Tangshan City, urban residents of the implementation of the minimum subsistence guarantee

Article 1 In order to standardize the system of minimum subsistence guarantee for urban residents, to protect the basic life of urban residents in difficulty in the city, according to the State Council's "Regulations on Minimum Subsistence Guarantee for Urban Residents" and "Implementing Measures for the Minimum Subsistence Guarantee for Urban Residents in Hebei Province", in conjunction with the actual situation of the city, to formulate the present measures.
Second, in the city's administrative area with permanent non-agricultural household registration, per capita monthly income of family members is lower than the local minimum subsistence standards of the family, can be in accordance with these measures to enjoy the minimum subsistence guarantee.
Article 3 The minimum subsistence guarantee for urban residents is implemented by the people's governments at all levels.
Cities, counties (cities), districts and civil affairs departments are specifically responsible for the management of the minimum subsistence guarantee for urban residents in their respective administrative areas; cities, counties (cities), districts and other departments of finance, statistics, pricing, auditing, labor security, etc., are responsible for the work of the minimum subsistence guarantee for urban residents within their respective areas of responsibility.
Street offices and township (township) people's governments are responsible for the specific management of the minimum subsistence guarantee for urban residents.
Community residents' committees (including residents' committees or family committees and villagers' committees) are entrusted by the civil affairs departments with the day-to-day service of the minimum subsistence guarantee for urban residents.
Article 4 The minimum subsistence guarantee system for urban residents adheres to the principle of combining government protection with social assistance and encouraging self-help through labor.
Article 5 The people's governments at all levels shall strengthen the construction of institutions for the minimum subsistence guarantee for urban residents and ensure the necessary funding for their work.
Article 6 The funds required for the minimum subsistence guarantee for urban residents shall be included in the financial budget by the people's governments at the same level, and shall be managed in special accounts and earmarked for specific purposes.
Article 7 Any unit or individual shall have the right to report to the civil affairs department or other relevant departments any violation of the provisions relating to the minimum subsistence guarantee for urban residents.
Article 8 The minimum living standard for urban residents shall be formulated by the civil affairs departments of the cities and counties (municipalities) in conjunction with the departments of finance, statistics and prices at the same level, in accordance with the costs of clothing, food and housing necessary for the basic living of the urban residents in the locality, and with due regard to the costs of water, electricity and gas (coal-fired), as well as the costs of education for minors, and shall be implemented after approval by the people's government of the respective level.
When the minimum subsistence guarantee standard for urban residents needs to be adjusted, it shall be re-approved in accordance with the preceding paragraph.
Article 9 The family refers to the organization of social life among relatives with a legal relationship of alimony, support and fostering based on the legal facts of marriage, blood or adoption.
The family consists of the following members:
(1) husband and wife;
(2) parents or adult children living with them;
(3) minor children or adult children studying in overseas institutions who need to be supported by their parents without wage income;
(4) other persons with alimony, support and fostering relationships as stipulated by law.
Article 10: The income of family members includes the following:
(1) wages, bonuses, allowances, subsidies, etc.
(2) retirement benefits, severance pay, basic living expenses of laid-off workers, lump-sum economic compensation for the termination of a labor contract, unemployment insurance premiums, and subsidies to survivors of the worker;
(3) alimony, support, and fostering;
(4) other persons who have a relationship of support as stipulated by law. p>
(iv) other family income that should be calculated.
Periodic pensions, periodic rationed subsidies, disability pensions (health care), and preferential treatments enjoyed by the beneficiaries are not included in the calculation of family income.
Article 11 The per capita monthly income of family members is calculated on the basis of actual income.
(1) The actual income of an employed worker is calculated according to the standard wage of the employer or the amount agreed upon in the labor contract;
(2) The actual income of a laid-off, unemployed, or recipient of retirement or severance pay is calculated in accordance with the relevant standards announced by the government;
(3) During the period of time when laid-off and unemployed persons are receiving the basic subsistence allowance or the unemployment insurance premium, they themselves also have other income, or if the jobless person is self-employed, they shall be calculated according to the local minimum wage standard determined by the province.
Article 12: In order to apply for the minimum subsistence guarantee, an urban resident shall submit an application to the local community residents' committee and provide the following supporting materials:
(1) an application form;
(2) proof of household registration and proof of family income;
(3) other certificates relevant to the matter being examined and approved.
Article 13 The community residents' committee shall, within seven days after receiving the application, investigate and verify the applicant's family's economic situation and actual living standard, and after discussion and approval by the residents' representatives, report it to the street office or township (township) people's government for examination and approval.
The street office or township (township) people's government shall, upon receipt of the application materials, complete the publicity and audit within fifteen days, and report the audit opinion to the civil affairs department of the people's government at the county level for approval.
The civil affairs department of the people's government at the county level shall, within seven days, make a decision on whether or not to authorize the application of the applicant for minimum subsistence allowance. If the applicant meets the conditions, he or she shall be issued a Certificate of Receipt of Minimum Subsistence Guarantee for Urban Residents of Tangshan City; if he or she does not meet the conditions, he or she shall be notified in writing and given reasons.
Article 14: The payment of the guaranteed minimum subsistence allowance to residents who have been approved to enjoy the minimum subsistence allowance shall be made in accordance with the following provisions:
(1) For urban residents who have no family income, full subsidies shall be given in accordance with the minimum subsistence allowance standard for local urban residents;
(2) For urban residents who still have some income but whose family income does not reach the minimum subsistence allowance standard, differential subsidies shall be given in accordance with the minimum subsistence allowance standard for local urban residents. minimum subsistence guarantee standard to give differential subsidies.
Article 15 No one shall be entitled to the minimum subsistence guarantee in any of the following cases:
(1) Where the actual standard of living of the family is significantly higher than the local minimum subsistence guarantee standard;
(2) Where the applicant and his/her family members refuse to cooperate with or do not cooperate with the staff of the minimum subsistence guarantee in investigating and verifying the relevant situation;
(3) Where a laid-off person who has the ability to work, unemployed or jobless persons who have the ability to work do not accept the introduction of employment by labor service agencies twice.
Article 16 Urban residents shall be entitled to the minimum subsistence guarantee for urban residents from the month following the month in which the approval of the civil affairs department is obtained, and the guarantee shall be paid monthly by the street office or township (township) people's government.
Article 17 If there is a change in the income of a family enjoying the guarantee, it shall take the initiative to report the change to the community residents' committee.
The street office or township (township) people's government shall organize a quarterly review of the guaranteed families by the community residents' committee. For those who do not meet the conditions, the civil affairs department at the county level shall approve the suspension of the payment of the guarantee and withdraw or cancel their "Tangshan City Urban Residents' Minimum Subsistence Guarantee Receipt Certificates"; for those who still meet the conditions but whose family incomes have changed, the procedures for the reduction and increase of the guarantee shall be carried out in accordance with the procedures.
Article 18 The street offices, township (township) people's governments or community residents' committees shall establish and improve the public welfare activity stations and points for the recipients of the minimum subsistence guarantee, and organize public welfare activities or labor at least once a month.
Urban residents of working age who are capable of working but are not yet employed shall, during the period in which they are enjoying the minimum subsistence guarantee for urban residents, participate in the public welfare activities or labor regularly organized by the community residents' committee of the community in which they live.
If a recipient of the minimum subsistence guarantee fails to participate in community-based activities or labor for two consecutive times without a valid reason, his or her family's monthly guarantee shall be cancelled.
Article 19 The urban minimum subsistence guarantee recipients shall be entitled to the following treatments with the Certificate of Receipt of Minimum Subsistence Guarantee for Urban Residents of Tangshan City and their ID cards:
(1) If their children go to school, they shall be reduced or exempted from the payment of miscellaneous fees;
(2) If they go to hospitals, they shall be exempted from the payment of registration fees, and shall be entitled to the treatment of poverty alleviation wards.
Article 20 Any staff member of the Minimum Subsistence Guarantee for Urban Residents who commits any of the following acts shall be subject to administrative sanctions by the civil affairs department or the supervisory department; if he or she is suspected of committing a crime, he or she shall be transferred to the judicial organs for handling:
(1) If he or she fails to sign a consenting opinion on a family that meets the conditions for enjoying the Minimum Subsistence Guarantee for Urban Residents without any justification or if he or she intentionally signs a consenting opinion on a Families intentionally signing the consent opinion;
(ii) falsely declaring or fraudulently claiming the guaranteed benefits;
(iii) neglecting their duties, practicing favoritism and malpractice, or embezzling, misappropriating, withholding, or defaulting on the payment of the guaranteed minimum living expenses for urban residents.
Article 21 If a resident enjoying the minimum subsistence guarantee for urban residents commits any of the following acts, the civil affairs department of the people's government at the county level shall give him or her criticism and education, and recover the guarantee money he or she has fraudulently claimed; and in the case of aggravating circumstances, he or she shall be punished by a fine of not less than twice and not more than three times the amount of the money he or she has fraudulently claimed:
(1) adopting false reporting, concealment, forgery, or other means to fraudulently enjoy the minimum subsistence guarantee for urban residents
(ii) failing to inform the management and approval authorities of any improvement in family income during the period of enjoyment of the minimum subsistence guarantee for urban residents, and continuing to enjoy the minimum subsistence guarantee for urban residents.
Article 22 Units or individuals who provide false certificates for urban residents applying for the minimum subsistence guarantee shall be warned by the civil affairs department of the people's government at the county level, and may be fined not more than one thousand yuan.
Article 23 Anyone who is dissatisfied with the decision made by the civil affairs departments of the people's governments at the county level not to approve the enjoyment of the minimum subsistence guarantee for urban residents, or to reduce or suspend the issuance of the minimum subsistence guarantee for urban residents, as well as with the administrative penalties imposed on them, may apply for an administrative reconsideration in accordance with the law; and if he or she is still dissatisfied with the decision of the reconsideration, he or she may bring an administrative lawsuit according to law.
Article 24 Anyone who insults or beats up a staff member of the Minimum Subsistence Guarantee for Urban Residents, disrupts the order of the office, or refuses or obstructs a staff member of a state organ in the performance of his or her official duties in accordance with law shall be punished by the public security organs in accordance with the "Regulations of the People's Republic of China on Public Security Administration Punishments"; any person suspected of committing a crime shall be referred to the judicial organs for handling.
Article 25 The counties (cities) may formulate implementation rules in accordance with these measures.
Article 26 These Measures shall come into force on February 1, 2003 . The original "Tangshan city residents of the minimum subsistence guarantee interim measures" (Tang Zheng Fa [1998] No. 24) and "Tangshan city residents of the minimum subsistence guarantee implementation details" (Tang Government Office [1998] No. 7) shall be repealed at the same time.

I. Application
(1) Application conditions
Any family with a permanent urban household registration within the administrative area of the city and with a monthly per capita income of family members lower than the local minimum subsistence guarantee standard can apply to the community committee of the place where the household registration is located to enjoy the low subsistence guarantee treatment.
Those in the following situations are not eligible for low income protection:
1. Unemployed, unemployable, or laid-off people of working age who have the ability to work and have refused three times to accept employment offered by the employment agency without any justifiable reasons;
2. Drug addicts or gamblers who are still unrepentant;
3. Children attending a school of their own choosing at their own expense;
4. 4, the per capita use area of the family residence exceeds the local per capita use area of the previous year by more than three times (calculated according to three persons if the family size is less than three persons) or newly renovated housing within two years;
5, owning and using high-grade consumer goods such as automobiles, motorcycles, air conditioners and other household consumption levels of pure water, mineral water and other household consumption levels are significantly higher than the standard of the low income insurance;
6, the total amount of monthly consumption of the telephone The total amount (including monthly rent) for two consecutive months is higher than 18% of the local minimum security standard;
7, there is a high-value collection or investment securities behavior

9, the applicant and his/her family members refused to cooperate with the staff of the Minimum Security to investigate and verify the relevant information or provide false supporting materials;
10, because of failure to fulfill the obligations undertaken by the low-income objects and was canceled low-income qualification for less than half a year;
11, can not be determined alimony (fostering, support) provider of the elderly, sick and disabled persons and orphans, whose property was donated to another person, the property grantee is responsible for the alimony (fostering, support) support;

Second, the identification of family members
Family members generally include legal support (fostering, supporting) relationships and **** with the people living.
Special circumstances of the identification of family members:

(e) disappearance, absconding, serving a sentence of imprisonment is not considered as a family member.
Calculation of family income
The calculation of family members' income follows the principle of "calculating according to actual income". For employees applying for the minimum subsistence allowance, their income is calculated on the basis of the standard salary of the employer or the amount agreed upon in the labor contract (except for the individual's contributions to pension insurance, medical insurance, unemployment insurance, and housing provident fund); for laid-off workers of state-owned enterprises, and recipients of unemployment insurance and pension, their income is calculated on the basis of the relevant standards announced by the government.
If the actual income is difficult to be approved and in other special cases, the income shall be approved in accordance with the following paragraphs:
(1) If an in-service employee of a state-owned enterprise or a laid-off employee, for reasons such as the enterprise in which he or she is working has suffered long-term losses, or has ceased production, or has been semi-stopped production, does not receive, or does not receive in full, his or her salary or basic living allowance for more than six consecutive months, and the local labor security and economic and trade department confirms that it cannot make up for the loss afterward, and after it has issued the certificate
(2) If a laid-off employee of a state-owned enterprise receives the basic living expenses after being laid off and has other income through self-employment, his income (the sum of the two incomes of the laid-off living expenses and self-employment, hereinafter the same) shall be calculated with the minimum wage as the starting point;
(3) If an unemployed person receives the unemployment insurance benefits and has other income during the period of receiving the unemployment insurance benefits, the minimum wage shall be used as the starting point for calculating the income;
(4) The unemployed person who receives the unemployment insurance benefits shall have other income. The minimum wage is used as the starting point for calculating income;
(d) Healthy young adults (male 18-52 years old, female 18-48 years old) who are neither self-employed nor applying for employment shall have their income calculated according to the standard of the minimum subsistence guarantee (except for those who have infants or sick people in their families who need to be taken care of). Those who cannot be employed due to the lack of jobs can calculate their income on the basis of actual income with a certificate from the labor and employment department.
(e) For those who are self-employed and have relatively stable working hours or workplaces, the minimum wage shall be used as the starting point for calculating income. Those who choose their employment on a temporary basis and do not have stable working hours or workplaces shall calculate their income on the basis of the minimum living standard. Where it is difficult to verify the income of a disabled person who is self-employed, his or her income shall be appropriately reduced in accordance with the provisions of this paragraph;
(f) The one-time economic compensation and resettlement payment received by an enterprise employee who terminates a labor relationship, less the social pension insurance premiums due from the date of the termination of the labor relationship to the statutory retirement age, with the balance used for family living, shall be offset against the minimum subsistence guarantee standard until the deduction is completed before the employee is allowed to apply for the minimum subsistence guarantee (Compensations (except when the compensation is used to purchase means of production and engage in production and business);
(g) If a family receives a one-time income from housing demolition and relocation compensation for urban construction, dangerous housing reconstruction, demolition, etc., and there is a balance for the purchase of a housing unit, the balance shall be implemented in accordance with the provisions of paragraph (f) of this section;
(h) A family that has been converted into an urban resident for reasons of land expropriation receives a one-time income from resettlement compensation and the balance of the social pension insurance premium shall be deducted according to the provisions of this section. Pension Insurance, and the balance after payment shall be implemented in accordance with the provisions of paragraph (f) of this section. If there is still contracted land, it shall be calculated on the basis of the average land income of the previous year;
(ix) Families receiving other one-time compensation payments may refer to paragraph (vi) of this section. If the one-time economic compensation fee is exhausted due to force majeure factors, the compensation fee shall no longer be considered as the family income;
(j) If the family members include both urban and rural residents, the per capita income of the family shall be calculated jointly. If the per capita income is lower than the guarantee standard, only urban residents are guaranteed. The income of rural residents shall be implemented with reference to the corresponding provisions;
(xi) If any of the family members living together has a foreign household registration, the per capita income of the family shall be calculated jointly. If the per capita income is lower than the protection standard, only residents of urban hukou in the city will be protected. Foreign household residents with reference to the implementation of the corresponding provisions;
(xii) life can not take care of themselves, no income of the invalids, their family monthly per capita income is more than the minimum subsistence guarantee standard but the family life is really very difficult, the invalids themselves can be appropriate to enjoy the guarantee;
(xiii) alimony (fostering, support) support is calculated as follows: alimony (fostering, support) support obligations to the family as a unit Calculation, per capita income has not reached 1.5 times the minimum insurance standard, do not pay alimony (fostering, support). Per capita income of 1.5 times the low income standard family, the sum of its excess with the total number of alimony (fostering, supporting) dependents divided by the number of alimony (fostering, supporting) maintenance fee.

Third, the community committee acceptance and preliminary examination

(2) The community committee's low-income insurance evaluation team (two or more people) verifies the family members' employment status and income and actual living conditions such as food, clothing, housing and utilities through household surveys and visits to neighbors, and forms household survey materials (style as attached).
(3) The Community Resident Committee's Low-income Insurance Deliberation Group will conduct collective deliberation on the families applying for low-income insurance to determine whether they meet the conditions for low-income insurance. If they meet the reporting conditions, they will sign the Application Approval Form and report it to the street office together with relevant materials. It is also publicized on the community's public board. If the evaluation panel considers that the conditions for low income insurance are not met, the reasons for not approving the low income insurance treatment will be filled in the Notice Form and sent to the applicant, and a good explanation of the policy will be made.
(4) The community committee will complete the preliminary examination of the application materials within 7 days.
(e) accepting applications from households in difficulty whose domicile and place of residence are different, the community committee of residence shall first be entrusted with the investigation and verification of the family's living conditions and employment, and the issuance of supporting documents. The neighborhood committee of the community of residence shall cooperate with the investigation.

(vii) If the applicant is a collective household, the unit in which the household is located will fulfill the function of the community committee.
Four, the street office review
Street offices set up by the office cadres, social personnel involved in the assessment of the low income group. Low-income assessment team is responsible for reviewing the materials reported by the community committee, household verification, request for relevant supporting materials, consideration, reporting. The details are as follows:
(1) The Low-Income Security Review Panel first examines the investigation materials and deliberation results reported by the community committee, and assigns two or more members of the Low-Income Security Review Panel to conduct household verification and form verification materials.
(ii) The review team will complete the review within 15 days. The information of the family members who meet the conditions of low income insurance will be filled in the Application Approval Form, and the audit opinion will be signed in the relevant columns and reported to the county-level civil affairs departments. At the same time, the review opinion will be fed back to the community neighborhood committee, and the community neighborhood committee will be entrusted to make a second public announcement. If, after examination, the conditions for low income insurance are not met, the reasons for not approving the application will be entered into the Notice Form and the community committee will be entrusted to deliver it to the applicant.
(3) The street office may directly accept applications for low income insurance treatment from residents of newly built neighborhoods who have not yet set up community neighborhood committees, and perform the functions of low income insurance work undertaken by the community neighborhood committees.
Fifth, the county-level civil affairs departments for approval
County-level civil affairs departments set up by the director in charge and the relevant sections of the approval of the low income group, the approval group is responsible for the approval of low income materials reported by the street office, and within seven days to make a decision of approval or disapproval, entrusted to the street office and community committee for publicity and delivery of notice. The details are as follows:
(1) Under the auspices of the director in charge, the section responsible for the work of the low income insurance examines the materials related to the low income insurance reported by the street office one by one and assesses whether the conditions of the low income insurance are met, and verifies the conditions through external investigation or on the spot if necessary.
(ii) For those who meet the conditions of the low income insurance, the amount of the low income insurance will be approved. Sign and stamp the approval opinion in the relevant column of the application approval form. Enter the relevant data of the low-income households into the computer, fill in the relevant contents of the Low-Income Guarantee, and entrust the community committee to deliver the Low-Income Guarantee and the Low-Income Guarantee Passbook.
(3) For families that do not meet the conditions of the Low-income Guarantee, the county-level civil affairs departments will fill in the Notice of Reasons for Non-approval and entrust the community neighborhood committees to deliver the Notice of Reasons for Non-approval to the applicants.
County-level civil affairs departments will monthly report the amount of low-income insurance enjoyed by the low-income objects and their family addresses to the Municipal Civil Affairs Bureau for the record.
Sixth, management
(a) the low security payments to implement a dynamic management system.
Community committees, through visits and tracking surveys, should keep abreast of changes in the family income of the low-income objects; street offices should conduct quarterly re-examinations of the families of residents who have been enjoying low-income insurance; county-level civil affairs departments should organize a half-yearly spot check of low-income objects. Community neighborhood committees and street offices shall promptly investigate and verify the problems reflected by the public.
The changes in the family members and incomes of the low-income objects shall be reviewed and examined by the community committee and the street office, and then publicized in a public notice, and the signed opinions shall be submitted to the county-level civil affairs departments for the change procedures.
