Chapter I General Provisions

Chapter II Donation of Human Remains

Article 14 Units meeting the following conditions may become units for accepting human remains upon registration with the provincial Red Cross:

Chapter III Organ Donation

Article 17 A natural person who has reached the age of eighteen and has full capacity for civil behavior may donate living organs, and there shall be written proof of consent to donation before donation. The donation of living organs by the donor shall not jeopardize his or her life.

Natural persons willing to donate organs after death shall have written proof of their consent to donation; if there is only a verbal expression of consent to donation, the following conditions shall be met:

(2) if there is no spouse, there shall be a written proof of his or her parents or adult children as well as two physicians;

(3) there shall be a written proof of his or her parents or adult children as well as two physicians;

Article 24 Individuals who need to receive organ transplants donated by non-close relatives shall apply to the Provincial Red Cross Society or to the Provincial Red Cross Society through the medical institutions with relevant certificates from the medical institutions.

The Provincial Red Cross Society shall register the applicant's application in the chronological order of its receipt, and shall enter the contents of the application into the information database of donated and transplanted organs. The content of the registration shall not be deleted or changed without the written request of the applicant.

Article 25 If the donated organ is used for an unspecified recipient, the Provincial Red Cross shall determine the transplant recipient according to the chronological order of the application for registration in the organ donation and transplantation information database.

When an organ is donated for an unspecified recipient, he or she and his or her close relatives shall have the right of preference in accepting an organ donated by another person for transplantation. If more than two persons have priority, the order shall be determined by the provincial Red Cross according to the time of application for registration.

If the medical institution that performs the transplant surgery considers the recipient unsuitable for transplantation according to the medical technology and the relevant indexes of the donated organ, the provincial Red Cross Society shall determine the recipient of the latter order. In an emergency situation where the donated organ may lose its utilization value, the medical institution may transplant it first and report in writing to the provincial Red Cross within ten days.

Article 26 The provincial health administrative department may access the relevant information in the information bank of donated and transplanted organs and supervise the transplant sequencing. If the parties concerned have objections to the sequencing, they may complain to the provincial health administrative department, which shall investigate and verify the complaint and reply to the complainant in writing within ten days after receiving the complaint.

Chapter IV Legal Liability

Article 27 Violation of the provisions of Article 3, paragraph 3 of these Regulations, the sale of human remains, the administrative department of health shall confiscate the illegal income, and the buyer and seller shall be fined three to five times the amount of the transaction.

In violation of the provisions of paragraph 3 of Article 3 of these Regulations, the sale of organs, the administrative department of health shall confiscate the illegal income, and impose a fine of seven to ten times the amount of the transaction; medical institutions selling organs, shall also be directly responsible for the competent personnel and other directly responsible personnel shall be given sanctions according to law and revocation of their practicing certificates; medical personnel selling organs, shall also be given sanctions according to law and revoke their practicing certificates; for the sale of organs, the health administrative department shall confiscate the illegal income.

Article 29 In case of violation of the provisions of the first paragraph of Article 14 of these Regulations, where a unit that has not been registered with the provincial Red Cross Society accepts human remains, the administrative department of health shall order the cessation of the violation; in case of seriousness of the circumstances, a fine of not less than ten thousand yuan and not more than thirty thousand yuan shall be imposed. The remains accepted in violation of the law shall be arranged by the Provincial Red Cross to be given to qualified units for accepting remains, and the unit accepting the remains in violation of the law shall be responsible for disposing of the remains that cannot be utilized.

Article 32 If, in violation of the provisions of Article 25 of these Regulations, a staff member of the provincial Red Cross Society fails to determine the recipient of a transplanted organ in accordance with the ranking of the applicants, the provincial Red Cross Society shall give administrative sanctions to the department head and the person directly responsible in accordance with law, and shall impose a fine of 10,000 yuan or more than 30,000 yuan or less on the directly responsible person by the provincial administrative department of health.

Article 33 If the administrative departments of health, local Red Cross societies, medical institutions and their staff fail to perform their duties, show favoritism, or abuse their powers in the course of implementing these Regulations, their competent departments or the units in which the staff members are employed shall impose sanctions on the persons in charge and other persons directly responsible according to the law; and if a crime is constituted, the person in charge shall be held criminally liable according to the law.

Chapter V By-laws

Article 34 The close relatives of the donor referred to in these Regulations refer to the donor's spouse, parents, children, brothers and sisters, grandparents, grandchildren and grandchildren.
