Supervisory duties of the Administrative Measures for Environmental Protection of Electromagnetic Radiation

The competent administrative department of environmental protection of the State Council is responsible for the environmental protection declaration and registration of the following construction projects and the examination and approval of the environmental impact report, and is responsible for the inspection of the simultaneous design, simultaneous construction, simultaneous commissioning (hereinafter referred to as the "three simultaneities" system) and completion acceptance of the environmental protection facilities of the project:

(1) TV towers with total power exceeding 200 kilowatts;

(2) Radio stations and stations with a total power of 1000 kW or more;

(three) electromagnetic radiation construction projects across provincial administrative regions;

(4) Construction projects above the limit of electromagnetic radiation prescribed by the state. The competent department of the unit engaged in electromagnetic radiation activities shall urge its subordinate units to abide by the national environmental protection laws and standards, strengthen the leadership over the electromagnetic radiation environmental protection work of its subordinate units, and be responsible for the pre-examination of the environmental impact report (table) of electromagnetic radiation construction projects and equipment.

Any unit or individual engaged in electromagnetic radiation activities shall abide by and implement the national environmental protection guidelines, policies, regulations, systems and standards, and accept the supervision, management and inspection of electromagnetic radiation environmental protection work by the environmental protection department; Do a good job in preventing and controlling environmental pollution caused by electromagnetic radiation activities.

Eleventh units and individuals engaged in electromagnetic radiation activities, before applying for the approval of construction projects or before purchasing equipment, must go through the formalities of environmental protection declaration and registration with the competent administrative department of environmental protection that has the power to examine and approve environmental impact reports (forms).

After accepting the declaration and registration of environmental protection, the competent administrative department of environmental protection with the power of examination and approval shall notify the units or individuals engaged in electromagnetic radiation activities of the accepted written opinions within 30 days, and send a copy of the accepted opinions to the relevant competent departments and the competent administrative department of environmental protection where the project is located.

Article 12 The competent administrative department of environmental protection with the power of examination and approval shall make the following opinions on the declaration and registration of environmental protection according to the development plan of the city where the declared electromagnetic radiation construction project is located, the scale of the electromagnetic radiation construction project and equipment, and the environmental protection requirements of the region where it is located:

(a) prohibit the construction or purchase of electromagnetic radiation construction projects and equipment that are seriously polluted, backward in technology and equipment, waste resources and seriously damage the ecology;

(2) To require units or individuals engaged in electromagnetic radiation activities to go through the formalities for examination and approval of environmental impact statements for electromagnetic radiation construction projects that meet the urban development planning and the inspection-free level or above;

(3) For electromagnetic radiation equipment in industrial, scientific and medical applications, units or individuals engaged in electromagnetic radiation activities need to go through the formalities for examination and approval of environmental impact reports.

Thirteenth provincial environmental protection administrative department is responsible for confirming the exemption level of electromagnetic radiation construction projects and equipment according to the relevant national standards for electromagnetic radiation protection.

Article 14 Before the implementation of these Measures, the electromagnetic radiation construction projects that have been completed or under construction but have not yet fulfilled the environmental protection declaration and registration procedures, or the electromagnetic radiation equipment that has been purchased but has not yet fulfilled the environmental protection declaration and registration procedures, are listed in the Catalogue of Electromagnetic Radiation Construction Projects and Equipment, and must go through the environmental protection declaration and registration procedures. Those that do not meet the environmental protection standards and are seriously polluted should take remedial measures, and those that are difficult to remedy should be closed down or relocated according to law.

Article 15 Where an environmental impact report (table) must be prepared in accordance with the regulations, units or individuals engaged in electromagnetic radiation activities must evaluate the possible environmental impact caused by electromagnetic radiation activities, prepare an environmental impact report (table), and report it to the corresponding environmental protection administrative department for examination and approval according to the prescribed procedures.

The environmental impact report of electromagnetic radiation is compiled in two stages. The preparation of the first phase of the feasibility phase environmental impact report must be completed before the approval of the construction project. In the second stage, the preparation of the environmental impact report in the actual operation stage must be completed before the completion and acceptance of environmental protection facilities.

Electromagnetic radiation equipment in industrial, scientific and medical applications must complete the preparation of environmental impact report before use.

Sixteenth units engaged in electromagnetic radiation activities shall put forward preliminary opinions on the environmental impact report (table); The competent administrative department of environmental protection with the power of examination and approval shall, within 180 days from the date of receiving the environmental impact report (form) and the preliminary examination opinions of the competent department, put forward opinions or requirements for examining and approving the environmental impact report (form). If no comments or requests are made within the time limit, it shall be deemed that the environmental impact report (form) has been approved.

Any electromagnetic radiation equipment that has passed the examination and approval of the environmental impact report (form) shall not change the approved power without authorization. If it is really necessary to change the approved power, the environmental impact report (table) of electromagnetic radiation shall be re-compiled, and submitted to the original examination and approval department for re-examination and approval according to the prescribed procedures.

Seventeenth units engaged in environmental impact assessment of electromagnetic radiation must hold the corresponding professional evaluation qualification certificate.

Eighteenth electromagnetic radiation construction projects and equipment environmental impact report (table) to determine the need for supporting the construction of environmental protection facilities to prevent and control electromagnetic radiation pollution, we must strictly implement the "three simultaneous" system of environmental protection facilities.

Nineteenth units and individuals engaged in electromagnetic radiation activities must abide by the provisions of the state on the management of the completion and acceptance of environmental protection facilities. Before electromagnetic radiation construction projects and equipment are put into production and use, an application for completion and acceptance of environmental protection facilities shall be submitted to the competent administrative department of environmental protection that originally approved the environmental impact report (form), and the acceptance application report, the two-stage environmental impact report required by Article 15 and other relevant materials shall be submitted as required. Those who pass the acceptance shall be approved by the competent administrative department of environmental protection, and the environmental acceptance certificate of electromagnetic radiation shall be issued.

Twentieth units and individuals engaged in electromagnetic radiation activities must regularly check the performance of electromagnetic radiation equipment and its environmental protection facilities, find hidden dangers in time and take remedial measures in time.

Large-scale electromagnetic radiation emission facilities or high-frequency equipment are concentrated in the surrounding areas, and sensitive buildings such as residential buildings and kindergartens shall not be built in the planning restricted areas designated according to the requirements of environmental protection and urban planning.

Article 21 The main tasks of electromagnetic radiation environmental monitoring are:

(1) Monitoring the electromagnetic radiation level in the environment;

(2) Supervising and monitoring pollution sources;

(three) to monitor the environmental protection facilities that have been completed and accepted;

(four) to provide relevant monitoring data for the preparation of electromagnetic radiation environmental impact report (table) and environmental quality report;

(five) to provide monitoring data for the collection of sewage charges or the handling of electromagnetic radiation environmental pollution cases, and to carry out other monitoring related to electromagnetic radiation environmental protection.

Article 22 The transmitting equipment of electromagnetic radiation construction projects must operate in strict accordance with the frequency range and rated power approved by the State Radio Regulatory Commission.

Electromagnetic radiation equipment used in industry, science and medical treatment must meet the requirements of Radio Interference Limits promulgated by the state and relevant departments.
