(1) Time limit requirements for challenge response
The bidder or bidding agent shall make a response within seven working days after receiving a written challenge from a supplier.
(2) Requirements for the form of the response to the challenge
The response to the challenge shall be notified in writing to the challenger and the other suppliers concerned, provided that the content of the response shall not involve commercial secrets.
(3) Handling of Disagreement with the Bidding and Tendering Challenge Response
If the challenger does not have any disagreement with the challenge response, the current dispute is handled. Article 55 of the Government Procurement Law provides that if the challenger is dissatisfied with the response of the bidder or the bidding agent or if the bidder or the bidding agent fails to make a response within the specified time, he may file a complaint with the government procurement supervision and management department at the same level within 15 working days after the expiration of the response period.
