The municipal road transport management institution is responsible for the specific implementation of road freight transport and freight station (field) management within its administrative area.
Public security, industry and commerce, price, taxation, quality supervision and other relevant administrative departments shall, according to their respective responsibilities, do a good job in the management of road freight transportation and freight stations (fields). Article 5 The term "logistics, distribution and transportation" as mentioned in these Provisions means that operators use small freight vehicles (hereinafter referred to as small logistics and distribution vehicles) with a capacity of less than 2 tons (including 2 tons) to engage in road general cargo transportation activities. Article 6 The Municipal People's Government shall, according to the road freight development plan, the urban road traffic situation and the demand of the road freight market, regulate and control the total amount of small logistics distribution vehicles in urban areas.
Operators who apply to engage in logistics distribution and transportation shall obtain a freight business license according to law. The municipal road transport management institution shall implement service quality bidding and other methods for the business license of logistics, distribution, transportation and freight transportation within the urban area. The implementation of service quality bidding shall follow the principles of openness, fairness and impartiality, and the specific measures shall be formulated by the municipal transportation department. Article 7 A logistics distribution and transportation operator who has obtained a freight business license through service quality bidding shall provide services according to the promised service quality within a certain period of time. After the expiration of the time limit, the logistics distribution and transportation operator shall re-apply for the freight business license before continuing to operate.
Before the implementation of these Provisions, small logistics distribution vehicles that have been put into operation to determine the period of freight business license shall re-apply for freight business license after the expiration of the period of freight business license before continuing to operate. After the small-scale logistics and distribution vehicles with undetermined freight business license period are scrapped, the logistics and distribution operators shall re-apply for the freight business license before they can continue to operate. Eighth to encourage freight taxi operators to integrate existing vehicle resources, and gradually use small logistics distribution vehicles to engage in logistics distribution and transportation.
Freight taxis put into operation before the implementation of these Provisions shall abide by the provisions of the Measures for the Administration of Freight Taxi in Hangzhou. After the expiration of the freight business license of the freight taxi or the scrapping of the vehicle, the freight taxi operator shall re-apply for the freight business license in accordance with the regulations before continuing to operate. Article 9 The business license for logistics, distribution, transportation and freight transportation may be transferred in accordance with the conditions and procedures stipulated by laws and regulations within the validity period. Article 10 The technical conditions and appearance marks of small logistics distribution vehicles approved for delivery according to law shall conform to the unified requirements of the municipal road transport management institution, and their appearance marks shall be kept intact and clean, and shall not be changed at will. Except for freight taxis that have been put into use, small logistics distribution vehicles shall not be equipped with overhead lights and meters.
Other transport vehicles shall not be equipped with or painted with the same or similar appearance signs as small logistics distribution vehicles. Article 11 If a small-scale logistics distribution vehicle is no longer engaged in logistics distribution and transportation, the owner of the small-scale logistics distribution vehicle shall remove the appearance mark, the road transport management institution shall cancel the vehicle operation license, and the traffic management department of the public security organ shall cancel the special number plate of the small-scale logistics distribution vehicle. Twelfth prohibit the use of small logistics vehicles engaged in road passenger transport business activities.
The volume of a single piece of goods carried by a logistics distribution and transportation operator shall not be less than 0.25m3, or its area shall not be less than1.2m2, or its length shall not be less than1.8m, or its weight shall not be less than 40kg, but it shall not exceed the specified volume and weight. Article 13 The traffic administrative department of the municipal public security organ shall issue special number plates to licensed small-scale logistics distribution vehicles, and consider their reasonable traffic when implementing road traffic management, so as to provide convenience for their traffic and parking of loading and unloading goods.
Commercial buildings, supermarkets, specialized markets and commercial buildings with frequent freight demand shall set up necessary special berths for loading and unloading goods within their business areas. If there is no condition to set up a special berth for loading and unloading goods in the business area, with the permission of the relevant administrative department according to law, you can temporarily stop at the nearby branch road or sidewalk to load and unload goods during off-peak hours. Article 14 Enterprises, institutions and individual transport operators shall apply for road transport business license and vehicle business license for freight vehicles produced and operated by their own units, but shall not engage in transport business activities other than serving their own production and operation. The driver shall obtain the qualification certificate. Fifteenth road transport operators of special vehicles for dangerous goods shall install and use driving recording equipment, and establish a sub-platform of driving recording equipment, equipped with specialized personnel responsible for monitoring.
Special vehicles for dangerous goods shall be equipped with safety cards suitable for the transported dangerous goods. The safety card shall specify the name, danger, storage and transportation requirements, protective measures, leakage treatment methods and fire fighting methods of the transported dangerous goods, as well as the contact numbers of safety supervision, fire fighting, chemical first aid, medical first aid, environmental protection, traffic police and other departments and operators.
