Resettlement of Disabled Soldiers

China's Ministry of Civil Affairs, Ministry of Finance, and the relevant departments of the PLA General Staff Department, General Political Department, and General Logistics Department have recently jointly issued the Provisions on the Retirement and Resettlement of Disabled and Sick Soldiers (hereinafter referred to as the Provisions). This is the first time that the Chinese Government and military authorities have made a comprehensive standardization, in the form of military administrative regulations, of the manner in which disabled and sick soldiers are to be discharged from military service, as well as of their housing and medical care. The Provisions*** contain eight chapters and 26 articles, which specify the manner in which disabled and sick soldiers are to be discharged from military service. It stipulates that officers and civilian cadres who have been disabled as a result of war or public service, and who have been assessed as having disabilities ranging from Grade 1 to Grade 6, or who have been medically certified as basically incapable of work after the expiration of the medical treatment period for their illnesses, as well as non-commissioned officers who have been assessed as having disabilities ranging from Grade 1 to Grade 4, or who have been medically certified as basically incapable of work after the expiration of the medical treatment period for their illnesses, may be resettled as retirees. After the approval of the retirement of disabled military personnel, they are to be resettled in a timely manner under the resettlement plan. Junior non-commissioned officers suffering from mental illness who have been assessed as having a Grade I to Grade IV disability, and conscripts who have been assessed as having a Grade I to Grade IV disability as a result of war, public service, or illness, shall be supported by the State for life. Non-commissioned officers with disabilities resulting from war, public service or illness who meet the conditions for retirement and voluntarily give up retirement resettlement may choose to be supported by the State for the rest of their lives. Official sources pointed out that the "Provisions" focus on the country's economic and social development situation, reflecting the deep concern and great importance that the Party and the State attach to the disabled soldiers, and specifically establish the disabled soldiers' retirement and resettlement allowances. The Provisions make it clear that, when disabled soldiers are transferred to the Government for resettlement, the military will provide them with a one-time resettlement subsidy based on their disability, in order to resolve their practical difficulties. The housing subsidy standard for disabled soldiers has been substantially increased, making it clear that the basic housing subsidy for disabled retired soldiers is less than 100,000 yuan, and that if the place of resettlement is in a high-priced area, a regional housing subsidy will be given in accordance with the military regulations. The central financial authorities provide subsidies to preferential hospitals that receive veterans with first- to fourth-degree disabilities and severe mental illnesses, to be used for such expenditures as additional beds, medical equipment, and housing repairs. At the same time, it stipulates that financial departments at all levels should increase their investment in medical insurance funds for disabled and sick soldiers. The Provisions also establish a system of accountability, clarifying the circumstances under which violations of policies and regulations in the transfer and resettlement of disabled military personnel should be penalized, as well as the handling of disabled veterans who refuse to validate their resettlement or go through the transfer procedures without justifiable reasons. The Provisions point out that disabled military personnel have made important contributions to the construction of the State and the armed forces, and should be respected and treated favorably by the State and society. Proper placement of disabled soldiers is the local governments at all levels and military organizations at all levels of *** with the political responsibility to adhere to the policy of national defense and military construction services, the implementation of the people-oriented, proper placement, the principle of each in its place, and solidly promote the scientific development of the disabled soldiers retirement resettlement work. The specific resettlement allowance should be consulted at the local civil affairs bureau where you are resettled, as it is calculated based on the average of the local per capita income.
