Measures for the Management of Kitchen Waste in Hebei Province (2019 Amendment)

Chapter I General Provisions Article 1 In order to strengthen the management of kitchen waste, promote the recycling of resources and the harmless treatment of kitchen waste, and safeguard food safety and public health, these Measures are formulated in accordance with the "Regulations on Urban Amenities and Environmental Hygiene of Hebei Province" and relevant laws and regulations, and in the light of the actual situation in this province. Article 2 These Measures shall apply to the generation, collection, transportation, disposal of kitchen waste and its related management activities within the administrative area of the province. Article 3 The kitchen waste referred to in these measures refers to food processing, catering services, collective feeding and other activities other than the daily life of residents in the food residues and waste edible oil and grease and other waste.

The waste edible oil and grease referred to in the preceding paragraph refers to non-edible animal and plant fats and oil-water mixtures. Article 4 The governance of kitchen waste, follow the principles of minimization, resource utilization and harmlessness. Article 5 The provincial people's government departments in charge of housing and urban-rural construction is responsible for the supervision and management of kitchen waste in the province.

The municipal and county (city) people's government of the city and environmental health department is responsible for the supervision and management of food waste in the administrative area.

The people's governments at or above the county level development and reform, ecological environment, transportation, natural resources, market supervision and management, finance, commerce, agriculture and rural areas, public security and other relevant departments in accordance with their respective responsibilities, to do a good job in the supervision and management of food waste. Article 6 The people's governments above the county level shall support the construction of kitchen waste disposal facility projects. Take a variety of measures to encourage through the net listing, improve food processing technology, saving meals, etc., to reduce the generation of kitchen waste; through economic and technological means, to promote the resourceful utilization of kitchen waste and harmless treatment. Actively promote the collection, transportation and disposal of kitchen waste market-oriented mode of operation. Article 7 kitchen waste collection, transportation and disposal costs in the urban life of waste disposal fees, the shortfall in the local people's government appropriate subsidies, and organizations to develop integrated solutions. Chapter III Collection and Transportation Article 14 For the collection and transportation of kitchen waste, it shall be approved by the municipalities in the districts and counties directly under the control of the province (cities), the competent departments of cityscape and environmental sanitation, obtain a license certificate, and have the following conditions:

(1) the applicant is a legally registered corporate legal person, with a registered capital of not less than three million yuan;

(2) there are with the function of classified collection of fully closed special collection containers;

(c) more than ten special vehicles for the transportation of kitchen waste with the functions of odor diffusion prevention, anti-spill and anti-drip;

(d) a fixed office and machinery, equipment, vehicle parking space;

(e) other conditions stipulated by laws and regulations.

Without approval, any unit or individual shall not engage in kitchen waste collection and transportation activities. Article XV of the municipal, county (city) people's government in principle through bidding and other fair competition to determine the kitchen waste collection and transportation enterprises, and signed with them kitchen waste collection and transportation agreement. Kitchen waste collection and transportation agreement should be clearly agreed upon business period, service standards, liability for breach of contract and so on. Article XVI of kitchen waste generation unit shall comply with the following provisions:

(a) the classification of kitchen waste storage;

(b) set up to meet the standards of kitchen waste collection containers and maintain normal use;

(c) the generation of waste edible oil and grease, the installation of oil and water separators or grease traps in line with the relevant technical requirements, and other pollution prevention and control equipment;

(d) the collection and transportation agreement shall clearly agree on the operating period of service standards and other contractual obligations. p>

(d) the establishment of kitchen waste generation ledger, and at the end of each month to the local amenities and environmental health departments to report on the type and quantity of monthly kitchen waste;

(e) kitchen waste shall not be dumped, piled up, shall not be put or discharged into the domestic garbage collection facilities, sewage drains, storm drains, and other municipal public **** facilities, and rivers, channels, Lakes, reservoirs and other places;

(f) food waste shall not be sold, dumped;

(g) and food waste collection and transportation enterprises to sign a written agreement within 24 hours after the generation of food waste to food waste to its agreement with the collection and transportation of food waste enterprises, shall not be handed over to other enterprises or individuals to collect and transport food waste.
