"Chapter II Scope of Tendering
Article VIII The following procurement of electromechanical products must be subjected to international tendering:
(1) the relationship between the interests of the social public ****, the public's safety, infrastructure, public utilities, and other projects in the international procurement of electromechanical products, the specific Scope see Annex 1; (B) all or part of the use of state-owned investment projects for international procurement of electromechanical products; (C) all or part of the use of state-financed projects for international procurement of electromechanical products; (D) the use of international financial organizations, or foreign governments, loans, aid funds (hereinafter referred to as foreign loans) in the project for international procurement of electromechanical products; (E) government procurement projects for international procurement of electromechanical products;(F) other in accordance with the provisions of laws and administrative regulations require international bidding for the procurement of electromechanical products.Article IX of the scope of bidding listed in Article 8, is one of the following cases, you can not carry out international bidding:
(a) (i) foreign gifts or gratuitous assistance in electromechanical products; (ii) for the production of spare parts and components; (c) the old electromechanical products; (d) 1 procurement of products in the contract price of less than 1 million yuan; (e) foreign-invested enterprises within the total amount of investment in imported electromechanical products;(f) for production enterprises and scientific research institutions for research and development of samples and prototypes;(g) the State Council to determine the special products or specific industries as well as in response to major national emergencies need electromechanical products;(h) the product manufacturer preferential supply, the preferential amount of more than 50 percent of the estimated contract price of the product 50% of electromechanical products; (ix) for the production of special molds needed for production enterprises; (x) for product maintenance parts and components; (xi) in accordance with the provisions of laws and administrative regulations, other electromechanical products are not suitable for international bidding procurement."Check the statute for details.
