Regulations of Yichun Municipality on the Administration of Residential Property

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Civil Law of People's Republic of China (PRC), the Regulations on Property Management of the State Council and other laws and regulations, combined with the actual situation of this Municipality, in order to standardize property management activities, safeguard the legitimate rights and interests of relevant subjects of property management, ensure the lawful, safe and rational use of property, and build a harmonious and livable community. Article 2 These Regulations shall apply to residential property management activities and their supervision and management within the administrative area of this Municipality.

The term "property management" as mentioned in these Regulations refers to the activities that the owners manage themselves or entrust the property service providers to make the same decision, and maintain, conserve and manage the buildings, structures and their supporting facilities and equipment and related sites within the property management area, provide services for the owners, and maintain environmental sanitation and related order. Property service providers include property service enterprises and other property managers. Article 3 The property management of this Municipality adheres to the working pattern of party building leading, government supervision, residents' autonomy, industry self-discipline, multi-party participation, consultation and construction, and scientific and technological support.

Encourage and support owners' committees and property service enterprises to set up party organizations in accordance with the party's articles of association and give play to the leading role of party building. Article 4 The people's governments of cities and counties (cities, districts) shall strengthen the organization and leadership over the supervision and management of property management activities, and incorporate property management into the development plan of modern service industry and the grass-roots social governance system. Establish and improve comprehensive coordination mechanisms such as joint meetings of housing and urban and rural construction, development and reform, urban management, public security, market supervision, fire rescue, natural resources, ecological environment, health and wellness, civil air defense, civil affairs and other departments, and make overall plans to solve major problems in property management. Fifth city and county (city, district) people's government housing and urban and rural construction departments responsible for the supervision and management of property management activities within their respective administrative areas, perform the following duties:

(a) to guide and assist neighborhood offices and Township People's governments in organizing owners' meetings and establishing owners' committees;

(two) to supervise and manage the service quality of the realty service enterprise, the bidding of realty service and the signing of realty service contract;

(three) supervision and management of buildings and ancillary facilities maintenance funds and property quality warranty funds deposited and used;

(4) Accepting and handling complaints against property service enterprises and employees;

(five) to guide the property management industry associations to formulate and implement self-discipline norms;

(six) to perform other duties of supervision and management of property management.

All kinds of development zones (parks), urban new areas, scenic spots and other management institutions shall bear the responsibilities stipulated in the preceding paragraph in accordance with the law within their management areas. Sixth city and county (city, district) people's government departments shall perform the following duties in the supervision and management of property management activities:

(a) the competent department of natural resources is responsible for planning and reviewing the infrastructure and supporting public services included in the planning conditions and design scheme of residential district construction projects, and identifying the behavior of changing the facade, adding stories, expanding or dismantling without authorization in residential decoration activities;

(II) The urban management department shall perform the duties of urban management within the property management area, and investigate and deal with illegal acts such as destroying municipal public facilities, connecting rainwater and sewage wrongly, missing or mixing them into the municipal pipe network, changing the facade, adding floors, expanding, demolishing and changing houses without authorization;

(III) The public security organ is responsible for supervising and inspecting the safety precautions in the property management area, supervising and managing the owners' raising of canine animals, guiding the road parking management in the property management area, and investigating and handling the illegal acts of illegally storing inflammable, explosive, toxic, radioactive and other dangerous goods in the property management area, which affect public safety and public order;

(four) the market supervision and management department is responsible for the safety supervision of special equipment in the property management area, and investigate and deal with illegal acts such as providing false information to obtain the registration of market entities, operating without a license, infringing on the legitimate rights and interests of consumers, and illegal prices in the property management area;

(five) fire rescue agencies responsible for the supervision and inspection of fire safety management within the property management area, and investigate and deal with violations of fire safety laws and regulations;

(six) the competent department of ecological environment is responsible for the supervision and management of environmental protection in the property management area, and investigate and deal with illegal acts such as substandard oil fume emission and noise pollution;

(seven) the health department is responsible for the prevention and control of infectious diseases and the supervision of drinking water hygiene in the property management area;

(eight) the competent department of civil air defense is responsible for the supervision and inspection of the construction and maintenance management of civil air defense projects within the property management area, and investigate and deal with illegal acts such as embezzlement, destruction and disguised sale of civil air defense projects;

(nine) the civil affairs department is responsible for the supervision and inspection of the maintenance and management of community home care service facilities and community management service facilities within the property management area;

(ten) the financial and auditing departments shall be responsible for the supervision and inspection of the management and use of maintenance funds for buildings and their affiliated facilities.

Water supply, power supply, gas supply, communications, cable television and other professional business units and other relevant departments shall perform their corresponding duties according to law. Article 7 Sub-district offices and Township People's governments shall establish the working system of property management in their respective jurisdictions, define the working institutions and management personnel of property management, and perform the following duties:

(a) to guide and coordinate the establishment of the owners' congress and the election of the owners' committee, set up the property management committee, and guide the owners' committee to handle the relevant filing procedures;

(two) to guide and supervise the owners' congress, the owners' committee and its members, and the property management committee to perform their duties according to law, and to revoke their decisions that violate laws and regulations and violate public order and good customs;

(three) to participate in property inspection, guide and supervise the handover and takeover of property management projects;

(four) to guide and coordinate the property service providers to perform their obligations according to law, mediate property management disputes, and coordinate property management activities as a whole;

(five) to supervise and manage the deposit and use of the preparatory funds for the first owners' meeting;

(six) to investigate and deal with illegal acts of occupation and destruction of greening facilities, sanitation facilities and environmental sanitation;

(seven) other duties as prescribed by laws and regulations.

Neighborhood (village) committees carry out specific work under the guidance of neighborhood offices and township people's governments, and assist in handling contradictions and disputes between owners, owners' committees and property service providers; Coordinate and solve the problems in the process of evacuation and handover of property service personnel; Found within the jurisdiction of the violation of property management regulations, should immediately stop, timely report to the relevant departments.
