Units that have obtained the license for comprehensive operation of hazardous wastes may engage in the collection, storage and disposal of all kinds of hazardous wastes; Units that receive the license for hazardous waste collection and operation can only engage in hazardous waste collection and operation activities of waste mineral oil generated in motor vehicle maintenance activities and waste cadmium-nickel batteries generated in residents' daily lives. Article 4 The competent department of environmental protection of the people's governments at or above the county level shall be responsible for the examination and approval, issuance, supervision and management of hazardous waste business licenses in accordance with the provisions of these Measures. Chapter II Conditions for Applying for a Hazardous Waste Business License Article 5 To apply for a comprehensive business license for the collection, storage and disposal of hazardous wastes, the following conditions shall be met:
(a) there are more than three technicians with intermediate titles in environmental engineering or related majors and more than three years of experience in solid waste pollution control;
(two) there are means of transport that meet the safety requirements for the transport of dangerous goods in the State Council;
(3) Having packaging tools, transit and temporary storage facilities and equipment that meet the national or local environmental protection standards and safety requirements, as well as storage facilities and equipment that have passed the acceptance;
(4) Having disposal facilities, equipment and supporting pollution prevention facilities that conform to the national or provincial, autonomous region or municipality directly under the Central Government's planning for the construction of hazardous waste disposal facilities and meet the national or local environmental protection standards and safety requirements; Among them, the centralized medical waste disposal facilities should also meet the national health standards and requirements for medical waste disposal;
(5) It has disposal technologies and processes suitable for the types of hazardous wastes it deals in;
(six) rules and regulations, pollution prevention measures and accident emergency rescue measures to ensure the safety of hazardous waste management;
(seven) to dispose of hazardous waste by landfill, the land use right of landfill shall be obtained according to law. Article 6 To apply for a hazardous waste collection and operation license, the following conditions shall be met:
(a) rain-proof, anti-leakage means of transport;
(2) Having packaging tools, transit and temporary storage facilities and equipment that meet the national or local environmental protection standards and safety requirements;
(3) Having rules and regulations, pollution prevention measures and accident emergency rescue measures to ensure the safety of hazardous waste management. Chapter III Procedures for Applying for and Obtaining Business License for Hazardous Wastes Article 7 The State shall examine, approve and issue business licenses for hazardous wastes at different levels.
The hazardous waste business license of the following units shall be approved and issued by the competent department of environmental protection of the State Council:
(1) Burning more than 654.38 million tons of hazardous waste every year;
(2) Disposal of hazardous wastes containing polychlorinated biphenyls and mercury that pose a great threat to the environment and human health;
(three) the use of comprehensive centralized disposal facilities included in the national hazardous waste disposal facilities construction plan to dispose of hazardous waste.
The hazardous waste business license of the centralized medical waste disposal unit shall be approved and issued by the competent environmental protection department of the Municipal People's Government where the centralized medical waste disposal facility is located.
Hazardous waste collection and operation license shall be approved and issued by the competent department of environmental protection of the people's government at the county level.
Hazardous waste business licenses other than those specified in the second, third and fourth paragraphs of this article shall be issued by the competent environmental protection departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government. Article 8 An entity applying for a hazardous waste business license shall submit an application to the issuing authority before engaging in hazardous waste business activities, and attach the certification materials that meet the conditions stipulated in Article 5 or Article 6 of these Measures. Article 9 The issuing authority shall, within 20 working days from the date of accepting the application, examine the certification materials submitted by the applicant and conduct on-site inspection of the applicant's business facilities. In line with the conditions, the hazardous waste business license shall be issued and announced; Do not meet the conditions, notify the applicant in writing and explain the reasons.
Before issuing a hazardous waste business license, the issuing authority may, according to actual needs, solicit opinions from relevant competent departments and experts such as health, urban and rural planning. The applicant shall go through the registration formalities with the administrative department for industry and commerce with the hazardous waste business license. Tenth hazardous waste business license includes the following main contents:
(1) The name, legal representative and domicile of the legal person;
(2) Management mode of hazardous waste;
(3) Types of hazardous wastes;
(4) Annual business scale;
(5) Term of validity;
(6) Date of issuance and certificate number.
The contents of the license for comprehensive operation of hazardous wastes shall also include the addresses of storage and disposal facilities. Article 11 Where a hazardous waste business unit changes its legal person name, legal representative and domicile, it shall, within 15 working days from the date of industrial and commercial change registration, apply to the original issuing authority for changing the hazardous waste business license.
