Xiamen City Prohibition on Smoking in Public Places (revised in 1997)

Article 1: In order to control the harm of smoking, protect the health of citizens, protect the environment, and prevent fires, these regulations are formulated in accordance with the national regulations on health management of public places and in light of Xiamen's actual conditions. Article 2 Smoking is prohibited in the following public places within the jurisdiction of this city:

1. Conference rooms and venues of agencies at all levels, social groups, enterprises and institutions;

2. Theaters, concert halls, song (dance) halls, video projection halls (rooms) and other entertainment venues;

The auditorium and competition hall of the three indoor gymnasiums (fields);

Four books Exhibition halls of museums, museums, art galleries and exhibition halls;

In public transport vehicles such as cars, ships and airplanes, as well as in waiting rooms and elevators;

Six Indoor education places such as classrooms and laboratories in colleges and universities, nurseries, kindergartens and primary and secondary school campuses;

Seven waiting rooms, clinics and wards of medical institutions;

Eight Shopping malls (stores), bookstores, postal and telecommunications, financial, and securities business places.

Smoking is prohibited when entering forest areas and woodlands. Article 3 In public places where smoking is prohibited, smoking rooms (areas) with ventilation equipment must be set up, except for elevator rooms and other unqualified places. Article 4 The unit where a smoking-free place is located shall perform the following responsibilities:

1. Formulate a no-smoking system;

2. Do a good job in publicity and education on no-smoking;

< p>3. Set up eye-catching no-smoking signs in places where smoking is prohibited;

4. Smoking utensils and tobacco advertisements must not be placed in places where smoking is prohibited. Article 5 Passive smokers have the following rights:

1. In places where smoking is prohibited, the right to ask smokers in the place to stop smoking; 2. The right to ask for a ban on smoking The unit where the place is located shall perform the responsibilities specified in Article 4, Item 3, Item 4 and Article 8 of these regulations;

Thirdly, report violations of these regulations to the municipal or district or county health bureau. Article 6 The Xiamen Municipal Health Bureau and the district and county health bureaus are the administrative departments responsible for banning smoking in public places within their jurisdiction. Article 7 Education, culture, environmental protection and other departments as well as news units should carry out publicity and persuasion activities on the harmful effects of smoking on health. Article 8: For smokers in no-smoking places, the unit where the place is located should persuade them to stop smoking immediately or leave the place. Article 9 Anyone who falls under any of the following circumstances shall be punished by the Municipal Health Bureau or the district or county health bureau:

Whoever violates the provisions of Article 2 of these regulations shall be given a warning and may be fined 10 yuan;

2. Anyone who violates the provisions of Paragraph 1 of Article 4 of these Provisions shall be ordered to make corrections within a time limit and be given a warning;

3. Violation of Paragraph 3, Paragraph 4 or Paragraph 4 of Article 4 of these Provisions Those who violate the provisions of Article 8 shall be ordered to make corrections and may be fined not less than 200 yuan but not more than 1,000 yuan. Article 10: Agencies, groups, enterprises, institutions and other organizations may refer to the requirements of these regulations to determine the places where smoking is prohibited within the unit. Article 11 These regulations shall come into effect on the date of promulgation. The "Interim Provisions on Prohibiting Smoking in Public Places of Xiamen City" issued by the Xiamen Municipal People's Government on May 17, 1995, are repealed at the same time.
