impact assessment system is implemented, and on the premise of maintaining ecological balance, land resources are rationally developed and utilized according to law, and land requisition and land use approval for construction projects are strictly controlled. All construction projects that have not been approved by the environmental protection department will not go through the procedures for land acquisition and use. In conjunction with environmental protection, agriculture and other departments to carry out soil pollution control and remediation work.

Municipal Housing and Construction Bureau: responsible for the prevention and control of dust pollution on construction sites; Responsible for the dust control of commercial concrete and ready-mixed mortar enterprises. We will further promote the construction of rural community service centers, simultaneously improve community public service facilities and infrastructure, and focus on rectifying rural sewage pools and stinking ditches.

Municipal Council: responsible for controlling smoke pollution of open-air barbecue oil; Responsible for the supervision and management of dust pollution in road excavation and road cleaning operations, further promote greening and maintenance projects, and strictly investigate garbage incineration. Responsible for the supervision of the city's drainage management, sewage treatment and reclaimed water utilization industry, promote the construction, management and maintenance of urban sewage treatment facilities and supporting pipe networks, and prohibit the direct discharge of sewage in urban built-up areas. Responsible for the construction and operation of sludge harmless disposal facilities in sewage treatment plants, as well as the destination, use and dosage of sludge. Strengthen the operation management of urban sewage treatment plants and improve the urban sewage treatment rate. Responsible for promoting the construction of natural gas transmission and distribution infrastructure, actively striving for gas sources and ensuring gas demand. Responsible for promoting the integration of heating market and optimizing heating layout. Responsible for the construction and management of environmental sanitation infrastructure. Responsible for improving rural environmental sanitation and promoting the treatment of rural domestic garbage. Strengthen law enforcement and supervision, and punish construction dust pollution, construction noise pollution and dust pollution in urban population concentrated areas, urban planning areas, urban roads or open-air material storage yards in public places. Strengthen the operation and management of landfill.

Municipal Transportation Bureau: responsible for the safety management of dangerous chemicals highway and waterway transportation units and their means of transportation, supervising the safety of dangerous chemicals waterway transportation, and preventing and controlling environmental pollution by dangerous chemicals. Motor vehicles that have not obtained the environmental protection inspection mark shall not go through the regular inspection procedures for operating motor vehicles. Responsible for promoting the construction of green transportation, organizing the implementation of traffic trunk pollution control, and promoting the elimination of high pollution emissions and old operating vehicles. Cooperate with and assist relevant departments to deal with environmental pollution accidents caused by road and waterway traffic accidents.

Municipal Water Conservancy Bureau: Formulate dam control and dispatching schemes for major rivers, rationally regulate and control dam operation, ensure the normal operation of dams, give play to benefits and meet the ecological water demand of rivers. According to the requirements of flood control and ecological water use, do a good job in dam control and operation. It is forbidden to set up sewage outlets in drinking water source protection areas. Responsible for the management and supervision of rivers, lakes and water sources, and take the lead in organizing, coordinating and supervising the implementation of river ecological wetlands and constructed wetlands exported by sewage treatment plants in conjunction with relevant departments and units. Organize the protection of water resources and the prevention and control of soil erosion, and implement the system of water intake permit, paid use of water resources, planned water use and water conservation.

Municipal Bureau of Agriculture: responsible for promoting rural energy construction, and supervising and managing the use of agricultural inputs such as pesticides, fertilizers and agricultural films according to law. Responsible for the comprehensive utilization of agricultural wastes such as crop straws. Strengthen the control of agricultural non-point source pollution, promote the construction of pollution-free, green and organic agricultural production bases, and vigorously develop ecological agriculture and organic agriculture.

Municipal Bureau of Commerce: responsible for attracting investment and industrial guidance, supervising and managing energy saving and consumption reduction (including plastic limitation) of wholesale and retail enterprises, recycling and dismantling of old cars, etc. Prevent pollution.

Municipal Bureau of Ocean and Fisheries: responsible for organizing the formulation of the city's marine environmental protection and remediation plan, formulating and implementing the pollution prevention and control plan for coastal waters, and implementing the pollutant discharge standards and total amount control system; To organize and manage the investigation, monitoring, surveillance and evaluation of the marine environment in the whole city; Supervise the discharge of land-based pollutants into the sea and comprehensively clean up illegal or unreasonable sewage outlets; Responsible for the protection of marine biodiversity, marine ecological environment and ecological environment of fishery waters, implement the protection of typical coastal wetlands, estuaries and bays, increase the protection of important fishery waters such as island ecosystems, spawning grounds and feeding grounds, and establish a number of breeding bases for marine endangered rare wild animals and plants and fishery proliferation and release areas; Supervise and manage marine and fishery protected areas, delimit restricted farming areas, and implement offshore farming and intensive farming.

Municipal Health Planning Commission: responsible for the unified supervision and management of medical waste collection, transportation, storage and disposal. Responsible for medical institutions radioactive source diagnosis and treatment technology and medical radiation institutions access management, responsible for medical emergency work of radiation accidents.

Municipal Forestry Bureau: responsible for the organization, coordination, supervision and management of river ecological wetlands and constructed wetlands exported by sewage treatment plants. Responsible for promoting the city's afforestation, forest resources protection, desertification and desertification control, wildlife protection and other work.

City Administration for Industry and Commerce: If it is necessary to go through the examination and approval procedures for environmental impact assessment when handling the business license, inform the applicant to go through the examination and approval procedures according to law before conducting business activities, and push the relevant registration information to the environmental protection department. For all kinds of illegal subjects who are ordered to suspend business or close down by government departments for violating environmental laws and regulations and national industrial policies, the registration of change or cancellation shall be handled according to the information notified by environmental protection departments. For those who refuse to handle it, their business licenses shall be revoked according to law. Responsible for the supervision and inspection of vehicle fuel sales activities, and investigate and deal with illegal sales of vehicle fuel according to law.

Municipal Safety Supervision Bureau: responsible for the safety supervision and management of hazardous chemicals enterprises in the city, supervising and inspecting major dangerous sources of hazardous chemicals, conducting investigation and management of major accident hidden dangers, investigating and dealing with illegal acts of production safety of hazardous chemicals production enterprises according to law, and preventing production safety accidents.

Municipal Finance Office: loans are approved, distributed, supervised and managed in strict accordance with national regulations on environmental protection management of construction projects and information notified by environmental protection departments, and no new credit support is provided for projects that fail to pass the EIA approval or acceptance of environmental protection facilities: when granting loans to enterprises or individuals, the basic database of credit information of enterprises and individuals should be inquired, and the environmental compliance of enterprises should be regarded as one of the necessary conditions for loan approval; Enterprises punished by environmental protection and relevant departments shall not issue loans. Implement green credit to support pollution control and technological transformation of enterprises in line with national industrial policies.

Municipal Bureau of Port and Shipping: Do a good job in the integration of planning and construction of new docks and demolition of small docks, carry out the technical transformation of pollution prevention in port operation areas, build a ship garbage and oily sewage receiving and processing system and an oil spill emergency disposal system, organize regular on-site inspections of dangerous goods ship loading and unloading operations, strengthen emergency drills, and effectively prevent and properly handle pollution emergencies caused by dangerous goods operations in ports.

Municipal Marine Department: responsible for the safety supervision of ships carrying dangerous goods and other goods, berthing safety supervision, on-site supervision of ship water pollution prevention and control, and participating in the investigation and handling of related ship pollution accidents.

Municipal Animal Husbandry Bureau: organize the implementation of energy-saving and emission-reduction projects for livestock and poultry breeding, scientifically delimit breeding areas, restricted areas and forbidden areas, improve the standardization, scale and intensification of livestock and poultry breeding, realize the comprehensive utilization of livestock and poultry manure, promote the harmless treatment of dead livestock and poultry, and reduce the pollution of livestock and poultry breeding.

Weifang Power Supply Company: It is responsible for executing the power cut-off decision made by relevant government departments to eliminate and shut down enterprises and enterprises that violate environmental laws.

Other relevant departments and units: conscientiously implement environmental supervision responsibilities in light of the actual situation and responsibilities of the department.

Verb (abbreviation for verb) protection

(1) Strengthen organizational leadership. The establishment of the city's environmental protection grid supervision work leading institutions, fully responsible for the city's environmental protection grid management organization, coordination, supervision and inspection. All member units should give full play to their respective functional advantages, enhance their sense of responsibility and overall situation, earnestly perform their duties, and do a good job in environmental protection in grid areas.

(2) Strengthen supervision. Regularly supervise and supervise the implementation of grid environmental protection responsibility and grid responsibility, so as to supervise the whole process of important matters, the rapid supervision of urgent matters and the regular supervision of general matters, and promote the steady progress and orderly implementation of grid management.

(3) Improve the working system. The first is to establish a grid management system. Strengthen the implementation of responsibilities of relevant departments and units at all levels, clarify the work requirements of inspection, reporting, time limit and standards of grid responsible subjects at all levels, and formulate reward and punishment measures to ensure the efficient operation of grids at all levels. The second is the joint meeting system. Timely convey and implement the superior's principles and policies on environmental protection; To study and formulate annual plans and responsibility targets for environmental protection; Coordinate and solve the hot, difficult and key problems encountered in environmental protection work; Supervise, inspect and evaluate the environmental protection work of each member unit; To study and coordinate the prevention and control of environmental pollution and environmental damage across departments and industries. In principle, it will be held once every quarter, and the holding time can be adjusted according to the needs of environmental protection work, and it will be convened by the deputy mayor of the municipal government in charge of environmental protection work. The third is the joint law enforcement system. Responsible for the unified coordination and scheduling of environmental protection joint law enforcement actions, study major issues in the actions, formulate action plans, and supervise key cases. It mainly includes: the key, difficult and hot issues of environmental safety supervision, and the joint enforcement of environmental safety during major holidays, conferences and major social activities; Large-scale environmental protection special actions such as joint law enforcement and environmental inspection, rectification of illegal sewage enterprises, and protection of people's health; Joint enforcement of sudden or other emergency environmental safety incidents. All relevant departments and units should give full play to their respective responsibilities, strengthen coordination and cooperation, adhere to the system of regular consultation, joint inspection and case transfer, form a joint force of law enforcement, rectify outstanding environmental problems, and ensure environmental safety.
