Special Equipment Safety Supervision Regulations
Article 7 The local people's government at or above the county level shall supervise and support the supervision and management of special equipment safety departments to carry out safety supervision duties in accordance with the law, and special equipment safety supervision of the existence of major problems to be coordinated in a timely manner, to solve.
Article IX of any unit or individual in violation of the provisions of these regulations, the right to special equipment safety supervision and management departments and administrative supervision and other relevant departments to report.
Special equipment safety supervision and management department shall establish a special equipment safety inspection and reporting system, publish a report phone, mailbox or e-mail address, accept the production of special equipment, the use of inspection and testing of illegal acts of reporting, and deal with it in a timely manner.
Special equipment safety supervision and management departments and administrative supervision and other relevant departments shall maintain confidentiality for the informant, and in accordance with relevant state regulations to reward.
Chapter V Supervision and Inspection
Article 50 of the special equipment safety supervision and management departments in accordance with the provisions of these regulations, the production of special equipment, the use of units and inspection and testing organizations to implement safety monitoring.
Schools, kindergartens and stations, passenger terminals, shopping malls, stadiums, exhibition halls, parks and other places of public gathering of special equipment, special equipment safety supervision and management departments should implement key safety monitoring.
Article 51 of the supervision and management of special equipment safety according to the report or obtained evidence of suspected violations, suspected of violating the provisions of these regulations for investigation and handling, you can exercise the following powers:
(a) to the production and use of special equipment and inspection and testing organizations, legal representatives, the main person in charge, and other relevant personnel to investigate, and suspected of engaging in violations of these regulations, production, use, inspection and testing. Regulations of the production, use, inspection and testing of the situation;
(2) access, copy special equipment production, use of units and inspection and testing organizations of the relevant contracts, invoices, books and other relevant information;
(3) evidence that does not meet the requirements of the safety specifications, or there are other serious potential accidents, energy consumption of special equipment seriously exceeds the limit, to be seized or Seizure.
Article 52 In accordance with the provisions of these regulations to implement the licensing, approval, registration of special equipment safety supervision and management departments, shall be in strict accordance with the provisions of these regulations conditions and safety specifications for the review of relevant matters; does not meet the conditions of these regulations and safety specifications, shall not be permitted to license, approval, registration; in the application for licensing, approval, the supervision and management of special equipment safety management department found that the applicant is unauthorized to engage in special equipment without the approval of the department of safety management. Department found that the applicant is unauthorized to engage in special equipment, the corresponding activities or forgery of permits, certificates of approval, inadmissible or not permitted, approved, and within one year will no longer accept new applications for permits, approvals.
Not according to law to obtain permission, approval, registration of units engaged in the production of special equipment without authorization, use or inspection and testing activities, special equipment safety supervision and management departments shall be dealt with according to law.
Violation of the provisions of this regulation, was revoked according to law, since the date of revocation of the permit within three years, the special equipment safety supervision and management departments shall not accept new applications for permits.
Article 53 of the supervision and management of special equipment safety in the handling of administrative approval matters under these regulations, its acceptance, review, licensing, approval of the procedures must be open, and should be accepted within 30 days from the date of application, to make a permit, approval or non-permission, approval of the decision; not permitted, approval, should be in writing to the applicant to explain the reasons.
Article 54 The local supervision and management of special equipment safety departments at all levels shall not be in any form of local protection and regional blockade, shall not have been licensed in accordance with the provisions of this regulation in other places to obtain permission to repeat the production of special equipment, and shall not be required in accordance with the provisions of this regulation in other places to test and pass the inspection of special equipment, repeat inspection and testing.
Article 55 of the special equipment safety supervision and management department of the safety inspectors (hereinafter referred to as special equipment safety inspectors) should be familiar with the relevant laws, rules, regulations and safety specifications, with the appropriate professional knowledge and experience, and by the State Council, the supervision and management of special equipment safety assessment, to obtain the certificate of special equipment safety inspectors.
Special equipment safety inspectors should be loyal to their duties, adhere to the principle of impartiality.
Order 56 special equipment safety supervision and management departments of special equipment production, use of units and inspection and testing organizations to implement safety inspection, there should be more than two special equipment safety inspectors to participate in, and show the valid special equipment safety inspectors documents.
Article 57 of the special equipment safety supervision and management departments of special equipment production, use of units and inspection and testing organizations to implement safety monitoring, should be the content of each safety inspection, found that the problem and the handling of the situation, to make a record, and participate in the safety inspection of special equipment safety inspectors and the person in charge of the unit to be inspected after signing and filing. The person in charge of the inspected unit refused to sign, special equipment safety inspectors should record the situation.
Article 58 of the special equipment safety supervision and management departments of special equipment production, use of units and inspection and testing organizations for safety monitoring, found in violation of the provisions of these regulations and safety specifications or in use of special equipment in the existence of potential accidents, does not meet the energy efficiency indicators, shall be issued in writing to the safety supervision of special equipment directives, and order the relevant units to take timely measures To be corrected or eliminate potential accidents. Emergency measures need to be taken in emergency situations, should be followed by a supplementary written notice.
Article 59 of the special equipment safety supervision and management departments of special equipment production, use of units and inspection and testing organizations to carry out safety supervision, found that major violations or serious accidents shall take the necessary measures at the same time, and in a timely manner to the higher-level supervision and management departments of special equipment safety report. Received the report of the special equipment safety supervision and management departments should take the necessary measures to deal with.
The violations, serious accidents and hidden dangers or do not meet the energy efficiency indicators need to deal with the local people's government and the relevant departments of support, cooperation, supervision and management of special equipment safety departments should report to the local people's government, and notify other relevant departments. The local people's government and other relevant departments should take the necessary measures to deal with in a timely manner.
Article 60 of the State Council special equipment safety supervision and management departments and provinces, autonomous regions and municipalities directly under the Central Special Equipment Safety Supervision and Administration Department shall regularly publicize the safety of special equipment as well as energy efficiency.
Publication of special equipment safety and energy efficiency, should include the following:
(a) the quality and safety of special equipment;
(b) special equipment accidents, characteristics, cause analysis, preventive countermeasures;
(c) the energy efficiency of special equipment;
(d) other need to be announced.
