Implementation Measures for Social Pension Insurance for Urban and Rural Residents in Wancheng District
Chapter 1 General Provisions
Article 1: Based on the "Implementation Opinions of the Henan Provincial People's Government on the Pilot Program of Social Pension Insurance for Urban and Rural Residents" (Yuzheng [2011] No. 58) and in combination with the actual situation of our district, these implementation measures are formulated.
Article 2 The basic principles of the pilot social pension insurance for urban and rural residents are “basic protection, wide coverage, flexibility, and sustainability.” First, starting from the actual situation of urban and rural residents, starting from a low level, financing standards and treatment standards must be compatible with economic development and the affordability of all aspects; second, individuals (families) and the government reasonably share responsibilities, and rights and obligations correspond; third, It is a combination of government leadership and residents' voluntariness to guide urban and rural residents to universally participate in insurance; fourth, social pension insurance for urban and rural residents implements territorial management.
Article 3 establishes a social pension insurance system for urban and rural residents that combines individual contributions, government subsidies, collective subsidies, and other economic organizations, social organizations, and individuals to provide financial assistance to insured persons, and implements social coordination and individual Accounts are combined with other social security policies and measures such as family pension, land security, social assistance, and social welfare to ensure the basic living standards of urban and rural residents in the elderly.
Chapter 2 Insurance Scope
Article 4 Rural residents who are over 16 years old (excluding school students) and have not participated in the basic employee pension insurance and are not eligible for the basic employee pension insurance Urban non-employed residents who meet the insurance requirements can voluntarily participate in the social pension insurance for urban and rural residents in their place of residence.
Article 5 Urban and rural residents who meet the insurance conditions must bring their household registration book, original resident ID card and other materials to the human resources and social security service station of the town (street) where their household registration is located to apply for insurance and register.
Chapter 3 Fund Raising
Article 6 The social pension insurance fund for urban and rural residents is mainly composed of individual contributions, government subsidies, collective subsidies and other economic organizations, social organizations and individuals. Subsidies provided by individual contributions.
Article 7: Individual payment. Residents participating in the social pension insurance for urban and rural residents shall pay pension insurance premiums in accordance with regulations. The payment standards are currently set at 12 levels: 100 yuan, 200 yuan, 300 yuan, 400 yuan, 500 yuan, 600 yuan, 700 yuan, 800 yuan, 900 yuan, 1,000 yuan, 1,500 yuan, and 2,000 yuan per year. The insured can choose the payment level independently, and the more he pays, the more he will get.
The district government shall adjust the payment levels in a timely manner in accordance with the unified arrangements and prescribed procedures of the province, combined with the economic development of the district and the income growth of urban and rural residents.
The payment year for social pension insurance for urban and rural residents is from January 1 to December 31 of each natural year. After the insured person pays the premium, the handling agency must issue a payment voucher to the insured person in a timely manner.
Article 8 Government subsidies. The government shall fully pay the basic pension of the social pension insurance for urban and rural residents to the insured persons who meet the conditions for receiving benefits. Basic pensions are subsidized by the central finance and district finance respectively according to determined standards.
The provincial and municipal finance levels subsidize the insured persons’ payment. The provincial finance subsidy is 20 yuan per person per year, and the provincial and municipal finance subsidies are 10 yuan per person per year.
The district finance department will pay an annual pension insurance premium of 100 yuan for each person with severe disabilities; for the surviving family members of martyrs who participate in the insurance payment, parents of only children aged 45-59 who received the certificate, and parents of two daughters under rural family planning The annual subsidy is 100 yuan per person.
Payment subsidies provided by finance at all levels to insured persons cannot offset individual contributions.
Article 9: Village collectives that meet the conditions shall provide subsidies to insured persons for their contributions, and the subsidy standards shall be democratically determined by the village committee at a village meeting. Encourage other economic organizations, social organizations, and individuals to provide subsidies for insured persons’ premium payments.
Chapter 4 Establishing Personal Accounts
Article 10 The district social pension insurance agency for urban and rural residents shall establish a personal pension insurance account with lifelong records for each insured person.
Individual contributions, collective subsidies and other economic organizations, social welfare organizations, and individuals' contributions to the insured's contributions, as well as the payment subsidies provided by governments at all levels to the insured's contributions, are all credited to individual accounts, fully accumulated, and implemented in one step.
Article 11 The amount of personal account deposits shall be calculated with reference to the one-year RMB deposit interest rate of financial institutions announced annually by the People's Bank of China.
Chapter 5 Pension Benefits
Article 12 Pension benefits consist of basic pension and personal account pension, and are paid for life.
The basic pension standard is 60 yuan per person per month, of which the basic pension standard determined by the central government is 55 yuan per person per month; the basic pension standard determined by the district is 5 yuan per person per month.
The district finance subsidizes the basic pension of 10 yuan per person per month for the survivors of martyrs who meet the conditions for receiving benefits, parents of only children who receive certificates, and parents of two daughters under rural family planning.
The monthly calculation and payment standard for personal account pensions is the total amount of savings in the personal account divided by 139 (the same as the current personal account pension calculation coefficient of the current basic pension insurance for urban enterprise employees).
Article 13. When an insured person dies, the balance of the funds in the personal account, except for government subsidies, will be paid to the legal heir or designated beneficiary in one lump sum; if there is no legal heir or designated beneficiary, the funds in the personal account will be paid to the legal heir or designated beneficiary. The remaining balance is used to continue paying pensions to other insured persons.
Chapter 6 Conditions for Receiving Pension Benefits
Article 14 Residents participating in the social pension insurance for urban and rural residents who are over 60 years old can receive monthly pensions.
When the social pension insurance system for urban and rural residents is implemented, those who are over 60 years old and do not enjoy the basic pension insurance benefits for employees and other pension benefits stipulated by the state do not need to pay. However, children of rural residents who meet the insurance conditions should participate in the insurance and pay premiums.

The back payment should be based on the payment standard of the year of back payment. Article 17 The social pension insurance fund for urban and rural residents shall be included in the special financial account of the social security fund, and management of revenue and expenditure shall be implemented on two lines, with separate accounting and accounting, and preservation and appreciation of value shall be achieved in accordance with relevant regulations. Basic pensions and personal account pensions must be managed in separate accounts and must not be mixed. Chapter 9 Fund Supervision
Article 18 The District Human Resources and Social Security Bureau must effectively perform its supervisory duties on the social pension insurance funds for urban and rural residents, and formulate and improve the social pension insurance funds for urban and rural residents. Article 19 District social pension insurance agencies for urban and rural residents must regularly disclose information on the collection and payment of social pension insurance funds for urban and rural residents, be open and transparent, and accept social supervision. Article 20 The District Human Resources and Social Security Bureau must take effective measures to prevent false claims and other illegal and disciplinary phenomena from occurring. Chapter 10 Handling and Management Services

Chapter 11: Connection of relevant systems

Chapter 12 Strengthening Organizational Leadership

Chapter 13 Supplementary Provisions
