Regulations on Comprehensive Management of Urban and Rural Environments in Sichuan Province

Chapter 1 General Principles

Chapter II Responsibility Area System

Article 14 The comprehensive management of urban and rural environments shall implement the responsibility area system.

Article 15 The division and management of areas of responsibility for the comprehensive management of urban and rural environments shall be determined in accordance with the following principles:

(1) Residential areas where property management is practiced shall be the responsibility of the property service enterprises;

(2) Rivers, waters, and hydraulic structures shall be the responsibility of the units that utilize, operate, or manage them;

Article 16 The area of responsibility for the comprehensive management of urban and rural environments shall be clearly defined as the responsible person. The responsible person shall fulfill the following responsibilities:

(1) to establish and improve the comprehensive governance of the area of responsibility related systems;

(2) to designate specialized agencies and personnel responsible for the comprehensive governance of the area of responsibility for the specific work;

(3) to equip, improve and maintain sanitation and other related facilities;

Chapter III Appearance and Order

Article 29 The construction of rural landscape should be based on the actual situation, in line with the rural planning and relevant technical standards, highlighting the local culture and regional characteristics, and strengthen the construction of rural roads and markets, greening and beautification of rural courtyards. Promote the construction of hygienic kitchens, toilets, agricultural equipment storage rooms, agricultural products drying sites and barns, to create a beautiful and clean, harmonious and civilized living environment.

Chapter IV Environmental Health

Article 30 of the urban and rural environmental health administration shall, in accordance with relevant national standards to develop road sweeping, cleaning, and collection, transportation and disposal of domestic garbage and other environmental health operations and supervision and management. Article 34 The people's governments of cities and counties shall establish and improve the market mechanism for urban and rural environmental sanitation operations, and encourage the formation of urban and rural environmental sanitation operation companies, to participate in urban and rural road sweeping, garbage removal, public **** toilet cleaning, maintenance of gardens and green spaces, food waste disposal and other operations.

Article 36 of the market shall be responsible for strengthening market management, reasonable setup of garbage collection containers, keep the field and the surrounding environment clean.

The operators in the town market shall keep the stalls and business premises neat and clean. Catering, agricultural products and other easy to produce garbage stalls should be equipped with garbage collection containers to keep the stalls clean and sanitary.

Article 38 engaged in vehicle repair, cleaning, decoration and recycling of renewable resources, shall comply with the requirements of urban and rural planning, urban and rural landscape management, to keep the business premises and the surrounding environment clean and sanitary, shall not occupy the public **** road and public **** place.

Article 39 of the towns and cities to implement the classification of household garbage, fixed-point collection, unified transportation, centralized disposal.

Construction waste, industrial waste, medical and health care waste, toxic and hazardous waste, hazardous waste and radioactive pollutants shall be disposed of in accordance with national standards, shall not be mixed into the domestic waste collection stations, collection containers and waste disposal sites.

Article 42 The competent departments of the local people's governments at or above the county level in charge of comprehensive urban and rural environmental management shall, in conjunction with the relevant departments, strengthen the planning, construction and management of renewable resources distribution markets and recycling outlets, popularize the knowledge of garbage classification, and promote the recycling of garbage.

Article 43 Units and individuals shall pay the domestic garbage disposal fee in accordance with the provisions. Domestic garbage disposal fees shall be used exclusively for the collection, transportation and disposal of domestic garbage.

Article 44 prohibits any unit or individual in towns and cities to use high-pitched broadcasting speakers, sound equipment, etc. to emit noise exceeding national standards to interfere with the lives of the surrounding residents. Building construction and indoor decoration of houses shall be limited in time, and commercial entertainment establishments shall take effective measures to reduce noise.

Article 45 prohibits the following behaviors affecting the environmental sanitation of the town:

(1) spitting, chewing gum, littering cigarette butts, paper, fruit peels and food packaging and other wastes, and urinating and defecating in the open air;

(2) throwing debris and wastes out of the vehicles or from the buildings;

(3) dumping garbage, sewage, feces and other wastes or placing them in a place other than the designated place; and

(c) Dumping garbage, sewage, feces and other wastes in non-designated places or sweeping or discharging wastes into urban drains or underground pipes;

Chapter V Construction of Facilities

Article 47 The construction of urban and rural environmental sanitation infrastructure shall meet the function of comprehensive urban and rural environmental management. Major urban and rural environmental sanitation infrastructure shall achieve regional *** enjoyment, urban and rural *** enjoyment, to achieve the optimization of major urban and rural environmental infrastructure allocation.

Article 48 The new construction, alteration and expansion of urban and rural environmental sanitation infrastructure, its design shall be examined and agreed upon by the administrative department of housing and urban-rural construction of the local people's government at or above the county level.

Complementary construction of urban and rural environmental sanitation infrastructure shall be designed, constructed and accepted at the same time as the main works of the construction project.

Chapter VI Appraisal and Supervision

Article 55 The comprehensive management of urban and rural environments implements a system of responsibility for the enforcement of the comprehensive management of urban and rural environments and a system of investigation of responsibility for administrative faults.

Local people's governments at or above the county level shall establish a scientific and reasonable performance appraisal system for the comprehensive management of urban and rural environments, and include the comprehensive management of urban and rural environments in the annual appraisal. Article 57 The standing committees of local people's congresses at or above the county level shall strengthen the supervision of the comprehensive management of urban and rural environments by means of law-enforcement inspections, and by listening to and deliberating on special work reports.

Article 58 The news media shall strengthen public opinion supervision of the comprehensive management of the urban and rural environment. (a) not in accordance with the legal procedures for law enforcement;

(b) collection of fines without issuing special receipts;

(c) intentional damage, unauthorized handling or misappropriation of the person concerned;

Chapter VII Legal Liability

Article 61 Where laws and administrative regulations provide for the main body of administrative law enforcement, the relevant administrative law enforcement department shall undertake the administrative law enforcement work; where such laws and administrative regulations do not provide for such work, the competent department for comprehensive urban and rural environmental management shall undertake the relevant administrative law enforcement work in accordance with these Regulations. The relevant administrative law enforcement departments may, in accordance with the law, entrust the competent department for comprehensive urban and rural environmental management to exercise the relevant law enforcement powers.

In case of violation of the provisions of these Regulations, where laws and administrative regulations provide for penalties, such provisions shall apply.

Article 62 The competent department in charge of comprehensive urban and rural environmental management, the relevant competent department and its administrative law enforcement personnel in violation of the provisions of Article 60 of these Regulations, by the competent authority in accordance with the administrative authority of the competent person in charge of the responsibility and other directly responsible personnel, shall be given administrative sanctions in accordance with law; constitutes a crime, shall be held criminally liable in accordance with law.

Article 63 If the person responsible for the comprehensive management of urban and rural environments fails to fulfill his obligations, and the appearance and order of the area of responsibility and environmental sanitation fail to meet the relevant standards, he shall be warned and ordered to make corrections; and if he refuses to make corrections, he may be sentenced to a fine of not less than one hundred but not more than two hundred yuan on an individual basis, or not less than five hundred but not more than two thousand yuan on a unit basis, or he may suggest to his superior authorities that they should impose disciplinary measures on the person directly responsible and his supervisory personnel.

Sixth

Article 64 If a unit or individual has one of the following circumstances, he or she shall be ordered to correct or remove it within a certain period of time; if he or she refuses to correct or remove it, he or she shall remove it on his or her behalf, and the cost shall be borne by the offender. May also be imposed a fine of not less than fifty yuan and not more than two hundred yuan:

(1) violation of the provisions of the first paragraph of Article 19 of these Regulations, unauthorized erection, stacking, hanging items affecting the cityscape;

(2) violation of the provisions of the second paragraph of Article 22 of these Regulations, not in accordance with the provisions of the parking of vehicles;

(3) violation of the provisions of the third paragraph of Article 27 of these Regulations, scribbling, graffiti, graffiti or unauthorized posting of all kinds of propaganda;

(4) violation of the provisions of Article 35, paragraph 2 of these Regulations, raising poultry and livestock in urban residential areas, keeping pets and pigeons affecting environmental hygiene and the normal life of the surrounding residents;

(5) violation of the provisions of Article 36, paragraph 2, and Article 37 of the Regulations on the hygienic management of stalls;

(6) Violation of the noise management provisions of Article 44, paragraph 1 of these Regulations.

Article 65 violation of the provisions of the first paragraph of Article 24 of these regulations, encroachment, destruction, enclosure of garden green space, or violation of the provisions of Article 54 of these regulations damage, theft, occupation of related facilities and equipment, unauthorized closure, dismantling, relocation or change of use, shall be ordered to make corrections within a specified period of time and impose a fine of not less than two thousand yuan to not more than 10,000 yuan, and shall bear the corresponding civil liability according to law; violation of the provisions of the Law of the People's Republic of China on Punishment for Public Security Administration", the public security organs shall be punished; constitutes a crime, shall be investigated for criminal responsibility.

Article 66 violation of the provisions of the second paragraph of Article 25 of these Regulations, the vehicle did not take cover or airtight measures, resulting in leakage of spills or illegal dumping, shall order the removal of correction; on behalf of the removal of the costs borne by the perpetrator of the violation; and impose a fine of one thousand yuan or more than five thousand yuan or less.

Article 67 violation of the provisions of Article 26 of these regulations construction site appearance management, ordered to make corrections within a certain period of time; if not corrected, shall be fined not less than ten thousand and not more than fifty thousand yuan.

Article 68 Violation of the provisions of Article 38 of these Regulations, occupying public **** roads and public **** place to engage in vehicle repair, cleaning, decoration and recycling of renewable resources, and ordered to make corrections, restore the original state, and impose a fine of more than five hundred yuan to less than two thousand yuan.

Article 69 Violation of the provisions of the second paragraph of Article 39 of these regulations special garbage management, shall be ordered to make corrections, take remedial measures, and may also impose a fine of not less than two thousand yuan to not more than ten thousand yuan.

Article 70 violation of the provisions of Article 41, paragraph 2 of these regulations, will be recovered from kitchen waste for the production of products that may be harmful to human health, shall order the cessation of production, confiscate the product and the illegal income, and impose a fine of 20,000 yuan above 100,000 yuan. Causing personal injury, civil liability according to law; constitutes a crime, shall be investigated for criminal responsibility.

Seventy-one units or individuals have one of the provisions of Article 45 of these Regulations affecting the urban and rural environmental health behavior, shall be ordered to correct or remove; refused to correct or remove, remove on behalf of the costs borne by the perpetrator of the violation; the circumstances are serious or serious consequences, and impose a fine of fifty yuan of more than two hundred yuan for an individual, and units of more than 500 yuan of more than two thousand yuan fine.

Article 72 Anyone who refuses or obstructs law enforcement officers in the comprehensive management of urban and rural environments in the performance of their official duties, or insults or beats up any practitioner in the comprehensive management of urban and rural environments in violation of the Law of the People's Republic of China on Punishments for the Administration of Public Security shall be punished by the public security organs; if the violation constitutes a crime, the person concerned shall be held criminally liable in accordance with the law.

Insults and beatings of citizens who dissuade them from violating the law violate the Law of the People's Republic of China on Administrative Punishments for Public Security; they shall be punished by the public security organs; if they constitute a crime, they shall be held criminally liable in accordance with the law.

Chapter VIII Supplementary Provisions

Article 73 The local people's governments at or above the county level may, in accordance with the provisions of these Regulations and in the light of local practice, formulate specific measures.

Article 74 These Regulations shall come into force on October 1, 2011.

At the same time, the Regulations on the Management of Urban Amenities and Environmental Hygiene of Sichuan Province adopted by the Standing Committee of the Eighth Sichuan Provincial People's Congress at its twenty-eighth meeting on August 19, 1997, are hereby repealed.
